Dear Sir :
As we have not received a copy of the complaints that
you have listed , 1• e have proceeded on the major violations in
the construction of your home that we noted in our inspection .
We have sent you a copy of these items .
We have eliminated the following for reasons given below :
1 . Nuts on foundation bolts , pressure from the nuts •
facilitate the straightening of the mud sill . Any winds
that would move the home after completion on the walls
would not be stopped from causing damage by the nuts
being on the bolts .
2 . Dryer vent not screwed together , minor home maintenance .
3 . No corner bracing in north east corner of garage , corners
braced in north west corner , overhead door set and unit
all sided , do not feel the installation of bracing at
this time would accomplish anything . •
4 . Crack between home and stoop , believe caused by
normal shrinkage and a slight settlement , believe
caulking is minor home maintenance .
5 . Ventilation in garage , not required per Sec . 1502 .

Gentlemen:
Due to a complaint by Virgil Sharp , the owner who
purchased a home built by your company on Building Permit
#3483 issued May 16 , 1974 , we made an inspection and found
the following :
1 . The home was built and occupancy was given
without the final inspection . This is a violation of
the Building Code and is classed a misdemeanor
UBC - 1973 Section 304 Sec . ( d ) Item 4 and Sec . 205 .
2 . No flashing between the house and garage roof
and over the front door area causing water leaks in
the home ( Sec . 3208) .
3 . No ventilation in crawl area ( Sec . 2517 , Sec . 6 ) .
4 . Access to crawl area blocked by furnace and Hot
Water installation ( Sec . 2517 , Sec . 2 ) .
5 . One-half inch ('-i" ) sheet rock between garage and
home , no evidence of fire rating ( Sec . 503 sec . ( d ) 4 ) .
6 . No step a,nd landing to garage floor 10 'z" rise
( sec . 3303 sec . ( h ) .
7 . Wood around chimney tight to masonry , code requires
two inch ( 2 " ) clearance ( table 37 -B ) .
8 . No evidence of caulking around windows , flashing
on top of Hick ledge and side of chimney next to home .
Will need to be caulked ( Sec . 1707 ) .

9 . Finish grade of earth too high on siding . Minimum
six inch ( 6 " ) clearance required between siding and dirt .
( Sec . 2517 , Sec . 7 ) .
These are basic code violations and not conditions
caused by use or depreciation due to time . These are
conditions that would have required corrections at the
Final Inspection had it been called for . We therefore
request that these items be corrected in the near future to
conform with the Building Code , UBC 1973 .
Please advise this office of your schedule for corrections
by February 6 , 1976 .

Dear Sirs:
We are in receipt of your letter dated January 23, 1976 in reference
to building permit #3483 and alleged code violations stated in your
letter.
We wish to take this opportunity to state our position in this matter.
We believe there was a final inspection given even though not
evidenced by a certificate of occupancy. At the time the house
was constructed and inspected it was not an automatic thing for Weld
County to issue a certificate even when requested. We
experienced having to drive to Greeley to get certificates. For
this reason we do not believe that because there. is no record of
a certificate there was no final inspection.
Almost without exception the items listed in your letter are items
that should have been inspected during construction and not only
upon final completion of the building.
Item #7 of your letter we believe is specifically unreasonable as
Weld County did not hcgin enforcing this requirment until approximately
one year ago and after the building in question was finished. It is
interesting to note that even to this date no other county, town, or
city in which we build, including Larimer and Boulder counties, the
cities of Boulder and Lafayette, enforces this code in 'the same manner
as Weld County does.

We believe this whole situation is unreasonable and unjust and is
being applied in a discriminatory manner. We have not been notified
by the owners in any form of their complaint or any request for repairs
or warranties to be performed on the items listed in your letter.
We request that you review our position and that of the county and
expecially in respect to the county's procedures existing at the time
of construction.
We will await your reply before taking any further action.

Dear Sirs :
We are in receipt of your letter of February 5 , 1976
in which you have taken exceptions to our letter of
January 23 , 1976 .
As you no doubt noted in our letter , there was no
mention of a Certificate of Occupancy . We also note that you
realize a final inspection is required under Code . This
particular job did not have a final inspection. See copy
of enclosed permit and records of inspection .
The list of violations are a type that are generally
completed between the framing stage and the final inspection .
The siding could possibly be installed before the framing
inspection . As stated , if a final inspection had been called
for and the inspection made , these violations would have been
noted and the correction of same could have been made before
occupancy .
In reference to item #7 , Table 37B _ Chimney Serving
Residential Type Appliances , clearly indicates on interior
installation , the Code requires a 2" clearance of combustible
materials . In this project you are , as stated , "tight " to
the chimney , no clearance .
Weld County has adopted the UBC-1.973 and has enforced
this section since 1973 . What the other towns or counties
enforce or don ' t enforce within the Code is not our concern .
We are sure if you check in your Code Book ( IIBC-1973 ) you
will see that this question leaves no other interpretation .

The owner states that she and her husband have
at various times talked to Mr . Tull and to you personally
about these problems and to date , they have not received
any satisfactory replies . We are enclosing a letter that
the Sharp ' s sent to the commissioners and a list of problems
that the Sharp ' s are objecting too .
We believe at one time someone from Tradition Homes
called our office and stated that our office was discriminating
against that company . We seem to detect a similar feeling
in your letter of February 5 , 1976 . To let you judge your
own workmanship , we are sending you the inspection reports on
the 3 homes that Tradition Homes is building with special
emphasis on the framing reports . Please note the pattern of
work to be corrected , particularly in reference to flashing .
This work follows neither the Code nor standard acceptable
practice in construction for residential work . In these
cases , it is not discrimination , it is just poor
workmanship .
As to the Sharp project , we cannot see any unreasonable ,
unjust or discrimination being applied as the Code Violations
that we have listed are there to see on the home . They can
be checked in the Code Book . The records show that the
. final you refer to has not been made .
We request you review your position in regards to the
above violations and advise us of your decision either to
correct same , or, if you do not intend to do so by
February 20 , 1976 .

10. Step into garage to high
11. Front stoop is sinking because it was not attached to house
12. Improper siding on north east corner of garage
13. No slant (away from window) on bottom level windows
14. Fireplace brick touches wooden structure in garage
15. Flue opening too small
16. Chimney is not 2' higher or 10' away from top of roof
