Dear Mr. Skelton: During the Weld County Department of Public Health and Environment's ( CDPHE) last inspection of the Rattler Ridge Organic Recycling Facility, located at 120102 Weld County Road 59, conducted December 1, 2017, and outlined in a January 3, 2018, inspection letter, it was noted that there was windblown debris/litter that had left the site boundaries. Information on how A-1 planned on dealing with the debris was r s' crested, in the initial inspection letter and a response was received on January 10, 2018, in the form of ;an email. A-1 indicated several methods to help reduce and remove this Jebrii hitter including: procurement of a slow speed shredder; re -configuring wind row sizing and construction; adding additional capping methods; purchasing a high vofume and high suction power vacuum truck to pick up litter; using hired labor to pickliD debris; and, purchasing an industrial grade 1S -foot litter fence to be installed along the east and southeast portions of the property. It appears that hired labor has been implemented, but no other options have been used or a timeline for implementation established. On January 18, 2018, WCDPHE received a complaint of debris/litter blowing off -site and onto neigh or1ng properties from the A4 Facility_ An inspection of the property conducted by a representative of this department on January 19, 2018, found significant debris on neighboring properties outside the Rattler Ridge property boundary. hi accordance with Development Standard 13 of ASR- 1255, "Waste materials shall be handfed, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisanceConditions". A site v sit was conducted yesterday (2/27) which noted debris on neighboring properties (see attached pictures). It did appear that some efforts had been made to c ean L. p the debris, but it still appears that debris is migrating to neighboring properties, WCDPHE understands that AC, -s working on constructing a debris fence, but it should be noted that debris should be ccntrollled to the site during this construction period (and after) and any debris that has left tie site will need to be removed from neighboring properties. Mixing immediately upon arrival at the site 3. Records of mixing temperatures, keeping the compost piles aerobic 4. Spills - noted on site visit trucks spilling over the entire area 5. If odors are detected - need to have site manager address issues — no evidence that this was occurring - Weld County inspections and Colorado Department of Public Health Solid Waste division records show violations Regulatory Issues 1. Need for Engineering and Operations Plan - still working on very old plan with promise to update - we did not find any updates on this plan at Rattler Rid.. g 2. R,emediatteni activities will consist of aeration, additional capping of materialist application of deecidorizing materials at the source, icontatirment in an in -vessel system, renoval of maierials from the site, or a comb n aat a n of these items, p .r r Regulatory Issues ' Approvals of waste streams -- rendering wastes are are issue • Site visit on Jan 29, 2018 — spilling of materials + Removal of waste streams which add either trash to the site and./or odor issues � EDOP calls for control of flies o At this time, flies are not an issue due to cold temperatures a o In the summer, the temperature rises and flies become a significant issue o EDO ' calls for numerous measures to control flies — .fir. Guttersen continues to have fly issues Conclusions I I I Al Organics is in violation of the CDPHE regulation, the Special Use Permit and the Certificate of Designation due to the violations associated with the trash issue This is a considerable issue to the Guttersen Ranch and needs to be resolved The initial written correspondence started in 20[l4 and has not been resolved over the last 14 years. This needs to be addressed and faced. Need to stop trash immediately and need to control odors andflies immedicately Hello
