RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING, PCSC18-0005,
CONCERNING USE BY SPECIAL REVIEW PERMIT, USR16-0029 - REYNALDO
BONILLA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 9th day of April, 2018, a Probable Cause Hearing was held before the
Board to consider setting a Show Cause Hearing to determine whether or not Reynaldo Bonilla,
21505 County Road 22, Hudson, CO 80642, was in compliance with certain Conditions of
Approval and Development Standards contained in Use by Special Review Permit, USR16-0029,
for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the
Commercial or Industrial Zone Districts, (event center for up to 200 people, along with an
operating office and shop for tack sales) provided that the property is not a lot in an approved or
recorded subdivision plat or part of a map or plan filed prior to the adoption of any regulations
controlling subdivisions in the A (Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as
Lot A of Recorded Exemption, RE -4329; being part of the NE1/4 of Section 10, Township 2 North,
Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, the Board heard evidence and testimony from all interested parties at said
Probable Cause Hearing and determined the issues of non-commercial horse race training and
exceeding 60 vehicle trips would be resolved by the property owner accepting donations and
tracking /logging attendance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Probable Cause Hearing to determine whether or not to revoke Use
by Special Review Permit, USR16-0029, issued to Reynaldo Bonilla, be and hereby is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 9th day of April, A.D., 2018.

attached photos and links to videos
E-mail forwarded to applicant's representative
Staff reviewed e-mail, photos & videos
Chris Gathman showed the videos to Reynaldo Bonilla (property owner) and
informed him that staff would be proceeding with a probable cause hearing. Mr.
Bonilla indicated that no more horse racing would be occurring onsite.
Probable Cause notice mailed via Certified Mail to Reynaldo Bonilla
Notified Complainant of Probable Cause hearing date & location via e-mail
SUBJECT: Probable Cause Hearing for USR16-0029 - A Site Specific Development
Plan and Use by Special Review Permit for Any Use Permitted as a Use by Special
Review in the Commercial or Industrial Zone Districts, (Event Center for up to 200
people, along with an office and shop for tack sales) provided that the property is not
a lot in an approved or recorded subdivision plat or lots part of a map or plan filed
prior to the adoption of any regulations controlling subdivisions in the A (Agricultural)
Zone District.
Development Standard #1 states: The Site Specific Development Plan
and Use by Special Review Permit, USRI6-0029, for Any Use Permitted
as a Use by Special Review in the Commercial or Industrial Zone
Districts, (Event Center for up to 200 people, along with an office and
shop for tack sales) provided that the property is not a lot in an
approved or recorded subdivision plat or lots part of a map or plan filed
prior to the adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District, subject to the Development Standards
stated hereon.
USR16-0029 Development Standard #6 states: This facility
includes a non-commercial training facility. Any events related
to the arena and practice track shall require a Temporary
Assembly Permit or may require an amendment to this USR.
USR16-0029 Development Standard #30 states: The Use by
Special Review area shall be limited to the plans shown hereon
and governed by the foregoing standards and all applicable
Weld County regulations. Substantial changes from the plans
or Development Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld
County Board of County Commissioners ,before such changes
from the plans or Development Standards are permitted. Any
other changes shall be filed in the office of the Department of
Planning Services.
USR16-0029 Development Standard #31 states: The property
owner or operator shall be responsible for complying with all of
the foregoing development standards. Noncompliance with any of
the foregoing development standards may be reason for
revocation of the permit by the Board of County Commissioners.

130710100012) is not in compliance with USR16-0029 (Event Center for up to 200 people, along with an
office and shop for tack sales).
The Department of Planning Services has been provided photographic and video evidence that horse
racing has been occurring on this site. As a result, it has been determined that you are not in compliance
with the following Development Standards:
Standard 1
Standard 6
The Site Specific Development Plan and Use by Special Review Permit, USR16-
0029, for Any Use Permitted as a Use by Special Review in the Commercial or
Industrial Zone Districts, (Event Center for up to 200 people, along with an office
and shop for tack sales) provided that the property is not a lot in an approved or
recorddd subdivisionplat or lots part of a map or plan filed prior to the adoption of
any regulations controlling subdivisions in the A (Agricultural) Zone District,
subject to the Development Standards stated hereon.
This facility includes a non-commercial training facility. Any events related to the
arena and practice track shall require a Temporary Assembly Permit or may
require an amendment to this USR.
Standard 30 The Use by Special Review area shall be limited to the plans shown hereon and
governed by the foregoing standards and all applicable Weld County regulations.
Substantial changes from the plans or Development Standards as shown or
stated shall require the approval of an amendment of the Permit by the Weld
County Board of County Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
Standard 31
The property owner or operator shall be responsible for complying with all of the
foregoing development standards. Noncompliance with any of the foregoing
development standards may be reason for revocation of the permit by the Board
of County Commissioners.

A Probable Cause hearing is scheduled for this case and this hearing will take place at 9 AM on Monday,
April 9, 2018 in the Commissioner's Hearing Room, Weld County Administration Building, 1150 O Street,
Greeley, Colorado. The purpose of this public hearing will be to review case number USR16-0029 for
compliance with the Development Standards as approved by the Board of County Commissioners on
January 11th, 2017 to determine if probable cause exists to hold a hearing of revocation of USR16-0029.
If it is determined at the public hearing that there is probable cause that you are not in compliance with
USR16-0029, the Board of County Commissioners will schedule a Show Cause public hearing to
consider revocation of the Use by Special Review permit.

granted to be conducting horse racing on his property every weekend like he is doing so today.
I have been in touch with the planner of this case and neighbors that attended his last hearing on
February 14th, and it's clear that he can't be doing such events, selling food, alcohol without a
permit.
So when will this be stopped?

So when will this be stopped?
