Explain, in detail, the proposed use of the property. This property will be used for the purpose of a 60 Ill MSCFD cryogenic gas processing plant to support existing and future development of mineral resources in the area. Gas from nearby wells will be treated and cooled on site and NCL's will be removed via an existing pipeline already located within the site boundary. Along with the plant and associated buildings and facilties, the proposed use includes a 160 -foot communications tower, temporary (during construction) cargo containers, construction trailers, and construction laydown areas on site. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. This proposal supports the Economic Development goals and policies outlined in Sec 22-6-20 and the agricultural private property rights covered in 22-2-10 while simultaneously complying with the goals and policies set forth regarding Natural Resources in Sec 22-5-100. The buffer of land surrounding the plant is designed to minimize the impact of incompatibilities that occur between the natural site features and surrounding properties per Section 22-2-100 E while acceding to the County's desire to promote the safety of all citizens and structures, Section 22-5-100 B. The County does recognize individual property owner's rights to request a land use change per Section 22-2-20 G., stating that such development should be supported and Outrigger is attempting to be compatible with the region as stated in the same Section. Outrigger will ensure that adequate services and facilities are currently available or reasonably obtainable to accommodate the requested new land use change for more intensive development per Section 22-2-20 H. Outrigger has and will continue to communicate with surrounding property owners per Section 22-2-20 1.5 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located Section 23-3-40 states that agricultural land may be used, with permit, for oil and gas facilities, support and services. This site is consistent with stated intent (23-3-40 A.2) as well as A.7 regarding transloading. Will permit cargo containers, 23 -3 -4O -BB. 4. Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. The areas surrounding the site have agricultural land use as well as oil and gas exploration and development. The site is designed with minimal impact and footprint to the surrounding area with plenty of buffer on all sides of the plant. The facility is designed to support the reasonable and orderly exploration and development of mineral resources occurring in the area. S. What are the hours and days of operation? No additional landscaping will be implemented due to the arid nature of the area. 13. Describe the type of fence proposed for the site. A 6 -foot chain link fence is proposed with a manual gate for access to the site. 14. Describe the proposed screening for all parking and outdoor storage areas At this time, there is no screening plan for this site. There are no houses within a 125 mile radius of the site and CR 85 is unmaintained and therefore untraveled. 15. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. When this site is no longer in use as a gas plant, it will be returned to its natural native grasses, the drainage pond will be emptied and back -filled. 16. Who will provide fire protection to the site? The Briggsdale volunteer fire department, 970-656-3503. They have been sent notification along with outrigger contact information and have acknowledged notification. They will be sent appropriate emergency info with muster areas and access points before the plant is brought on ine, per their request. (Please see attached Emergency Action Plan.) 17. Lust all proposed on -site and off -site improvements associated with the use (e.g. landscaping, fencing,. buildings, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Landscaping, as discussed under #12, will be gravel and dirt inside the fence and natural grasses, as common to the area, outside the fence. Surrounding property owners will be notified of the planned site including the natural grass landscaping. The plant will be fenced with a 6' high chain link fence with barbed wire on top. There will be two to three manually operated gates for vehicle access. The fence will be installed after grading is complete, hopefully mid -September. Surrounding property owners will be n otified that no screening is planned for this site. Proposed Structures: (1) 12'x60' prefabricated PDC building, (1) 6'x8'prefabricated meter houses, (1) 15' x 8' pre -fabricated meter control building (1) 45'x60' office/shop, (1) 120' x 60' metal compressor building. Buildings won't be started until permitting, grading, foundation permitting, and foundation work is complete. All buildings planned to be complete by 2/2019. The site grading will include a detention pond. The detention pond is described at length in the drainage plan. It is shown on the plot plan and designated as a "No Build/No Storage Area". County Road 85, an unmaintained county road, will be improved from Hwy 14 south to the e ntrance of the plant. This distance is approximately 2980'. CR 85 will be improved along the section line in the recorded road ROW. Location of planned lights are shown on the plot plan. All lights will be mounted on pipe rack or buildings with the exception of one light pole being located by the truck loading area. Lights will n ot overly illuminate large areas and will be directed at 90 degrees to the natural ground plane. Lighting will comply with Weld County dark sky standards. Additionally, Outrigger will address any concerns received from surrounding property owners who are notified of the site plans. Outrigger has taken into consideration noise concerns in the planning of this site. All process equipment is a minimum of 500' from property lines. Reciprocating compressors will be in buildings and will have hospital -grade mufflers. Valves with noise levels above 70 dBs will be insulated. Outrigger has developed a communication plan to communicate with surrounding property owners as well as the local fire department. (Please see attached letter sent to surrounding property owners.) Improvements will begin when appropriate permitting approval is received. Engineering Questions: 1. Environmental Health Questions: 1. What is the drinking water source on the property? The drinking water will be delivered weekly during construction. A well permit has been applied for and approved with the State. The well permit number is 309340. When construction is complete, well water will be the source of drinking water. 2. What type of sewage disposal system is on the property? Currently there is none. Port -a toilets will be provided per OSHA standards. A septic system will be permitted and installed when the office building is being constructed. It will be designed by an engineer and will be inspected before the office is in use. 3. No.: 0 Date: 07 May -2018 Page 1 of 2 FACILITY OVERVIEW The Makena Gas Plant is a 60 MMSCFD SCFD cryogenic gas processing facility. Incoming gas and liquids are separated in the high pressure slug catcher, sitting on the west side of the facility. The liquids are stabilized and stored on -site in a 60,000 gallon NGL storage tank, before being pumped into the Y -grade OPPL pipeline on -site. The gas is routed to an amine treater, and then a cryogenic processing package, which cools the gas, then distills the stream to separate the gas into a pipeline quality gas and Y -grade pipeline quality liquids. The DeMethanizer is the distillation column used to separate the product liquids and gas. The liquids are routed to the Y -grade OPPL pipeline on -site. The product gas is routed to the Cheyenne Plains Gas Pipeline off -site. Water and carbon dioxide are removed from the incoming gas stream as waste. Water removed during the process is sent to a tank, and trucked off -site for disposal. Carbon dioxide removed from the gas stream is sent to a thermal oxidizer to ensure full combustion of the waste gases before venting. Flammable gases and liquified -petroleum -gases (LPGs) are the primary chemical hazards associated with the plant. 1. 2. 3. Transportation Routes — Access to the site will be from the north, Hwy 14, turning south from Hwy 14 onto CR 85. 10. Action Items and Response 10.1. Large Liquid Release — The emergency response to a spill of one of these liquids would be to first stop the flow if possible. Try to control the liquids which were spilled such as using dirt to dike the area in front of the spill. If the spill is condensate or LPG do not do anything which might cause a spark. Use pumps or a vacuum truck to remove as much liquid as possible. Remediate the soil assoon as possible to prevent the liquids from going any deeper in the soil. In case of exposure to any of these liquids see the proper Safety Data Sheet (SDS) for health effects and emergency procedures. Safety Data Sheets (SDS) for all materials located in the Facility can be found in the SDS manual/ located at the Outrigger Energy Makena Gas Plant Office 10.2. Large Gas Release - For large gas releases not associated with normal operations, call 911, isolate the area in question and blow down the pressure. Record all details pertaining to the incident. Notifications should proceed as in any other emergency. 10.3. Fire At the scene of a fire, Outrigger Energy employee shall take every corrective action necessary to protect life first and then property from danger. The employee shall access the danger to public, surrounding building occupants, and property by use of visual observance, leak detectors, pressure gauges, etc. Call 911. Evacuate or assist all persons to safety. Blockade area if necessary and maintain communication with fire, police and other public officials that are on the scene. 11. Coordination with First Responder Agencies: When at the scene of an emergency, the most senior Outrigger Energy representative shall develop a tentative course of action. Actions should be directed toward protecting people first, then property. First responders at the scene will want to help Outrigger Energy personnel in coping with the situation they are in. However, during all circumstances, first responders are to remain outside of the facility limits until approved to enter by an Outrigger supervisor on scene. 12. Safety and Training Review: Outrigger employees are trained for emergency response upon hiring and annually thereafter. Outrigger will conduct annual emergency shutdown tests at the Makena Gas Plant. 2 April 16, 2018 Trent Taylor Outrigger DJ Operating, LLC 1200 Seventeenth Street, suite 900 Denver, CO 80202 RE: Desktop Environmental and Cultural Review, Vacant Land, Weld County, CO INTRODUCTION Outrigger DJ Operating, LLC (Outrigger) is proposing to construct and operate an approximately 80 -acre parcel of privately owned land in the southeast 114 of section 25, township 8 north, range 62 west in Weld County, Colorado, hereafter referred to as the proposed Project (Attachment A, Figure 1). The proposed Project occurs approximately 3 miles east of the city of Briggsdale and approximately 0.5 mile south of the intersection of State Highway 14 and County Road 85. The purpose of this desktop analysis is to evaluate the proposed Project for environmental constraints pertaining to the U.S. Clean Water Act Sections 401/404, Endangered Species Act, Migratory Bird Treaty Act, Bald and Golden Eagle Protection Act, Colorado Parks and Wildlife (CPW) guidelines, Colorado Oil and Gas Conservation Commission (COGCC) rules, and National Historic Preservation Act, and to discuss any regulatory permitting that may be warranted. PROJECT SETTING The proposed Project setting was reviewed to aid in determination of natural and cultural resources constraints. A brief summary of existing site conditions is provided below. Topography Elevation of the proposed Project ranges from 4,982 feet above mean sea level (msl) near the proposed Project's southwestern extent to 5,023 feet above msl near the proposed Project's north central boundary. The topography of the proposed Project gently slopes downward traversing from the northeast to the southwest (Attachment A, Figure 2). Hydrology The proposed Project is located in the Bidwell Lake -Crow Creek (101000090503) and Greasewood Lake -East Greasewood Flats (101900031003) subwatersheds, which are located within the South Platte (101900) watershed (EPA 2018). Aerial imagery, United States Geological Survey (USGS) topographic maps, USGS National Hydrography Data (NHD), and the National Wetlands Inventory (NWI) database (USFWS 2018a) indicate that there are no USGS blue -lines, NWI wetlands, or ponds intersected by the proposed Project. Vegetation According to the National Land Cover Database (NLCD), the proposed Project intersects one vegetative class — Cultivated Cropland (Homer et al. 2015). Cultivated Cropland is described as areas used for the production of annual crops including corn, soybeans, vegetables, tobacco, cotton, and perennial woody crops such as orchards and vineyards. Crop vegetation accounts for Outrigger DJ Operating, LLC 80 -acre Property, Weld County, CO April 2018 Page 2 greater than 20 percent of the total vegetation within this class and all land being actively tilled is also included in this designation (Homer et al. 2015). Soils Two soil units are intersected by the proposed Project. Table I lists the soil units within the proposed Project area (NRCS 2017). Hydric soils are defined as soils that formed under conditions of saturation, flooding, or ponding long enough during the growing season to develop anaerobic conditions in the upper part. WATERS OF THE U.S. Under Section 404 of the Clean Water Act, the USAGE has the authority to permit the discharge of dredged or fill material into waters of the U.S. The term "waters of the U.S." is defined under the Clean Water Act as: • All waters which are currently used, or were used in the past, or may be susceptible to use in interstate or foreign commerce, including all waters which are subject to the ebb and flow of the tide; • All interstate waters including interstate wetlands; All impoundments of waters otherwise defined as waters of the U.S. under the definition; All other waters such as intrastate lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, or natural ponds, the use, degradation or destruction of which could affect interstate or foreign commerce including any such waters: (i) which are or could be used by interstate or foreign travelers for recreational or other purposes; or (ii) from which fish or shellfish are or could be taken and sold in interstate or foreign commerce; or (iii) which are used or could be used for industrial purpose by industries in interstate commerce; and • The territorial seas. In 2006, Rapanos w. United States clarified that waters of the U.S. are also defined as: Traditional Navigable Waters (TNW) and their adjacent wetlands; non -navigable tributaries of TNWs that are relatively permanent; and wetlands that directly abut such tributaries. In addition, the Rapanos plurality decision clarified that the USAGE asserts jurisdiction over every water body that is not a relatively permanent water (RPW) if that water body is determined to have a significant nexus with a TNW. A significant nexus exists if the tributary, in combinations with all of its adjacent wetlands, has more than a speculative or an insubstantial effect on the chemical, physical, or biological integrity of a TNW. Outrigger DJ Operating, LLC 80 -acre Property, Weld County, CO April 2018 Page 3 The limit of USACE jurisdiction for non -tidal waters of the U.S. in the absence of adjacent wetlands is the ordinary high water mark (OHWM). "Ordinary high water mark" is defined by USACE documentation as that line on the shore established by the fluctuations of water and indicated by physical characteristics such as clear, natural line impressed on the bank, shelving, changes in the character of soil, destruction of terrestrial vegetation, the presence of litter and debris, or other appropriate means that consider the characteristics of the surrounding areas. Wetlands are defined as those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions (USAGE 1987). To be considered a wetland, an area must have: (1) a prevalence of hydrophytic vegetation, (2) hydric soils, and (3) appropriate wetland hydrology. The feature must have a hydric connection or significant nexus to a waters of the U.S. in order to be considered jurisdictional under Section 404. Certain geographic features are generally not considered waters of the U.S. by the Environmental Protection Agency (EPA) and USACE. These geographic features include swales, erosional features, and small washes characterized by low volume, infrequent and short duration flow; ditches draining wholly uplands and that do not carry a relatively, permanent flow of water; and upland transporting of overland flow generated from precipitation. In addition, isolated features that do not have a significant nexus or connection to a water of the U.S. are not considered waters of the U.S. and are not federally regulated. n May 27, 2015, the Environmental Protection Agency (EPA) and the USACE announced a final rule, the "2015 Rule," redefining the scope of waters protected under the CWA. According to the agencies, the new rule revised the definition of waters of the U.S. to be consistent with the CWA, legal rulings, the agencies' expertise and experience, and science concerning the interconnectedness of tributaries, wetlands, and other waters and effects of these connections on the chemical, physical, and biological integrity of downstream waters. The rule became effective on August 28, 2015. However, on October 9, 2015, the U.S. Court of Appeals for the Sixth Circuit stayed the Clean Water Rule nationwide pending further action of the court. In response, the EPA and USAGE resumed the use nationwide of the agencies' prior regulations defining waters of the U.S. An amendment published on February 6, 2018 added an applicability date for the 2015 Rule in order to maintain the status quo, providing continuity and regulatory certainty while the EPA and USAGE consider possible revisions. The applicability date for the 2015 Rule is February 6, 2020. Section 404 of the Clean Water Act Based on aerial imagery, USGS topographic maps, USGS NHD, and NWI database, potential waters of the U.S. are not located within the proposed Project area. Therefore, the proposed Project is not subject to Section 404 and coordination or permitting with the USACE is not warranted. No further action is recommended. FEDERALLY LISTED THREATENED AND ENDANGERED SPECIES The United States Fish and Wildlife Service (USFWS) has authority under the Endangered Species Act (ESA) to list and monitor the status of species whose populations are considered imperiled. Species listed as threatened or endangered by the USFWS are provided full protection under the ESA including a prohibition of indirect "take." The term "take" means to harass, harm, Outrigger DJ Operating, LLC 80 -acre Property, Weld County, CO April 2018 Page 4 pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct with regards to a federally -endangered species. According to the USFWS Information, Planning, and Conservation System (IPaC), 9 federally listed species should be considered in an effects analysis for the proposed Project: Preble's meadow jumping mouse (Zapus hudsonius preblei), least tern (Sterna antillarum), Mexican spotted owl (Strix occidentalis lucida), piping plover (Charadrius melodus), whooping crane (Grus americana), pallid sturgeon (Scaphirhynchus albus), Colorado butterfly plant (Laura neomexicana var. coloradensis), Ute ladies' -tresses (Spiranthes diluvialis), and western prairie fringed orchid (Platanthera praeclara) (USFWS 2018b). While the bald eagle (Haliaeetus leucocephalus) has been delisted due to recovery, this species is still protected under the Bald and Golden Eagle Protection Act. This species is found primarily near rivers and large lakes and nests in tall trees or on cliffs near water (USFWS 2007). Based on aerial imagery, habitat for the bald eagle, such as forested areas with large enough trees to support nesting or perching, does not appear to be located in the vicinity of the proposed Project alignment; therefore, this species is not likely to be encountered during construction. Of these 16 species, western burrowing owl, Cassin's sparrow, chestnut -collared longspur, lark bunting, long -billed curlew, and mountain plover are the only ground nesting birds with breeding ranges that overlap the proposed Project. No nests or habitat suitable for these species are known to occur within the agricultural land of the proposed Project. Field surveys may be recommended for western burrowing owl if suitable habitat is created by prairie dog colonization. Additionally, Apex conducted a desktop review using the CPW Species Activity Mapping (SAM) data, together with a proprietary database of over 1,300 mapped raptor nests throughout the Denver-Julesburg Basin, maintained and largely compiled by Apex biologists. Google Earth and NAIP 2017 aerial imagery were also utilized to examine ground surface and vegetation within the parcel. There are no mapped ground (e.g. ferruginous hawk) or tree raptor nests, nor trees suitable for nesting raptors within 1/2 mile of the proposed Project. In order to fully comply with the MBTA, ESA, and in a good faith effort to protect Colorado bird species, Apex recommends implementing avoidance strategies recommended by USFWS in order to avoid impacts to migratory birds. Strategies may include the following efforts, which are listed in order of preference: • Avoid clearing and construction during the migratory bird nesting season (February 1 to October 31). • Vegetation removal and ground disturbing activities should be phased to occur outside of the nesting season (February 1 to October 31) and to avoid impacts to spring and fall migrants. • Any areas that are cleared and grubbed prior to the migratory bird season, but that are n ot constructed within a reasonable tirneframe, would be maintained, as practicable and n ecessary, to avoid the regrowth of nesting habitat. • Survey for nesting birds within 10 days of construction in any areas that were not cleared prior to February 1. If nests are identified during surveys, work would stop until the appropriate construction buffer around the nest can be determined. Construction would restart after nest had failed or the chicks have fledged. • Other reasonable, prudent, and effective measures include use of suitable mufflers on engines to minimize noise and use of approved roadways for construction traffic. CULTURAL RESOURCES Alpine Archaeological Consultants, Inc. (Alpine), under the auspices of Apex, reviewed the Colorado Office of Archaeology and Historic Preservation's online Compass database to identify previously conducted inventories, and previously recorded sites, within and around the proposed Project. The file search covered an approximately 1 -mile -wide buffer surrounding the proposed Project. Overall, the review indicates that limited cultural resource work has occurred near the proposed Project. Only two previous inventories are within 1 mile of the proposed Project (neither overlap the survey area), and no previously recorded sites are within the file search area. The previous inventories include one well pad survey, and one small inventory of two blocks for the Natural Resources Conservation. Service (Attachment A, Figure 3). Both were negative for cultural resources. An unnamed road is visible in the northwest quarter of Section 25 on the 1872 general Outrigger DJ Operating, LLC 80 -acre Property, Wed County, CO April 2018 Page 9 land office (GLO) map, but does not appear to enter the proposed Project area (Attachment A, Figure 3, Inset). Based on the file search results and its location (within a plowed agricultural field, distance from any major water source), Alpine anticipates a very low likelihood of encountering cultural resources within the proposed Project area. SUMMARY AND RECOMMENDATIONS • Based on aerial imagery, USGS topographic maps, USGS NHD, and NWI database, potential waters of the U.S. are not located within the proposed Project area. No further action is recommended. No habitat for federally listed endangered, threatened, or candidate species was identified during desktop review. No further action is recommended. • Conservation measures should be implemented during the migratory bird nesting season or if nesting birds are identified within the proposed Project during construction. This would include a biological nesting survey within 10 days of vegetation clearing as proposed Project activities are initiated. • The proposed Project is not subject to Section 106 of the National Historic Preservation Act and has a low to negligible potential for containing significant cultural resources; therefore, Apex does not recommend a cultural resource survey. A radio system is being designed to allow for operators at the Makena Gas Plant to remotely control and monitor wellhead meters and nearby facilities. To accommodate remote control and access, the master radio at the plant will need to cover an area approximately 8 miles to the north, 10 miles to the east, and 6 miles to the south. No coverage is anticipated to be required to the west currently. Outrigger completed a survey of existing communications towers within a 10 -mile radius, to determine the availability of space on those towers. Table 1 below shows the results, and Figure 1 shows a map of those towers relative to the Makena Gas Plant. Based on an open -path study of required coverage area, the 84 m Souther Star tower could potentially provide the coverage. Outrigger reached out to Southern Star to ask for co -location of a radio on the tower. Southern Star, a private pipeline operator, declined access. Documentation to the declined access is shown in Figure 2. The Tri-State and Verizon towers in the area would not allow the coverage required to the east and south. The Industrial Tower would also not allow the coverage required to the east. Note — the Industrial tower sits approximately 120> below elevation of the Makena Gas Plant, and the top three spaces on the tower are already occupied. Based on these results, Outrigger is proposing a new 160 ft, or approximately 50 m, radio tower at the Makena Gas Plant. The tower will be used for Outrigger's master polling radio, a receiver for Internet data and server communication, and a radio for Overland Pass Pipeline, the NGL purchaser at the plant. Outrigger intends to use a Rohn 45GSR 160' guyed tower. Attachment A shows the specifications for the proposed radio tower.
