HEARING CERTIFICATION DOCKET NO. 2018-55 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0026, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY 5.45 MILES IN LENGTH (16 -INCH DISCHARGE PIPELINE) IN THE A (AGRICULTURAL) ZONE DISTRICT — DCP OPERATING COMPANY, LP A public hearing was conducted on June 13, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro -Tern - EXCUSED Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Clerk to the Board, Esther Gesick Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated April 24, 2018, and duly published April 27, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of DCP Operating Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0026, for a greater than 12 -inch high pressure natural gas pipeline approximately 5.45 miles in length (16 -inch discharge pipeline) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Moreno advised the applicant and the public that Commissioners Kirkmeyer and Conway are excused, and approval will require a unanimous vote from the present Commissioners. The applicant agreed to proceed. r__= Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the Milton Discharge Pipeline will connect to the Milton Compressor Station and terminate at the Crossroads Booster Station. He stated the newly constructed pipeline will increase transfer capacity, decrease traffic on roads, and support safer transport of natural gas in the County. He reviewed the rights -of -way easements during and after construction, burial depths, and ancillary equipment. Mr. Ogle reported the site is not in the three (3) mile referral area of any municipality and stated the referral response from the Colorado Division of Wildlife cited no concerns and no referral response was received from History Colorado. He reviewed the requirement for an Emergency Action Safety Plan and stated the entire length of the pipeline is designed as required by the Colorado Department of Transportation, Hazardous Materials Safety Administration. Mr. Ogle reported no letters or phone calls have been received from surrounding property owners, he presented the site map displaying the pipeline route, and entered the unanimous favorable recommendation of the Planning Commission into the record as written. Hayley Balzano, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements and described the location in relation to relevant County roads. She stated, per the application materials, there are no temporary or permanent access points planned outside of the pipeline right-of-way and any access points will require a Weld County Access Permit. She reviewed the classifications of the impacted local roads, boring depths at roadway crossings, and clarified that after construction is complete, the applicant anticipates occasional traffic related to pipeline inspections or maintenance. Ms. Balzano stated accesses may require temporary tracking control during construction and a temporary Improvements Agreement will be required during construction. She explained pipelines are exempt from drainage requirements and a Weld County Grading Permit will be required if disturbing more than an acre. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating portable toilets can be used along the construction route, an Air Emissions Permit will be required if disturbing more than 25 acres, and Development Standards (DS) #13-20 address Environmental Health items. Kent Naughton represented the applicant and stated the proposed pipeline will be beneficial to the County and reduce the number of trucks. He requested the Board consider modifying DS #8 regarding the boring depths at road crossings to allow DCP to meet those requirements or to submit alternative depths to the Department of Public Works for approval, based on the safest and best engineering design. He explained this would allow for some flexibility to alter the engineering and continue to work with Public Works as some of the added depths would require renegotiation with some of the property owners. After further discussion, Commissioners Cozad and Freeman stated they agree with the recommendation to ensure depths are sufficient based on good engineering and documentation. Chair Moreno emphasized the huge investment made to CR 49 and requested assurance that any crossing will not impact CR 49. No public testimony was offered concerning this matter. El In response to Chair Moreno, Mr. Naughton indicated no other comments. Mr. Choate provided language to amend DS #8 to read, "Any oil and gas pipeline crossing a County road shall be bored in accordance with the Right -of -Way Permit from the Department of Public Works." IEJ In response to Chair Moreno, Mr. Naughton indicated, on behalf of DCP Operating Company, LP, that he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. 2018-1749 PL2554 HEARING CERTIFICATION - DCP OPERATING COMPANY, LP (USR18-0026) PAGE 3 Commissioner Freeman moved to approve the request of DCP Operating Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0026, for a greater than 12 -inch high pressure natural gas pipeline approximately 5.45 miles in length (16 -inch discharge pipeline) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Cozad, and it carried unanimously. There being no further discussion, the hearing was completed at 10:52 a.m. This Certification was approved on the 18th day of June, 2018.
