Harmony Windsor Site, File No. M-2017-056 Dear Mr. Hays: The following discussion and attachments are submitted on behalf of our client, Serfer Land Ventures, LLC., in response to the Adequacy Review comments prepared by the Division of Reclamation, Mining and Safety (the Division) dated January 24, 2018 and January 30, 2018 for the Harmony Windsor Site Limited Impact Operation (110) Reclamation Permit application. The information and discussion below addresses each comment as it was presented by the Division. DIVISION ADEQUACY REVIEW COMMENTS DATED JANUARY 24, 2018 1.6 Public Notices 1. Proof of publication in newspaper is attached. 2. Proof of notice to all owners of record of surface and mineral rights of affected land and surface owners and easement holders within 200 feet of the affected land is attached. 3. The Colorado Division of Water Resources comments have been reviewed and it is anticipated that (1) no groundwater will be exposed during mining, (2) water trucked to the site will be obtained from a legal source, and (3) stormwater will not be detained in the mining cell for more than 72 hours. 6.3.4 Exhibit D — Reclamation Plan 4. The financial warranty will be submitted to the Division upon permit application approval. 6.3.6 Exhibit F —List of Other Permits and Licenses Required 5. Serfer Land Ventures will be the permit holder and Connell Resources Inc. will be the operator. Connell Resources Inc. will extract the additional gravel and complete the Reclamation Revision within the first 4 months of 2018 weather permitting.The plans for the Harmony Gardens Nursery site have changed — there is a need to regrade the existing mined area to make the property more useful for business operations. O Daylight existing pit areas to match with existing topography There is 2 Existing pit locations for regrading and 1 additional area for the purposes of this mining permit. Remove gravel where available and level pit bottom for uniform site grading • Trucks will follow established haul route that crosses the waterline as shown As port of the permit application, DRIBS requires a Structure Agreement between the Operator (Serfer Land Ventures / Connell) and any Structure or Utility within 200' of the mining area. The State of Colorado, Division of Reclamation, Mining and Safety ("Division") requires that where a mining operation will adversely affect the stability of any significant, valuable and permanent man-made structure located within two hundred (200) feet of the affected land, the Applicant shall either: a) Provide a notarized agreement between the Applicant and the Person(s) having an interest in the structure, that the Applicant is to provide compensation for any damage to the structure; or I b) Where such an agreement cannot be reached. the Applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation: or where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect" on their utility. ( Construction Materials Rule 6.3.12 and Rule 6.4.19 & Hard Rock/Metal Mining Rule 6.3.1 2 and Rule 6.4.20) The Colorado Mined Land Reclamation Board ("Board') has determined that thisi form, if properly executed, represents an agreement that complies with Construction Materials Rule 6.3.12(x), Rule 6.4.19(x), and C.R.S. tsC 34-32.5-115(4)(c) (1)1(1 with Hard Rock/Metal Mining Rule 6.3.12(a), Rule 6.4.20(x), and C.R.S. ,tit; 34- 2a. 15(4)(d).
