USR18-0066, FOR A ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER
THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY
DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - RANDALL AND
TANI OWENS
A public hearing was conducted on August 15, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
.. = I hereby certify that pursuant to a notice dated July 20, 2018, and duly published July 25,
2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Randall
and Tani Owens, for a Site Specific Development Plan and Use by Special Review Permit,
USR18-0066, for one (1) Single -Family Dwelling Unit per lot other than those permitted under
Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob
Choate, Assistant County Attorney, made this a matter of record.
Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal and stated the site is located north of and adjacent to Holly Street, and east of County
Road (CR) 7. She indicated the site is located within the three (3) mile referral area of the City of
Dacono and the Towns of Erie, Fredrick and Firestone. Ms. Snyder stated all four (4) surrounding
municipalities responded with no concerns. She mentioned 12 referrals were sent out, and ten
(10) agencies responded without concerns or with suggestions that have been included in the
staff recommendation. She stated staff has received no correspondence from surrounding
property owners (SPO). Ms. Snyder described the surrounding land uses and stated there are
five (5) USRs within one (1) mile of the proposed site. She displayed images of the site and
surrounding views and entered the favorable recommendation of the Planning Commission into
the record as written.
Evan Pinkham, Public Works Engineer representative, provided a brief overview of the
transportation plans and stated the site accesses onto CR 14.75 and there is no Tracking Control
or Road Maintenance Agreement required. He indicated the applicant submitted a Drainage

Narrative which meets an exception; therefore, a Final Drainage Report is not required.
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated water is provided by the Left Hand Water District (LHWD) and the existing
residence is serviced by a septic system permitted for a four (4) bedroom home. She explained
Condition of Approval (COA) #5.A requires the installation of a septic system for the proposed
site prior to the issuance of the Certificate of Occupancy. She stated Development Standards
(DS) #6-7 address Environmental Health items and there are no outstanding issues.
Randall Owens, applicant, stated he and his wife are proposing a second residence for his
in-laws to be closer.
No public testimony was offered concerning this matter.
ta In response to Chair Moreno, Mr. Owens indicated they have reviewed, and agree to abide
by, the Conditions of Approval and Development Standards.
Ej Commissioner Kirkmeyer stated she was glad the applicant's request for a sooner date
could be accommodated. Commissioner Cozad acknowledged the change in the Weld County
Code to allow for consideration of multi -generation housing on the same property and stated her
support for this application.
Commissioner Conway echoed the comments previously made regarding scheduling and
acknowledged Commissioner Cozad's involvement with the Area Agency Aging in Weld County.
He expressed his support of a second dwelling and allowing the elder generation to be
independent.
Commissioner Conway moved to approve the request of Randall and Tani Owens for a Site
Specific Development Plan and Use by Special Review Permit, USR18-0066, for one (1)
Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second
single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of
Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as entered into the record. The motion was seconded by Commissioner Cozad, and
in response to Chair Moreno, the applicant indicated they agreed with the Conditions of Approval
and Development Standards. There being no further discussion, the motion carried unanimously,
and the hearing was completed at 10:32 a.m.
