HomeMy WebLinkAbout20181421.tiffRESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF SECTION LINE COUNTY ROAD RIGHT-OF-WAY - DENNIE KUTCHER, WILLIAM AND HOLLY SUTTON, AND FRANCIS HARVEY, C/O LEONARD HARVEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Dennie Kutcher, 31608 County Road 74, Galeton, Colorado 80622, William and Holly Sutton, 946 Stannard Avenue, Indiana, Pennsylvania 15701, and Francis Harvey, 37321 Highway 392, Briggsdale, Colorado 80611, c/o Leonard Harvey, 36812 County Road 80, Briggsdale, Colorado 80611, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of a portion of Section Line road right-of- way, being more fully described as follows: All of the right-of-way along the Section Line starting at the southwest corner of Section 24, Township 7 North, Range 63 West, and running east one (1) mile more or less to the southeast corner of Section 24; except the right-of-way for County Road 71 being the westerly thirty (30) feet of Section 24, and except the right-of-way for County Road 73 being the easterly thirty (30) feet of Section 24, all being in Township 7 North, Range 63 West of the 6th P.M., Weld County, Colorado, as further described in Exhibit B. WHEREAS, the Department of Public Works has recommended denial of said request since that portion of right-of-way is needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. CDOT suffered through a 3+ week computer hacking attach beginning the end of February. I am just now catching up so to speak. If our comments can still be incorporated, I would appreciate that. To answer your question: CDOT typically would prefer that the proposed vacation be utilized for all of the surrounding neighbors as an access point if at all possible. The blue rectangle aligns nicely with the distance from CR 80. We have been working with Mr. Kutcher since last fall. I realize he has some issues with access for his parcel related to neighboring parcels. Having said that, CDOT would only object to the ROW vacation for the specific areas where the ROW overlaps with the Hwy 392 ROW. For the remaining portion of the proposed rectangle, we would prefer the ROW remain but will not formally request that it does. MEMORANDUM TO: Board of County Commissioners DATE: May 1, 2018 FROM: Tiffane Johnson, Public Works Department SUBJECT: Right of Way Vacation Request Description of Public Right of Way Being Requested to be Vacated All of the right of way along the section line starting at the Southwest corner of Section 24, Township 7 North, Range 63 West and running East one mile more or less to the Southeast Corner of Section 24, Township 7 North, Range 63 West; except the right of way for Weld County Road 71 being the Westerly 30 feet of Section 24 and except the right of way for County Road 73 being the Easterly 30 feet of Section 24, all being in Township 7 North, Range 63 West of the 6`h P.M., Weld County, Colorado. General Information The Petitioners, Dennie Kutcher and Leonard Harvey are requesting to vacate one mile of non -maintained public road right of way located in Section 24, Township 7 North, Range 63 West of the 6th P.M. The right of way being requested to vacate is the south 30' feet of Section 24 and is commonly referred to as section line right of way. There is no physical road however, the right of way is along the alignment of where County Road 78 would be. The right of way is located south of County Road 80 (maintained) between County Road 71 (maintained) and County Road 73(un-maintained). Mr. Kutcher previously owned the southeast quarter of Section 24 and recently processed a four -lot recorded exemption known as RECX 17-0124 recorded on November 11, 2017 at reception 4351448. The Recorded Exemption plat identifies the existing right way along the south line of Lot C and Lot D as 30' County Road Right of Way per Book 86, page 273 Reception number 34823 recorded on October 14, 1889. A review of assessor records indicate that Mr. Kutcher still owns Lot A, Lot B and Lot C of RECX 17-0124 and recently sold Lot D of RECX 17-0124 to William and Holly Sutton. William and Holly Sutton do not appear to be included in the petition to vacate. Mr. Leonard Harvey, acting as Power of Attorney for Francis L Harvey owns the southwest quarter of Section 24 and that portion of Section 25, Township 7 North, Range 63 West of the 6`h P.M. lying directly south and adjacent to the above described right of way being requested to vacate. WOGLA 17-0059 has recently been permitted in the southwest quarter and the associated Access Permit AP 17-00407 has been issued at a point generally located where CR 71 and CR 78 would intersect. The owners should be aware that future development would require the existing access point to be shared by the existing oil and gas operation and the future development regardless of the type of use per the Weld County Code. Existing County Road Right of Way Based on the information available we have determined the following: • 30' of public right of way exists along the south 30' of Section 24, Township 7 North, Range 63 West of the 6` P.M. per the 1889 Resolution. • The total area of the ROW to be vacated is approximately 158,400 sq ft.(3.63 acres) • There is no ROW in Section 25. • No parcel is left without access. • The Public Works CIP 5 Year Plan does not identify any improvements to be made in this area. Recommendation Public Works does not typically support requests for right of way vacations to ensure the ability to provide adequate and safe traveling for the public while reserving opportunities for future development of property. Public Works has growing concern related to the number of Recorded Exemption lots created and the potential to limit the extension of utilities that are necessary to serve these lots when rights of way are vacated. This application was a little confusing but just to make sure I am on the right page it appears from the email in the vacation application that they are only requesting the vacation of CR 78 in Section 24 for the entire mile. I see they have "NA or None" for utilities but do not have any letters from the electric power providers. I would like to send a referral to the power company in this area to make sure they are aware of the vacation request as they may have been relying on a route that we are not aware of to service all the RE lots just created. On a daily basis we get lots of calls from power companies needing to utilize the section line ROW to bring power to RE lots being created and they are surprised to find that it may be there. I don't see any documentation provided in the application to remove that concern for me at this point. I don't feel I need a meeting but I think we should have something from the power company indicating they are in support or that they have a route determined to facilitate bringing power to the lots. I also see that the Harvey's appear to be using a road to get from their property between Section 19 and 25 and I guess I would like something from them acknowledging that they understand that vacating the ROW along CR 78 may not allow them to do that any longer. Frank as a requirement of the vacation I would like to require Denny prepare and record deed for Lots C and D concurrent with the vacation so that we can make sure it is addressed in legal description correcity on the first deed conveyed after creating the lot.
