AND SERVICE INCLUDING OIL AND GAS PROCESSING FACILITIES (FOUR (4) GAS
COMPRESSORS) AND RELATED EQUIPMENT IN THE A (AGRICULTURAL) ZONE
DISTRICT - KENNETH AND EDNA LANGE, C/O DISCOVERY DJ SERVICES, LLC
A public hearing was conducted on March 28, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 12, 2018, and duly published
February 15, 2018, in the Greeley Tribune, a public hearing was conducted to consider the
request of Kenneth and Edna Lange, c/o Discovery DJ Services, LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR17-0078, for Mineral Resource
Development, Oil and Gas Support and Service including oil and gas processing facilities (four
(4) gas compressors) and related equipment in the A (Agricultural) Zone District. Bob Choate,
Assistant County Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated the approximate 10 -acre Subdivision Exemption parcel is located within the three (3) mile
referral area of the Towns of Hudson and Lochbuie and he reviewed the referral responses from
these jurisdictions. He described the adjacent land uses to include nearby residences and stated
staff received phone calls regarding the compressor station location in relation to an adjacent
neighbor and in response to this concern, the applicant moved the location further away from this
residence and since then there has been no further correspondence. Mr. Ogle described the
necessity for the Lochbuie Compressor Station to allow for the transport of higher volumes of
natural gas and increase production. He stated 13 referrals were sent out with two (2) responses
offering comments that have been considered in the staff recommendation. He displayed images
and entered the favorable recommendation of the Planning Commission into the record as written.
Hayley Balzano, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements, stating this site is accessed from County Road 41, for

which she also provided the average daily traffic count and truck percentage. She reported the
traffic narrative indicated only one (1) daily round trip and staff is requiring tracking control during
the construction phase and an Improvements and Road Maintenance Agreement will be required.
Ms. Balzano stated the applicant is required to submit a final drainage report and detention pond
design signed and stamped by an Engineer.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions, stating according to the application materials, there will be no permanent employees
after construction. He asserted during construction, and thereafter, the use of portable toilets and
bottled water is acceptable. Mr. Frissell stated Development Standards (DS) #11-25 address
Environmental Health items.
IR Matthew Norton, represented the applicant, provided a PowerPoint presentation (Exhibit D)
and began by introducing the team available for questions. He referred to his presentation in the
previous hearing reflecting the company history, basic safety and community involvement and
proceeded to move ahead to the portion of the presentation related to the construction and
operations of the Lochbuie Compressor Station and defined the site plan in detail.
• Matthew Bossier, Kimley-Horn and Associates, Inc., presented the landscaping mitigation
options with the plant palettes for each to address visual and noise issues. He provided diagrams
of landscape placement in relation to height and placement of equipment to mitigate for the
surrounding residences sight lines and in relation to varying density of landscape concepts.
• Mr. Norton concluded with the specifics of their community involvement to include being a
proud supporter of the Cardinal Academy, and the 2018 Weld County Fair.
• No public testimony was offered concerning this matter.
• In response to Chair Moreno, Mr. Norton stated he has reviewed the Conditions of Approval
and Development Standards and is in agreement.
• Commissioner Freeman suggested amending Condition of Approval (COA) #1.A to refer to
the period of construction. Mr. Pinkham interjected the Department of Public Works can address
the Board's wishes in the Road Maintenance Agreement. Commissioner Kirkmeyer
recommending creating a new COA #1.D to read, "The applicant shall submit a
Landscaping/Screening Plan delineating Option C, as developed by the applicant with the
surrounding property owners and per the presentation to the Department of Planning Services for
review and approval." Commissioner Cozad asserted the associated DS #4 needs to be amended
to add language at the end of the sentence to read, "in accordance with the approved
Landscaping/Screening Plan." Commissioner Kirkmeyer suggested adding the words "during
construction" to the beginning of Development Standards (DS) #6 and 7. In response to
Commissioner Cozad, Mr. Norton stated they will perform a noise study to create a baseline.
Mr. Frissell explained the process for measurement. Mr. Norton stated they will comply with the
Residential noise standard. In response to Commissioner Cozad, Mr. Frissell explained the CDPS

Permit regarding stormwater discharge in DS #22, after which, the Board agreed to change the
word "as" to "if". In response to Chair Moreno, Mr. Norton reviewed the secondary containment.
The Board agreed with all the aforementioned changes.
IR In response to Chair Moreno, Mr. Norton indicated he and the applicants have reviewed,
and agree to abide by, the Conditions of Approval and Development Standards, as amended.
la Commissioner Freeman moved to approve the request of Kenneth and Edna Lange, c/o
Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review
Permit, USR17-0078, for Mineral Resource Development, Oil and Gas Support and Service
including oil and gas processing facilities (four (4) gas compressors) and related equipment in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as amended and
entered into the record. The motion was seconded by Commissioner Cozad, and she further
asserted the application meets the criteria and it is important to recognize that the applicant
worked with surrounding property owners regarding compatibility. There being no further
discussion, the motion was approved unanimously and the hearing was completed at 11:25 a.m.
This Certification was approved on the 2nd day of April, 2018.
