OF 2 REC DOC Weld County CO Clerk & Recorder 0.00 RE: VACATION OF PORTION OF WELD COUNTY ROAD 22.5 FROM HALF -SECTION LINE OF S7, T2N, R66W, WEST TO SOUTH PLATTE RIVER AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by a letter dated August 28, 1995, Elton N. and Catherine S. Miller requested Weld County vacate Weld County Road 22.5 from the W1A of Section 7, Township 2 North, Range 66 West and E% of NE% of Section 12, Township 2 North, Range 67 West of the 6th PM., Weld County, Colorado, and WHEREAS, the Weld County Public Works Department has recommended said Weld County Road 22.5 from the bridge west of State Highway 85 to the river be vacated, since the section of road is not needed for the Weld County roadway system, and WHEREAS, the County Attorney's Office has specified that portion of the road right-of-way to be vacated -is the stretch beginning at the half section line of Section 7, Township 2 North, Range 66 West and extending westward to the South Platte River, and WHEREAS, on June 10, 1996, the Board of County Commissioners considered the vacation of said portion, heard all of the testimony and statements of those present, studied the recommendations of the Weld County Attorney and Dave Becker, Operations Manager for the Weld County Public Works Department, and all of the exhibits and evidence presented in this matter and, having been fully informed, deemed it advisable to vacate said portion of Weld County Road 22.5 as designated on the attached plat, a copy of which -is attached hereto and incorporated herein by -reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the portion of Weld County Road 22.5 beginning at the half section line of Section 7, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado, and extending westward to the South Platte River be, and hereby is, vacated. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign any and all necessary documents pertaining to said vacation. BE IT FURTHER RESOLVED -by the Board that the necessary easement be granted to the appropriate parties. 961031 EG0035 Requirement No. 12 By Resolution dated June 10, 1996, recorded at Reception No. 2497538, Weld County vacated Tract 4 [herein part of Mineral Tract F]. This Tract consisted of a county road being 50 foot wide off the North side of the W/2SW/4. The owners of the abutting property, being Tract 2 [herein the balance of Mineral Tract .F], are now credited with ownership of the oil and gas estate underlying Tract 4. Upon vacation of streets and alleys, Colorado law provides that these lands revert to abutting lots; however, the law appears to contemplate a recorded plat or division of the land into lots. No such recorded plat or division appears relative to Tracts 2 and 4. However, it is the examiner's opinion that it was and is the intention of Weld County that Elton N. Miller and Catherine S. Miller, owners of the abutting Tract 2, own the surface and mineral estates in Tract 4, and that the county reserve only an easement for road purposes. Obtain and record a deed from Weld County to Elton N. Miller and Catherine S. Miller, conveying all of Tract 4, reserving to the County an easement for road purposes. Page 62 of 85 Please note by mesne conveyances the interest of Elton N. Miller and Catherine S. Miller in Mineral Tract F became vested in Miller Family Farm, LLC, a Colorado limited liability company. Consequently any curative deed should now be in favor of the current owner.
