HomeMy WebLinkAbout20182578.tiffRESOLUTION RE: APPROVE RESUBDIVISION, RES18-0003, TO DIVIDE LOT 5, BLOCK 4 CARRIAGE ESTATES 1ST FILING INTO TWO LOTS, DIVIDING THE DUPLEX ON THE PROPERTY ALONG THE COMMON PARTY WALL - CROPPER COUNTRY INNS III, LLC, C/O THOMAS AND ANNABELLE CANZONA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of August, 2018, at the hour of 9:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Cropper Country Inns III, LLC, 6268 W. 10th St. #5, Greeley, Colorado 80634, c/o Thomas and Annabelle Canzona, 3527 W. 12th Street, Greeley, Colorado 80634, for a Resubdivision, RES18-0003, to divide Lot 5, Block 4 Carriage Estates 1st Filing into two lots, dividing the duplex on the property along the common party wall, on the following described real estate, being more particularly described as follows: Lot 5, Block 4 of Carriage Estates 1st Filing, being part of the W2SW4 of Section 24, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the applicant was present, and WHEREAS, Section 24-5-40 of the Weld County Code provides standards for review of said Resubdivisions, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Sections 24-5-40.A and B. of the Weld County Code. 2 It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Sections 24-5-40.B thru .D, of the Weld County Code as follows: A. Section 24-5-40.B.1 -- This Resubdivision process requires all information listed in Section 24-4-40. The Resubdivision utility map and plat shall show only the property under consideration for the Resubdivision. If an application requirement is not applicable to the proposed Resubdivision, it may be waived by the Department of Planning Services. The applicant submitted a Resubdivision application that included all the items applicable for review. The Conditions of Approval will need to be addressed prior to approval of this Resubdivision. cc.: Pc.CC.Gimmi-rP), q41-fr-qe 2018-2578 PL2598 RESUBDIVISION (RES18-0003) - CROPPER COUNTRY INNS III, LLC, C/O THOMAS AND ANNABELLE CANZONA PAGE 2 B Section 24-5-40 B 2 -- In addition to the requirements of Section 24-4-40 F and G , the following application information shall be submitted 1) A Resubdivision application form provided by the Department of Planning Services The applicant submitted a complete Resubdivision application form 2) A letter explaining the Resubdivision request The letter shall explain how the proposed Resubdivision complies with the approved final plat The letter shall also explain how the Resubdivision complies with the adopted rules, regulations and ordinances currently in force and affecting the subdivision The application materials include responses to the supplemental requirements which address the compliance with the rules, regulations, and ordinances in force and affecting the subdivision 3) A copy of the recorded final plat The applicant submitted a plat with the application materials The final plat will need to be submitted once this Resubdivision is approved 4) All public easements or rights -of -way proposed to be vacated shall be identified and shown in hatch line form on the Resubdivision plat to be recorded A legal description shall also be provided for any public easement or right-of-way not parallel to a lot line The applicant is not proposing to vacate any public easement or rights -of -way The applicant shall comply with the requirements of the Utility Board as outlined during the June 14, 2018, hearing C Section 24-5-40 B 3 - Drainage easements or rights -of -way designed to accept drainage shall not be changed unless supported by a drainage plan and complete engineering data for the affected subdivision No drainage easements or rights -of -way will be modified by this subdivision D Section 24-5-40 B 4 -- An affidavit listing the names and addresses of all entities with a security interest in the property being considered The list shall be compiled from the title commitment issued by a title insurance company or a title opinion by an attorney licensed to practice in the State, and shall be current as of a date not more than thirty (30) days prior to the date the application is submitted to the Department of Planning Services The applicant submitted a complete list of all the names and addresses of all entities with a security interest in the property E Section 24-5-40 C -- Any person wanting to apply for review of a Resubdivision for redesign or addition of new lots, or vacation of all or portions of a subdivision, shall arrange for a pre -application conference with the Department of Planning Services Upon receipt of a complete Resubdivision application, the Department of Planning Services will schedule the request before the Board of County Commissioners Given 2018-2578 PL2598 RESUBDIVISION (RES18-0003) - CROPPER COUNTRY INNS III, LLC, C/O THOMAS AND ANNABELLE CANZONA PAGE 3 that this parcel contains an existing duplex (no new buildings or residences are proposed), the Department of Planning Services determined that a pre - application meeting is not required F Section 24-5-40 D -- No lot or parcel shall be created that is less than the minimum lot size standards set forth in Section 24-7-50 of Chapter 24 of the Weld County Code The lots proposed are less than the 6,000 - square -foot lot size requirement in the R-4 (High Density Residential) Zone District However, the proposed lot sizes meet the minimum lot area per unit requirement of 1,500 square feet per unit Additionally, the Development Standards for Carriage Estates were amended (and approved by the Board of County Commissioners) in July 1980, allowing for smaller lots The amendment was to signage, setbacks and lot sizes The Development Standards allow common party walls to be used for lot lines and provided that there be a minimum setback of 15 feet between buildings Lots on both sides of this property have existing residences Previous dwellings have been subdivided into lots less than 6,000 square feet NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Cropper County Inns III, LLC, c/o Thomas and Annabelle Canzona, for a Resubdivision, RES18-0003, to divide Lot 5, Block 4 Carriage Estates 1st Filing into two lots, diving the duplex on the property along the common party wall, on the parcel of land described above be, and hereby is, granted subject to the following conditions 1 Prior to Recording the Resubdivision Plat A The plat shall be amended to delineate the following 1) All Plats shall be labeled RES18-0003 2) 35th Street is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance #2017-01) as a local road, which requires 60 feet of right-of-way at full buildout The applicant shall verify and delineate on the plat the existing right-of-way and the documents creating the existing right-of-way If the existing right-of-way cannot be verified it shall be dedicated The applicant shall also delineate the physical location of the roadway Pursuant to the definition of setback in Section 23-3-50, of the Weld County Code, the required setback is measured from the future right-of-way line This road is maintained by Weld County 3) Show and label the preliminarily approved access point(s) and the usage types as described in the Department of Public Works referral memorandum 4) Show and label all easements with the recorded document reception number and date on the plat 2018-2578 PL2598 RESUBDIVISION (RES18-0003) - C The applicant shall submit one (1) paper copy or one (1) electronic copy (.pdf) of the plat for preliminary approval to the Weld County Department of Planning Services. 2 Upon completion of Condition of Approval #1 the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-5-40.B.1 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. The Board of County Commissioners may extend the date for recording the plat. If the Board determines that conditions supporting the original approval of the Resubdivision plat cannot be met, the Board may, after a public hearing, revoke the Resubdivision. ROADS AND RIGHT-OF-WAY: 35th Street is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a(n) local road, which requires 60 feet of right-of-way. The applicant shall delineate on the site map or plat the future and existing right-of-way and the physical location of the road. If the right- of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of- way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. SECTION 2. Sharing of Repair and Maintenance. The cost or' reasonable repair and maintenance of a party wall shall be shared by the Owners who make use of the wall in proportion to such use. SECTION 3, Destruction by Fire or Other Casualty. If a party wall destroyed or damaged by fire or other casualty, any Owner who has used the wall may restore it, and the contagious Duplex Unit Owner shall contribute to one-half of the cost of restoration thereof without prejudice, subject however; to the right of any such Owner to call for a larger contribution from the other under any rule of law regarding liability for negligent or willful acts or omissions, SECTION 4. Weatherproofing. Notwithstanding any other provision of this Article, an Owner who by his/her negligent or willful act causes the party wall to be exposed to the elements shall bear the whole cost of furnishing the necessary protection against such elements. SECTION 5. Right to Contribution Runs With Land. The right of any Owner to contribution from any other Owner under this Article shall be appurtenant to the land and shall pass to such Owners' successors in title. ARTICLE III — COVENANTS AND MAINTENANCE SECTION 1. Obligation for Maintenance. The Declarant for each Lot owned, or any part thereof, hereby covenants and each Owner of any lot by acceptance of a deed therefore, whether or not it shall be so expressed in deed, is deemed to covenant and agree to provide exterior maintenance upon his/her Duplex unity, which shall include paint, repair, replacement and repair of roofs, gutters, down spouts, exterior building surfaces including glass surfaces, trees, shrubs, grass, drainage paths,walks and driveways and all other exterior/ improvements. SECTION 2. Default of Maintenance Covenant. In the event the an Owner of a Duplex Unit fails to maintain the premises as provided in SECTION 1 of this article, the Owner of the contiguous Duplex Unit shall have the right, through its agents and employees to enter upon said parcel to repair, maintain and restore Duplex Unit and the exterior of the buildings and any other improvements thereon. The cost of such exterior maintenance together with lawful interest, costs and reasonable attorney's fees incurred in the enforcement thereof shall be a charge on the said Duplex Unit and shall be a continuing lien upon the property of the Owner who defaulted in this maintenance covenant. The lien shall not be deemed to be perfected or enforceable against the Duplex Unit or against bona fide Third party purchasers or lienholder until after a lien statement is filed or recorded with the Clerk and Recorder 's office of Weld County, Colorado, giving notice of such claim fox lien.
