HomeMy WebLinkAbout790209.tiff RESOLUTION RE: REQUEST FOR SPEED ZONING TO 30 MPH ON THE NORTH HALF OF WELD COUNTY ROAD 42 AT STATE HIGHWAY 85. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the town of Gilcrest has requested that traffic on Weld County Road 42 (the North boundary of the town) be slowed to 30 miles per hour, and WHEREAS, the Weld County Department of Engineering Services has recommended to the Board of County Commissioners of Weld County, Colorado that the speed zone on the North half of Weld County Road 42, at State Highway 85, be posted at 30 miles per hour, and WHEREAS, the Board of County Commissioners has studied the recommendations of the Department of Engineering Services and has determined that the speed zone to 30 miles per hour is necessary to insure safety to the traveling public. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Board deems it advisable and in the best interests of Weld County to speed zone the North half of Weld County Road 42, at State Highway 85, to 30 miles per hour. BE IT FURTHER RESOLVED by the Board that said traffic con- trol device must conform to the State Manual and specifications. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 4th day of June, A.D. , 1979 . Dear Mr. Smith : On behalf of the Town Board of Gilcrest I am requesting the county to lower the speed limit on County Road 42 where it forms the north boundary of the town. At present there are nine homes that have driveways that enter onto the road. The present speed limit is 55 m.p.h. . I would request that it be lowered to the 25 to 35 m.p.h. range . If there is a formal process that must be gone through to lower the speed limit, please inform me of the same and I will see to it that the town takes the necessary steps. If you wish to discuss this matter with me I may be reached at the Ault Town Hall on Monday, In Gilcrest on Wednesday mornings at the Town Hall and on Wednesday afternoon at the Severance Town Hall. Box 8 Gilcrest, Colorado 80623 Dear Craig: In reply to your letter of April 26, 1979, there are two (2) ways your problem could be handled: 1) For the County to post lower speed limits on the County portion of Weld County Road 42 adjacent to Gilcrest, or 2) The Town of Gilcrest to annex the County portion of Weld County Road 42 and post its own speed limits. Option (1) would be the easiest for the town, but probably the least satisfactory, in that the County has no statutory authority to enforce speed limits on County roads. You would have to depend on the State Patrol for enforcement; normally they come around to County locations only in the case of an accident. Option (2) would require more administration work, i .e. , to annex; however, once done the town would have the authority to post and patrol the road as it sees fit. Of course, annexing the road would entail assumption of maintainence and repairs too. Let us know what you 'd like to do. If you want to have the County post the road, I will put it before the Board of County Commissioners for action. If you desire to annex, that can be done unilaterally by the town. PO Box 758 Greeley, CO Dear Mr. Smyth: In reply to your letter of May 2, 1979, the Town of Gilcrest would appreciate it if the county would post County Road 42 on the north edge of town at 30 m.p.h. . Although the town limits only extend from Elm Street to Highway 8$ , the Town would appreciate it if the road would be posted at 30 m.p.h. from Elm Street to Highway 85. Since the south z of the road is in the town limits , the Town assumes that it can enforce the speed limit on the south lane . Is there some way the Town Police Department can also enforce the speed limit on the county portion of the road? I would appreciate it if you would take this proposal to the County Commissioners . Larson Circuit Rider City Manager Dear Craig: In response to your letter to the County Engineer dated May 16, 1979, the Board of County Commissioners has approved on June 4, 1979 the posting of 30 miles per hour limits on the north side of Weld County Road 42 at Gilcrest. It should be pointed out that this will not give you positive control over traffic speeds , since you will have to rely on the State Patrol for enforcement. I We know of no legal way for Gilcrest to enforce speed limits on what is now the County half of the road. It is strongly recommended that the Town of Gilcrest initiate action to annex the north half of Weld County Road 42, which lies within the city limits. In the interest of safety and traffic control , this appears to be the only effective long range solution to your problem.
