How is the proposed rezoning consistent with the policies of the Weld County Code, chapter 22? If the proposed rezoning is not consistent with the Comprehensive Plan, explain how the proposed rezoning will correct what the applicant perceives as faulty zonings or how the proposed rezoning will fit with what the applicant perceives as the changing conditions in the area. Judy and James Docheff are requesting a Change of zone for a 32 +1- acre property located in Part of the Southwest Quarter of Section 30, Township 3 North, Range 68 West, being Lot B of Recorded Exemption RE -3841. This proposal is to change the zone from the R-1 (Low -Density Residential) Zone District to the A (Agricultural) Zone District. In the 1960s a large portion of Section 30, including the subject property, was zoned R-1 through case no. Z-38*. Several properties, including Lot A of RE -3841, have changed their zone to the A Zone District since that time. An amendment to Lots A and B of Recorded Exemption RE -3841 is proposed and will be processed through a separate application. As advised by Weld County Planning Department Staff, Lots A and B cannot be amended unless they are both in the same Zone District. If approved, this change of zone would allow the Amended Recorded Exemption process. The proposed rezoning is consistent with the Weld County Comprehensive Plan in accordance with the following sections designated in the Weld County Code. Sec. 22-2-20. — Agriculture goals and policies. A. Goat 1. Respect and encourage the continuation of agricultural land uses and agricultural operations for purposes which enhance the economic health and sustainability of agriculture. . A Policy 1.1. Establish and maintain an agricultural land use designation to promote the County's agricultural industry and sustain viable agricultural opportunities for the future. 2. A. Policy 1.2. Support the development of creative policies for landowners to voluntarily conserve agricultural /and. 2. How will the uses allowed by the proposed rezoning be compatible with the surrounding land uses? Include a description of existing land uses for all properties adjacent to the subject property. Uses permitted in the A Zone District are generally compatible with the existing uses on the site and adjacent properties. Although the subject property was zoned R-1 in the 1960s, no residential development has occurred on -site. Agricultural uses are historic to the subject property. Several neighboring properties have also changed their zone from R-1 back to the A Zone District. 3. Will the property use a septic system or public sewer facilities? No homes are proposed at this time. If, in the future, a home is built, a septic permit will be acquired and the system will be designed, constructed and permitted according to applicable state and county regulations. 4. Who will provide adequate water, including fire protection, to the property? Water will be provided by the Longs Peak Water District and a commitment to Serve Letter is included in this application. 5. Does the property have soils with moderate or severe limitations for construction? If yes, the applicant shall submit information which demonstrates that the limitations can be overcome. The Geology Report provided by Soilogic, Inc. does not indicate moderate or severe soil limitations for construction or economically recoverable gravel resources at this site. 6. Is the road and/or highway facilities providing access to the property(ies) adequate to meet the requirements of the proposed zone district? If not, the applicant shall supply information demonstrating the willingness and financial capability to upgrade the road and highway facilities. Attached is the completeness review report. COMPLETE- no further action required. 2. Please provide clarification as to what specifically we need to request a waiver from. If there is a waiver request form, please forward a copy. Can this waiver be included as a condition of approval so as not to hold up the referral review? Please let me know. The mineral resources statement is a requirement listed on the COZ application. There is no waiver form but spoke with Tom Parko about this requirement and it seems overkill for the subject COZ. So, you can request a waiver from the requirement and just write a brief email that addresses the information that I detailed in the completeness memo. 3. The Town of Firestone was notified on September 8, 2017. On September 11, 2017 the Senior Planner indicated that they had received our request. We waited the full 21 -day IGA notification period following that correspondence, however no comments were received. I will forward the Sept. 11th email following this response. COMPLETE- Firestone Notification email received - no further action required. Building Comments: 1. There are no buildings on the subject property.
