IN THE MATTER OF GRANTING RIGHT OF WAY FOR SIDE
TRACK ACROSS COUNTY ROAD NO. 188 TO U.P.R.R.CO.
WHEREAS, The Eaton Sugar
Company is desirous of securing for the U. P. R. R. Company the right
to construct and maintain a side track, or switch, over and across what
in commonly known as, County Wagon Road Number 188, viz :--
Said side track will cross said road at a point about midway between-- - -
the section corners common to section 31, Tp. 7 , R. 65 and Section 6, Tp.
6, R. 65.
WHEREAS, It is the desire of said Board to grant said request and
allow said privilege and easement.
NOW THEREFORE, Be it Resolved that sad right to construct such side
track across said highway at the point aforesaid be and the same is here-
by granted, provided said Railroad Company shall construct and maintain •
during the continuance of the privilege hereby granted, at the point of
crossing said highway, suitable approaches to said side track and con-
struct and maintain during the continuance of said privilege proper and
suitable appliances to render crossing thereon safe and secure to
travelers on said highway.

railroad to place a switch crossing the highway, as shown by the accom-
paning diagram.

We therefore petition your honorable body to cause to be laid out and opened a County road as above
described, and we, the owners of the land through which said road is sought to be laid out, in consideration
of the sum of one dollarjb us each and severally in hand paid by the said County of Weld, the receipt of
which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give the right
of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for
damage by reason thereof.
The said proposed line of road is more fully shown by the following map or plat, to which reference is
herein made, the same being in
TOWN4IIP NORTH RANGE _WEST.

virtue of the laps of the State of Colorado, first party,

organized and existing under and by virtue of the laws of
the State of Colorado, second party,

a right of way for a road across a portion of the southwest
quarter of Section 32, Township 7 North, Range 66 West of the
6" P.M. in Dald County, Colorado, and in consideration
thereof second party has conveyed to first party the following
described parcel of land:
A parcel of lend 60 feet in width, being
30 -feet measured at right angles on each
side of the following described center
line: Beginning at a point on the east
line of the County Road, said point being
North 1 degree, 11 minutes East 1040.5
• feet, thence South 82 degrees 36 minutes
East 30 fret from the southwest corner
of Section 32, Torsi9hip 7 North, Range
66 West of the 6" P.M.; running thence
from said point of beginning south 82
degrees, 36 minutes east 358 feet;

375 feet to a point in the inlet ditch to
Doodle Lake. Said parcel of land is
located in the southwest quarter of
