RE: APPROVAL OF RECORDED EXEMPTION NO. 421 - COLUMBINE JERSEY
FARMS, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 24th day of October, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado , that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No . 421, being the property of Columbine Jersey Farms ,
Inc. , described as the Northeast Half of Section 5 , Township 1
North, Range 67 West of the 6th P .M. , Weld County, Colorado,
being more particularly described as follows :
Lot B
A parcel of land located in the Southwest
Quarter of the Northwest Quarter of Sec-
tion 5 , Township 1 North, Range 67 West
of the 6th P.M. , Weld County, Colorado,
and more particularly described as follows:
Beginning at the Northwest corner of said
Section 5; thence South 00°50 '00" East
along the West line of said Section 5 a
distance of 1408 . 16 feet to the True Point
of Beginning; thence continuing along the
West line of said Section 5, South 00°50 ' 00"
East a distance of 1320 .00 feet; thence
South 89°40 ' 20 " East a distance of 360 .18
feet; thence North 00°50 '00" West parallel
to the West line of Section 5 , a distance
of 1320 . 64 feet; thence North 89°46 '25" a
distance of 360 . 18 feet to the True Point

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Columbine Jersey Farms , Inc. be, and
hereby is, exempt from the definition of the terms "subdivision"

and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended subject to the plat
being changed to reflect the 75 feet of right-of-way reservation
on State Highway 52 prior to having the plat recorded and also
subject to a notation being placed on the plat regarding a
setback of 200 feet from the Town of Dacono limits.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
October, A.D. , 1979 .

Dear Commissioners:
The attached application, plat and related items are in reference
to a request from Columbine Jersey Farms, Inc. , for a recorded
exemption. The parcel of land on which this request has been made
is described as the Ni Section 5, T1N, R67W of the 6th P.M. , Weld
County, Colorado. This property is located adjacent to the east
side of the Town of Dacono. The property contains approximately
310. 160 acres of Class II and IV irrigated soils. The request is
to split the property into parcels of 10. 006 acres and 300. 154
acres.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the use would be compati-
ble with the surrounding agricultural uses. Agriculture and
related uses would continue to be the predominant land use.
2. The Town of Dacono has no objections to this exemption provided
drilling operations are conducted at least 200 feet from the
Town Limits and that within six months from the date drilling
starts, hydraulic pumping equipment is used by the wells.

3. The request complies with the provisions of Section 9-4A. of the
Weld County Subdivision Regulations.
4. The Weld County Engineering Department has no objections to this
request provided all accesses shall be constructed in accordance
with the recommendations and/or requirements of the Weld County
Engineering Department .
The State of Colorado Department of Highways has indicated the need
for a reservation of 75 feet of right-of-way on the south side of
State Highway 52. The Department of Planning Services recommendation
for approval is conditional upon the plat being changed to reflect
the 75 feet of right-of-way reservation on State Highway 52 prior to
having the plat recorded.
Based upon the recommendation of the Weld County Health Department ,
it is the opinion of the Department of Planning Services Staff that
the 200 foot setback as requested by the Town of Dacono is a
reasonable request . The Department of Planning Services recommenda-
tion for approval is conditional upon a notation being placed on the
plat regarding a setback of 200 feet from the Town of Dacono Limits.

Re : Application for Recorded Exemption
Dear Sirs :
A recorded exemption for the subdivision of ten acres out of a
larger parcel generally described as the North Half of Section 5 ,
Township 1 North, Range 67 West is requested because Martin Oil
Service, Inc. is desireous of purchasing the ten acre parcel for
the drilling of four oil and gas wells . The wells would be drilled
directionally from the ten acre parcel to bottom hole locations
in the North East Quarter of Section 6 , Township 1 North , Range
67 West, where Martin Oil Service , Inc. holds an interest in the
mineral rights .
The subdivided ten acre parcel would be used for oil and gas
drilling and producing operations. Land not needed for these
operations would retain their present usage . Lands in the larger
parcel would retain their present usage.
Water is available from the Central Weld County Water District.
Sewage disposal will be into a septic system.

Dear Ms. Traxler:
This letter is in response to G. Olson request for information
concerning the use and access from Weld County Road 15. At the
town of Dacono Planning Commission meeting 10/9/79 this letter was
presented and the Town of Dacono P. C. had no objections to Martin
Oil Service, Inc. using the west half of Weld County Road 15.
The type of access that would be required would be one 40' wide
access near the north edge of lot B. This would be a 90° gravel
surfaced turnoff.
During drilling operations 30-50 vehicle trips per day will be
required, for a duration of 30-40 days. After the wells are comple-
ted one tank truck per week and one pickup truck per day will be
required.
The gas line owned by Coors is located on the west shoulder of
Road 15 as stated by Len Folkerts 10/10/79. This location would be
unaffected by a driveway to the east.
Panhandle Eastern has a gas line in the area and they will be
contacted to spot their line and assess the adequacy of cover over the
line prior to the moving on of any equipment.
Storm drainage will be routed in existing channels, 1-18" X 40'
culvert will be placed on the east edge of County Road 15 at the
driveway access.

The Dacono Planning Commission met on October 9, 1979 and considered
the application for the recorded exemption on the parcel of land
described as N'4 Section 5, T1N, R67W.
It is the opinion of this board that this exemption be allowed with the
stipulation that Martin Oil be requested to stay at least 200 ft. from
the town limits and that within six months from the date drilling starts,
they use hydraulic pumping equipment.
As to the request for input from Gil Olsen regarding the use of Road
15, the only concern would be the amount of traffic to the well sites.
Martin Oil has assured the town that the traffic will not be excessive.

Weld County Road 15 is maintained by the County but the west half is in
the City Limits of Dacono. Therefore, the Town of Dacono should have

2. How much traffic, if any, will this request generate?
3. How storm drainage, if any, will be handled from proposed Lot B.
4. Existing oil and gas lines in Weld County right-of-way must be
