Events will be held throughout the year. There are no additional structures proposed. Building Permits will be required, per Section 29-3-10 of the Weld County Code. Currently the following has been adopted by Weld County: 2012 International Codes; 2006 International Energy Code; 2014 National Electrical Code. A building permit application must be completed and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechi n ical engineers ng report or an open -hole inspection report performed by a registered State of Colorado engineer may be required for new structures and or additions. The applicant shall delineate on the site map the future and existing right-of-way. If the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. TRAFFIC REQUIREMENTS: High traffic trips (near or over 100 round trips/day) A Traffic Impact Study shall be completed by a Colorado Registered Professional Engineer following the checklist available on the Public Works website at: htlp://www.co-welt. .us/Departments/Public orks/Trafficand igninr=html. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 ft from edge of existing shoulder of roadway to allow a truck and trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped for gate create a safety issue for roadway users. Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. More than 10 round truck trips/day (tandem or semi -trucks) or more than 50 round passenger vehicles trips: • Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled asphalt or road base. • Access onto paved roads requires either a tracking control device and 100ft of asphalt OR 300ft of asphalt. *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering pubiically maintained roadways. A variance request for alternatives to the above tracking control can be submitted to Public Works for review and consideration. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Collateral is mired to ensure the improvements are made. Road Maintenance will be included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. A Site Plan will be required identifying the following (if applicable): o Show and label location of existing road Right -of -Way, future road Right -of -Way, and Easements o Show and label the unmaintained section line Right -of -Way o Show and label location of the access(es) and label with access permit number o Show and label the access turning radii (25 feet for passenger vehicles/80 feet for trucks) o Show and label the approved tracking control ENGINEERING DEPARTMENT Weld County has recently adopted a new stormwater drainage code located under Chapter 23, Article 12 Storm Drainage Criteria. This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas generally require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site. Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23-12-30 F.1. To avoid holding up case processing, a minimum of either a preliminary drainage report or a drainage narrative with exception as shown below must be submitted with 7 -day case submittal information. Existing Drainage Report and Detention Pond: Please submit a drainage narrative stamped and signed by a Colorado Licensed Professional Engineer indicating the existing detention pond can handle the increased imperviousness or update the Drainage Report and drainage design to accommodate the increase in imperviousness. OR Drainage Narrative requirements with exception from detention pond. The Drainage Narrative must describe at a minimum: i. Which exception is being applied for and include supporting documentation ii. Where the water originates if it flows onto the property from an offsite source Where it flows to as it leaves the property iv. The direction of flow across the property v. If there have been previous drainage problems with the property DRAINAGE CODE REQUIREMENTS (informational only): Section 23-12-30. Drainage Policy. F. Exceptions. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property and shall be limited to the following: No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 8. Development of sites where the change of use does not increase the imperviousness of the site. The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (map recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Please identify any proposed fighting or signs on the Site Plan. Lighting needs to be downcast and shielded. A 16sf sign is allowed in the Agricultural Zone District; however if there are potentially any additional or larger signs please include those in the application. The applicant/representative had questions about what information is needed in the U S R regarding traffic (is an updated traffic study needed or will a traffic narrative suffice?) Also, there were questions whether additional tracking control off of County Road 22 (in addition to what is currently onsite) is needed. Staff recommended the applicant contact Public Works re: the specific questions that they had. Staff indicated that a water supply report should be provided with the USR application. Staff also recommended that the applicant discuss septic requirements with the Department of Public Health and Environment as the applicant will be holding racing events more than 6 months out of the year. The applicant shall submit 1 packet for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as many of the referrals as possible. At that meeting the Planning Commission hearing will be scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks after the Planning Commission hearing. The above notes are provided as a courtesy to the applicant While we strive to help identify as many potential issues upfront during the pre application meeting we cannot anticipate every issue that may come up during the formal application process. Explain, in detail, the proposed use of the property. The original Use By Special Review proposal was to develop the 15 -acre +I- property for an equestrian event center. U R I -0029 was approved for an event center for up to 200 people, along with an operating office and shop for tack sales. The approval limited the use of the riding arena and track to up to 60 vehicle trips per day as allowed in the A (agricultural) zoning district. This proposal is to amend U R16-0029 to allow additional use of the track and riding arena for up to 350 people on weekends (Saturday and Sunday) between the hours of 10:00 AM and 8:00 PM, as weather permits. The proposed amendment includes the construction of a restroom facility with running water and an additional septic system. Total capacity would be no more than 350 people for both the event center and riding arena/track. The facility will be operated under applicable local, state and federal regulations. The facility will also use standard and traditional operating procedures and best management practices consistent for the proposed use. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. Section 22-2-20 Agriculture goals and policies. Goal 7: County land use regulations should protect the individual property owner's right to request a land use change. Policy 7.1. County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. Policy 7.2. Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region. Policy 7.. Conversion of agricultural land to urban residential, commercial and industrial uses should be considered when the subject site is located inside an Intergovernmental Agreement area, Urban Growth Boundary area, Regional Urbanization Area or Urban Development Nodes, or where adequate services are currently available or reasonably obtainable. A municipality's adopted comprehensive plan should be considered, but should not determine the appropriateness of such conversion. Goal 8. Ensure that adequate services and facilities are currently available or reasonably obtainable to accommodate the requested new land use change for more intensive development. The site is not situated in an urban growth boundary of any municipality or inside any Intergovernmental Agreement area. The proposed use is not situated near a residence or any neighboring uses that would be negatively affected by the ongoing operations. Services for the proposed use are reasonably obtainable. Initially, bottled water will be provided. Well permit no. 80304-F has been issued for the property. Initially, events will be served by a series of Port -C -Lets. A restroom facility is proposed with running water and an additional septic system. The new septic system will be designed, constructed and permitted according to Weld County septic requirements. Hudson Fire Protection District and Weld County sheriff will provide services to the site. 3. Explain how this proposal is consistent with the intent of the Weld County Code, chapter 23 (Zoning) and the zone district in which it is located. Section 23-3-40 of the Weld County Code states: "The following Buildings, Structures and Uses may be constructed, occupied, operated and maintained in the A (Agricultural) Zone District upon approval of a permit in accordance with the requirements and procedures set forth in Article l!, Division 4 of this Chapters" 23-3-40. B. Agricultural Service establishments primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including: 17. Rodeo Arenas, Commercial 18. Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. The site is located approximately sly 230 feet east of the nearest residence. This residence is owned and occupied by the applicant and owner of the proposed facility. All properties adjacent to the proposed site are agricultural crop land and oil and gas facilities. The proposed land use is a logical addition to existing equestrian facilities on the site. It is in a fairly remote location and is not expected to negatively impact surrounding property owners. Page 3 of 8 5. What are the hours and days of operation? (e.g. Monday thru Friday 8:00 a.m. to 5:00 p.m.) The additional use of the track and riding arena would occur on weekends (Saturday and Sunday) between the hours of 10:00 AM and 8:00 PM as weather permits. 6. List the number of full time and/or part time employees proposed to work at this site. No additional employees are proposed. 7. If shift work is proposed include the number of employees per shift. There will be no shift work at this site. 8. List the number of people who will use this site. Include contractors, truck drivers, customers, volunteers, etc. The current USR allows up to 200 people at the event center. The proposed additional use would allow for up to 350 people at the facility Saturdays and Sundays, primarily during daylight hours. Use of the entire facility will be limited to 350 total people. 9. If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. Up to forty (40) horses will be housed at this location, per USR 16-0029. Any other livestock will be brought in and will leave the site during practice events. No additional livestock are proposed with this amendment. 10. Care has been taken to locate parking centrally on the property to minimize any potential negative effect on adjacent property owners. Screening will be provided by landscape buffers along the south property line, in the parking areas, and along interior driveways. No outdoor storage areas are proposed. Agricultural practices may result in outdoor staging typical of similar uses in the A -agricultural zone district. 15. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Upon termination of the proposed Use by Special Review activity, the facilities will be utilized for other agricultural purposes, 16. Who will provide fire protection to the site? The Hudson Fire Protection District will provide fire protection to the site. 17. List all proposed on -site and off -site improvements associated with the use (e.g. landscaping, fencing, buildings, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Proposed improvements to the existing quarter -mile practice track and roping arena include an observation tower and restroom facility. The entire project is expected to proceed at one time if the owner can secure adequate financing. Engineering Questions: 1. The report quantifies traffic generation in Peak Hour rates. There are no Semi - trucks and trailers, and service trucks wilt be limited to pane/ trucks. The facility is projected to generate approximately 234 weekend daily trips, and 116 total weekend peak hour trips. There will be 11 projected weekend peak hour left -turns at ingress and 47 projected weekend peak hour right -turns at ingress. A request for variance from auxiliary lane construction is included with the T1S Memorandum. The amendment will increase trip generation calculations, but will not increase peak hour impacts. 2. Describe the expected travel routes for site traffic. The existing access to this property is via a private drive, which is approximately 30' in width. It extends approximately 1.5 miles south of the property to Weld County Road 22. WCR 22 Page 5 of 8 is a paved roadway with "local" designation. There is an existing access permit at this location, API 6-00370. Reynaldo Bonilla has signed an Improvements and Road Maintenance Agreement. The agreement is a condition of approval for USR 16-0029. It is not yet approved by the Board of County Commissioners. 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) 100% of traffic will come into the site from the south via Weld County Road 22 It is projected that 80 of traffic traveling along WCR 22 to the site will come from the east, and 20% will come from the west. 4. Describe the time of day that you expect the highest traffic volumes from above. Attendees are expected to start arriving at 10:00 AM and filter in and out throughout the day, Saturday's and Sunday's only. Arrivals and departures will be spread -out as racing and roping events are scheduled intermittently throughout the day. 5. Describe where the access to the site is planned. A private drive extends north from WCR 22 which will provide access to the site. 6. Drainage Design: Detention pond summarized in a drainage report is required unless the project falls under an exception to storm water detention requirements per code section 23- 12-30 F.1. a. Does your site qualify for an exception to storm water detention? If so, describe in a drainage narrative the following: 1. Which exception is being applied for and include supporting documentation. 2. Where the water originates if it flows onto the property from an offsite source 3. Additionally, the proposed land use associated with the Bonilla Event Center is not anticipated to generate additional pedestrian or bicycle trips. Any additional pedestrian or bicycle traffic from this development, if any, would be negligible. 4.0 Proposed Project The Bonilla Event Center is a commercial arena and event center upon a 15 -acre property currently used as a personal horse arena. Vehicular access to the property is proposed from the property's existing access point to CR 22 located east of the Beebe- Neres Canal. This TIS Memo Update analyzes the project's potential traffic related impacts of the access to CR 22 during the weekend peak hour. 4.1 Weekend Traffic at the Bonilla Event Center Kellar Engineering LLC (KE) was able to gain a thorough understanding of the weekend traffic patterns at the project site through correspondence with the client and project team. Additionally, AGPROfessionals conducted a weekend site observation on Saturday, March 4, 2017 at the Bonilla Event Center to observe the traffic patterns at the project site. KE was also provided the results of this site observation for this TIS Memo Update. Below is a summary of the weekend event traffic at the Bonilla Event Center: • The majority of the traffic (approximately 80%) coming to the site is from WCR 49 to the east. Additionally, the Bonilla Event Center will encourage even more vehicles to arrive from the east so that vehicles are arriving to the site via a right - turn entry. • People start arriving at 10:00 AM. They filter in and out throughout the day. The races are scheduled intermittently throughout the day. Arrivals and departures are spread -out throughout the day. • The roping usually occurs in the late afternoons and evenings. Everyone has cleared out by 8:00 PM. Bonilla Event Center TES Memo Update Page 4 • 3 persons per vehicle is a reasonable assumption by observation. The Bonilla Event Center will encourage even more car-pooling. • Roping or racing does not occur during the week — it's only on weekends. Saturday and and Sunday, throughout the year as weather permits. The Bonilla Event Center will commit to a having a TCS certified technician (wearing proper PPE) to direct traffic if the peak hour traffic volumes of the event exceed the traffic thresholds established by Weld County. • The Bonilla Event Center will commit to counting cars, and turning vehicles away if the site reaches permitted capacities. • Approximately 350 total people attend a weekend event at the Bonilla Event Center with arrivals and departures spread -out throughout the day. • The typical weekend event peak hour with approximately 50% of the people arriving and departing is between noon — 1:00 PM. This equates to approximately 175 people arriving and departing during the weekend peak hour. With 3 persons per vehicle, approximately 58 peak hour vehicles arrive and depart during this weekend peak hour. Traffic estimates from trucking operations at the site are included in the above numbers. 4.2 Trip Generation Site generated traffic estimates are determined through a process known as trip generation. Rates and equations are applied to the proposed land use to estimate traffic generated by the development during a specific time interval. The acknowledged source for trip generation rates is the Trip Generation Report published by the Institute of Transportation Engineers (ITE). The Institute of Transportation Engineers' (ITE) Trip Generation Manual, 9th Edition does not provide detailed data on event centers. As such, ICE was able to estimate the weekend peak hour trip generation based upon estimated weekend peak hour attendance. The auxiliary lane analysis for the access points were conducted using CDOT State Highway Access Code (SHAC). Based upon the SHAC, and a posted speed of 55 mph, a left -turn deceleration lane is required at an intersection with a projected peak hour ingress turning volume greater than 10 vph. Additionally, a right -turn deceleration lane is required at an intersection with a projected peak hour ingress turning volume greater than 25 vph, and a right -turn acceleration lane is required at an intersection with a projected peak egress turning volume greater than 50 vph. Based upon the projected peak hour weekend event traffic of the Bonilla Event Center, a left -turn deceleration lane and a right -turn deceleration lane are triggered in CR 22 at the site access per SHAC (11 projected weekend peak hour left -turns at ingress and 47 projected weekend peak hour right -turns at ingress). See Figure 4: Weekend Peak Hour Site Generated Traffic. 5.1Auxiliary Lane Variance Request A left -turn deceleration lane is projected to be triggered at the CR 22/site access intersection per SHAC during the weekend event peak hour at the Bonilla Event Center by one (1) projected additional left -turn entering vehicle. Based upon the SHAC, and a posted speed of 55 mph, a left -turn deceleration lane is required at an intersection with a projected peak hour ingress turning volume greater than 10 vph. The projected peak hour left -turn ingress turning volume at the site access to the Bonilla Event Center is estimated to be 1 '1 vph. See Figure 4: Weekend Peak Hour Site Generated Traffic. Vehicular access to the site is from the property's existing access point located just east of the existing bridge for the Beebes-Neres Canal. See Appendix A: Aerial Image. Constructing a left -turn deceleration lane at the site access would involve constructing a new bridge structure across the Beebes-Neres Canal on CR 22. This would be a large burden to account for one (1) projected left -turn entering vehicle above the threshold. Additionally, this traffic analysis is for the weekend peak hour event when traffic on CR 22 is lighter when compared to the weekday peak hours. Additionally, the Bonilla Event Center will encourage even more vehicles to arrive from the east so that vehicles are arriving to the site via a right -turn entry. It is possible that once more vehicles during the Bonilla Event Center TIS Memo Update Page 9 weekend events start arriving from the east that the left -turn entering vehicles could actually be below the threshold for triggering a left -turn deceleration lane in CR 22. A right -turn deceleration lane is projected to be triggered at the CR 22/site access intersection per SHAG during the weekend event peak hour at the Bonilla Event Center. Based upon the SHAG, and a posted speed of 55 mph, a right -turn deceleration lane is required at an intersection with a projected peak hour ingress turning volume greater than 25 vph. The projected peak hour right -turn ingress turning volume at the site access to the Bonilla Event Center is estimated to be 47 vph. See Figure 4: Weekend Peak Hour Site Generated Traffic. Constructing a right -turn deceleration lane at the CR22/site access intersection would involve acquiring off -site right-of-way (ROW) from property that is not part of the Bonilla Event Center property. This would be a large burden to account for a weekend peak hour event when traffic on CR 22 is less when compared to the traffic on CR 22 during the weekday peak hours. Additionally, the Bonilla Event Center will commit to having a TCS certified technician (wearing proper PPE) to direct traffic if the peak hour traffic volumes of the event traffic exceed the thresholds established by Weld County. Additionally, the existing site access to CR 22 is a wide access (approximately 46' in width) that provides sufficient room for the right - turn entry turning movement to be made with a larger turning entry radius that limits disruption to the flow of the existing thru traffic on CR 22. In light of the above information, it respectfully requested that a variance be granted to not require the left - turn deceleration lane and right -turn deceleration lane in CR 22 at the site access for the Bonilla Event Center's projected weekend event peak hour traffic. Bonilla Event Center TIS Memo Update Page 10 6.0 Conclusions Based upon the analysis presented in this TIS Memo Update, the proposed Bonilla Event Center located at 21505 CR 22, Hudson, CO 80642 will not create a traffic burden upon the local and regional traffic system. ® Approximately 350 total people at -tend a weekend event at the Bonilla Event Center with arrivals and departures spread -out throughout the day. The typical weekend event peak hour with approximately 50% of the people arriving and departing is between noon — 1:00 PM. This equates to approximately 175 people arriving and departing during the weekend peak hour. U R16-0029 would allow the additional use of Reynaldo Bonilla's existing race track and riding arena on Saturdays and Sundays as weather permits. Reynaldo Bonilla will be the point of contact for communications regarding the use of this facility. The following describes how security will be managed on site. On -Site Security Owner will contract with a third -party security company. Currently, Taser Security Enforcer (Taser) provides security services. During events, Taser staff observe the riding track and arena. They are situated at the facility entrance and vehicles are checked as they enter the site. They also record and control the number of people on -site at a given time. Taser staff walk the perimeter of the track and maintain an on -site presence. The number of security personnel on -site at a given time generally is two (2) security personnel for the first one -hundred (100) participants and one (1) additional security professional for each additional fifty (50) participants, Facility protocol prescribes that security professionals be approachable, proficient and able to respond quickly in the event of an emergency. Should an incident occur that requires emergency medical services or law enforcement, 911 will be contacted. No alcohol will be permitted on -site. Gambling at this facility is prohibited. Signs are posted at the entrance to the facility to inform participants of facility policies. Traffic Control A Traffic Impact Study (TIS) has been submitted with this application. Attendees arrive starting at 10:00 A.M. and filter in and out throughout the day, Saturday's and Sunday's only. Arrivals and departures are spread -out as racing events are scheduled intermittently throughout the day. 100% of traffic will come into the site from the south via Weld County Road 2. It is projected that 80% of traffic traveling along WCR 22 to the site will come from the east, and 20% will come from the west. Traffic Control Supervisor (T) certified individuals will be contracted to direct if traffic becomes excessive. Vehicles will be counted upon entrance to the site. NOTE: The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than the 100 years upon which the amount of water in the aquifer is allocated, due to anticipated water level declines. NOTE: To ensure a maximum productive life of this well, perforated casing should be set through the entire producing interval of the approved zone or aquifer indicated above.
