A public hearing was conducted on November 14, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
• I hereby certify that pursuant to a notice dated September 14, 2018, and duly published
September 19, 2018, in the Greeley Tribune, a public hearing was conducted to consider the
request of Glenn Dewayne Cecil, for a Site Specific Development Plan and Use by Special Review
Permit, USR18-0074, for one (1) Single-Family Dwelling Unit per lot other than those permitted
under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District.
Frank Haug, Assistant County Attorney, made this a matter of record.
• Chair Pro-Tern Kirkmeyer reviewed for the applicant and the public, the procedures to follow
should this case result in a tie vote due to four(4) Commissioners being present and Chair Moreno
excused.
• Angela Snyder, Department of Planning Services, presented a brief summary of the proposal
and stated the proposed second home was permitted, in 1998, with a Zoning Permit for a Mobile
Home, ZPMH-1093, for a medical hardship for the applicant's grandmother. She explained the
applicant's mother now lives in the primary home on the property and the second dwelling would
be used for her in the future; however, if she chooses to stay in the primary home the second
dwelling could be used for a caregiver or a rental. Ms. Snyder stated the secondary home is
manufactured and built on a permanent foundation. She explained there are no intentions of
splitting the lot, indicated the adjacent County roads (CR) to the property and stated the site has
two (2) accesses on CR 51 and CR 74. She confirmed the proposed site is not within the three
(3) mile referral area of any municipality, no referral agencies have objected to the application

and five (5) referral agencies have responded without concerns or with concerns that were
considered in the staff recommendation. Ms. Snyder mentioned the Department of Planning
Services has had no correspondence from surrounding property owners (SPO). She described
surrounding uses and zoning, and explained there is a current USR that covers a portion of the
proposed parcel for a hog farm, SUP-315. She indicated vacating or partially vacating the USR
for the hog farm is included in the Conditions of Approval. She provided images of the site and
surrounding views and entered the favorable recommendation of the Planning Commission into
the record as written.
Evan Pinkham, Public Works Engineer representative, reiterated there are two (2) accesses,
and stated staff is recommending closing the access on CR 74 due to various issues. He
mentioned the traffic counts to include truck percentages, provided a brief overview of the
transportation plans and requirements, and presented the drainage and grading requirements.
. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated water is provided by the North Weld County Water District (NWCWD). She
stated Greeley Sanitation provides sewer, and Development Standards (DS) #10 and #11
address Environmental Health items.
IR Sheri Lockman, Lockman Land Consulting, LLC, represented the applicant and stated the
second home is ideal for the proposed lot. She explained the use is compatible and similar to
second dwellings on surrounding parcels. She requested the Board discuss the accesses and, in
response to Commissioner Conway, Ms. Lockman stated the Planning Commission did not have
an issue with the use of both accesses.
El No public testimony was offered concerning this matter.
In response to Chair Pro-Tern Kirkmeyer, Ms. Lockman indicated they have reviewed, and
agree to the Conditions of Approval and Development Standards, as presented. In response to
Commissioner Cozad regarding the pig farm SUP, Ms. Snyder clarified it is at the decision of the
applicant whether they would like to vacate part of or all of the SUP, which includes three (3) or
four (4) surrounding parcels. After lengthy discussion regarding the vacating and mapping of the
original SUP, Ms. Snyder clarified there is no map associated with the SUP and, therefore, it does
not have to be amended. Commissioner Cozad recommended submitting a letter to state the
applicant is vacating their part of the SUP, which staff indicated has already been done. Chair
Pro-Tern Kirkmeyer suggested removing the last sentence of Condition of Approval (COA) #1.A
regarding the signatures of SPOs for the vacation and the Board agreed. Chair Pro-Tern
Kirkmeyer suggested changing COA#9 to read, "The applicant shall show and label the existing
accesses." Commissioner Cozad recommended deleting COA #11 regarding traffic circulation.
Commissioner Freeman suggested deleting Development Standards (DS) #6-8, regarding public
road impacts, parking, and easements. Commissioner Cozad further recommended deleting DS
#13 regarding access to the site for staff at any reasonable time and the Board concurred to the
changes.
El In response to Chair Moreno, Ms. Lockman indicated they have reviewed, and agree to abide
by, the Conditions of Approval and Development Standards, as amended.

El Commissioner Freeman moved to approve the request of Glenn Dewayne Cecil for a Site
Specific Development Plan and Use by Special Review Permit, USR18-0074, for one (1) Single-
Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-
family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of
Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as amended and entered into the record. The motion was seconded by Commissioner
Conway, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:39 a.m.
This Certification was approved on the 19th day of October, 2018.
