HomeMy WebLinkAbout750706.tiff RESOLUTION RE: CONSTRUCTION OF THE HAYDEN - AULT 345-KV TRANSMISSION LINE IN WELD COUNTY, COLORADO. WHEREAS, the United States of America (Bureau of Reclamation) is desirous of establishing a proposed Hayden-Ault 345-KV transmission line, and WHEREAS, an AGREEMENT has been submitted by the United States of America (Bureau of Reclamation) to the Weld County Board of County Commissioners, copy attached herewith, including all Exhibits thereto and showing thereon the route of said Hayden-Ault transmission line as same affects Weld County road crossings, and WHEREAS, the Board believes it to be in the best interests of the County to enter into such an Agreement in accordance with the conditions and stipulations as contained therein. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said AGREEMENT, including all Exhibits thereto, providing for the construction of the Hayden-Ault 345-KV transmission line, in Weld County, copy of which is attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be, and it hereby is authorized to execute the Agreement as submitted and to make the same effective forthwith. Terry, Jr. Construction Engineer Enclosures PO 6> 2 F 0 m ^a2 1176.1916 Contract No. 14-06-700-8266 UNITED STATES DEPARTMENT OF THE INTERIOR BUREAU OF RECLAMATION COLORADO RIVER STORAGE PROJECT TRANSMISSION DIVISION HAYDEN-AULT 345-kV TRANSMISSION LINE AGREEMENT WITH WELD COUNTY, COLORADO, FOR CROSSING CERTAIN COUNTY ROADS WITH THE HAYDEN-AULT TRANSMISSION LINE THIS AGREEMENT, made and entered into this 3rd day of December , 19 75, pursuant to the Act of Congress approved June 17, 1902 (32 Stat. 388) , and all acts amendatory thereof or supplementary thereto, between the UNITED STATES OF AMERICA, acting by and through the Bureau of Reclamation, Department of the Interior, hereinafter called the United States , and WELD COUNTY of the State of Colorado, hereinafter called the County; WITNESSETH: WHEREAS, the United States will construct the Hayden-Ault 345-kV Transmission Line, herein called the Transmission Line, as a feature of the Colorado River Storage Project; and WHEREAS, this Transmission Line will cross certain County Roads ; NOW, THEREFORE in consideration of the stipulations and covenants herein contained, it is agreed by and between the parties hereto as follows : 1 . The County hereby grants to the United States the perpetual right to construct, operate and maintain said Transmission Line over and across those roads at the six locations listed herein and as shown on • Exhibit A, being Bureau of Reclamation Drawing No. 864-732-2301 attached hereto and made a part hereof: LOCATION Transmission Line Station 27+00 Centerline County Road No. 86 Along Section line common to Section 6, T7N and Section 31 , T8N, R66W, 6th P.M. Transmission Line Station 49+59 Centerline County Road No. 25 SE', Section 36, T8N, R67W, 6th P.M. Transmission Line Station 171+78 Centerline County Road No. 90 Along Section line common to Sections 26 and 23, R67W, 6th P.M. Transmission Line Station 292+25 Centerline County Road No. 19 Along Section line common to Sections 15 and 16, T8N, R67W, 6th P.M. Transmission Line Station 377+68 Centerline County Road No. 96 Along Section line common to Sections 8 and 5, T8N, R67W, 6th P.M. Transmission Line Station 494+11 Centerline County Road No. 100 Along Section line common to Sections 31 and 30, T9N, R67W, 6th P.M. 2. The United States will construct said Transmission Line without expense to the County in accordance with Bureau of Reclamation standards for a 345-kilovolt, 3-phase, 60-hertz, steel-tower, single-circuit trans- mission line with aluminum conductor, steel reinforced, and two overhead ground wires utilizing an appropriate protective angle. Said Transmission Line is designed as specified in the National Electrical Safety Code for heavy loading conditions and clearances will be equal to or greater than those specified in said Safety Code. Any required changes in design and construction of said Transmission Line over and across said roads differing from Code requirements will be as mutually agreed between the County and the United States. -2- 3. The United States will require its contractor to observe standard regulations of the County with respect to handling of traffic, and to provide, erect and maintain all necessary barricades , suitable and sufficient red lights , danger signals , and signs , and to take all necessary precautions for the protection of the work and the safety of the public. 4. The Transmission Line will , at all times after construction, be operated, maintained, repaired, and renewed by the United States without expense to the County. 5. If the United States damages the County's property while constructing, operating, or maintaining said Transmission Line, and fails to repair such damage, the County will be reimbursed for the direct costs of repairing the damage plus administrative costs not to exceed 15 percent of the direct costs upon receipt of a certified cost statement. 6. No member of or Delegate to Congress or Resident Commissioner shall be admitted to any share or part of this contract or to any benefit that may arise herefrom, but this restriction shall not be construed to extend to this contract if made with a corporation or company for its general benefit. 7. The terms of this contract shall inure to the benefit of and be binding upon successors in interest and assigns of the parties hereto. -3- IN WITNESS WHEREOF, the parties hereto have executed this agreement as of the date first above written. Billings, Chairman Gentlemen: Enclosed is the original and two copies of a proposed Crossing Agreement between the Bureau of Reclamation and Weld County for crossing cer- tain county roads with the Bureau's Hayden-Ault 345-kV Transmission Line. This agreement was originally transmitted to you by our October 24, 1975, letter and returned by your November 17, 1975, letter. Your letter specified that conductor clearances and tower locations be included in the agreement. The agreement as written in paragraph No. 2 requires that clearances will be equal to or greater than those specified in the National Electrical Safety Code. The clearance over each County road will exceed thirty-five feet. We have included tower locations complete with stationing at road crossings on the exhibits of the attached agreement, and the 35 foot minimum conductor clearance is also noted on the exhibit. A copy of the plan and profile sheet for each road crossing is also enclosed for your use to further clarify the crossing of the county roads. �J0\,UTI0H tQ, ego Q .4 0 m 2 1/26 1916 If the Crossing Agreement is satisfactory, please sign the original and one copy and return in the self-addressed envelope which is enclosed. The signed copy of the Crossing Agreement will be returned upon execution on behalf of the United States. Enclosed for your general information is a print of a sheet titled "Specifications for Transmission Line" showing data pertinent to the transmission line. The construction of the Transmission Line will be in accordance with the requirements of the National Electrical Code. If any additional information is required, please advise. This Board noted that the ten,b of the contract and the drawing do not specify location of towers with reference to county roads nor miniman height of wire above roads. The towers should be set back 100' in each direction from the center line of the road or section line. Ashley, Chairman Weld County Courthouse Ninth Avenue and Ninth Street Greeley, Colorado 80631 Gentlemen: We have prepared and are enclosing three specific clauses, which can be inserted, if applicable, in the standard rights-of-way easement contract for the Hayden-Ault Transmission Line, as discussed at our meeting at Greeley on February 19, 1974. This meeting was attended by Mr. Glenn Billings and some of the landowners involved. One or all of the clauses will be inserted, as indicated in Article 3 of the enclosed "Contract and Grant of Electric Transmission Line Easement" form, No. 7-1522, if it is found during negotiations with the land- owner that they are applicable to his property. The clauses were prepared along the same lines as the amended Declaration of Taking in the pending condemnation actions on the Archer-Weld Transmission Line. The suggestion of Mr. J. Norman Brown to negotiate the easements with a group of owners instead of individually has been checked with our legal counsel, and we have been advised no regulation precludes this type of negotiation with consenting landowners.
