HomeMy WebLinkAbout20183774.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 26, 2018 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 26, 2018, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Senior Accountant, Chris D'Ovidio • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of November 21, 2018, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner Cozad moved to read Code Ordinance#2018-10 by audio. The motion was seconded by Commissioner Conway and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on November 21, 2018, as follows: 1) USR18-0072 - Steven and Carie Winter, c/o Carters Lawn Care, Inc., and 2) USR18-0070 — Abelardo and Edgar Vega. Commissioner Cozad seconded the motion, which carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. El PUBLIC INPUT: No public input was given. O1/O Minutes, Monday, November 26, 2018 2018-3774 Page 1 BC0016 BIDS: • 1) PRESENT BID #B1800158, EMC UNITY STORAGE EXPANSION — DEPARTMENT OF INFORMATION TECHNOLOGY: Josh Thimgan, Department of Information Technology, reviewed the six (6) bids received and stated staff will bring back a recommendation on December 10, 2018. El 2) RESCIND AND APPROVE BID #61800138, PATROL ALL-WHEEL DRIVE OR 4X4 SUV PURSUIT RATED (QTY. 10) -SHERIFF'S OFFICE: Rob Turf, Department of Purchasing, requested the original award to low bidder, AutoNation Ford in Littleton, be rescinded, because they won't be able to supply the ten (10) vehicles at the original bid price or the 2019 model. Mr. Turf explained Spradley Barr Ford will meet the specifications and is willing to give a discount of $600.00 per vehicle so the additional cost to the County is $21,872.00. In response to Chair Moreno, David Springer, Director of Fleet Management Services, stated he was able to address questions and has been in contact with Josh Noonan, Sheriff's Office, through this process. Commissioner Conway moved to rescind said bid and award the bid to Spradley Barr Ford. The motion was seconded by Commissioner Cozad, and it carried unanimously. Commissioner Cozad thanked Mr. Springer for working with the Sheriff's Office. NEW BUSINESS: El 1) CONSIDER CONTRACT ID #2248 MEMORANDUM OF UNDERSTANDING FOR HOTLINE CALLS FOR CHILD AND ADULT PROTECTIVE SERVICES AND AUTHORIZE CHAIR TO SIGN - PROWERS COUNTY: Judy Griego, Director of the Department of Human Services, reviewed the terms which will allow Prowers County to manage and administer Hotline calls regarding alleged Child Welfare and Adult Protection concerns. Ms. Griego stated the anticipated cost is $125,580.00. Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously. El 2) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR VICTIM ASSISTANCE UNIT GRANT AWARD AND AUTHORIZE CHAIR TO SIGN: Michael Rourke, District Attorney, present the agreement for the Victim Assistance Unit Grant award. He stated the grants are important to Victim Witness Assistance and thanked staff for their hard work obtaining the grant. Commissioner Conway moved to approve said intergovernmental agreement and authorize the Chair to sign. The motion was seconded by Commissioner Cozad. Commissioner Conway stated the District Attorney's Office has an important position in assisting victims and witnesses of crime. Commissioner Cozad expressed her appreciation to staff for assisting victims and helping them to understand their legal rights. Chair Moreno expressed his appreciation to Mr. Rourke for his professionalism during a recent high-profile case. There being no further discussion, the motion carried unanimously. • 3) CONSIDER APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM GRANT FOR IMPROVEMENTS TO CR 60.5 (TIER I) AND AUTHORIZE ELECTRONIC SUBMITTAL: Stacey Swanson, Department of Public Works, presented the details of the application for funds to pave County Road (CR) 60.5 from CR 47.5 to CR 51.5, and stated construction is anticipated to begin in the Fall of 2019. Commissioner Cozad moved to approve said application and authorize electronic submittal. The motion was seconded by Commissioner Conway, and it carried unanimously. • 4) CONSIDER APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM GRANT FOR SIX (6) MOTOR GRADERS (TIER II) AND AUTHORIZE ELECTRONIC SUBMITTAL: Ms. Swanson reviewed the details of the application for the Energy and Mineral Impact Assistance Program Grant to purchase six (6) motor graders and one crushing plant which will be purchased in late Spring of 2019. Commissioner Freeman moved to approve said application and authorize electronic Minutes, Monday, November 26, 2018 2018-3774 Page 2 BC0016 submittal. Seconded by Commissioner Cozad, the motion carried unanimously. Each one of the Commissioners thanked staff for dedicating their time to these projects. • 5) SECOND READING OF WELD COUNTY CODE ORDINANCE #2018-11, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE (FEES), OF THE WELD COUNTY CODE: Commissioner Freeman moved to read Code Ordinance #2018-11, by title only. The motion was seconded by Commissioner Cozad and it carried unanimously. Mr. Barker read the title for the record. Dawn Anderson, Department of Public Works, addressed the proposed changes for the right-of-way fees. She stated staff researched and compared Weld County's current and proposed fees with three (3) other counties and two (2) municipalities. She stated staff did a permit project comparison, and the proposed fee will cover 68% of the cost. Commissioner Cozad thanked Ms. Anderson for researching and comparing the fees from other counties and making sure Weld County's proposed fees do not exceed the costs to the County. Commissioner Cozad stated it has been over ten (10) years since the fees have been increased and she believes they are reasonable. No public testimony was offered concerning this matter. Commissioner Cozad moved to approve Code Ordinance#2018-11 on Second Reading. The motion, which was seconded by Commissioner Freeman, carried unanimously. ▪ 6) FIRST READING OF WELD COUNTY CODE ORDINANCE #2018-10, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, AND CHAPTER 12 LICENSES AND PERMITS (RIGHT-OF-WAY), OF THE WELD COUNTY CODE: Ms. Anderson reviewed the details of proposed Code changes and presented the change to repeal the Right-of-Way Use Permit policy and move it to Chapter 8 Public Works. She explained the other change will be to Section 8-13-10, to change the definition as defined by the Public Utilities Commission and lastly, the other changes are clean up of terminology and language. • Ryan Seastrom, representative of Colorado Oil and Gas Association (COGA), requested additional time for the oil and gas industry to review the Code Ordinance #2018-10 and provide their comments; however, he doesn't want to significantly impact the timeline. In response to Commissioner Conway, Mr. Seastrom stated a couple weeks will be a sufficient amount of time to review the Code Ordinance. Commissioner Cozad suggested with the scheduled date of the Second Reading there should be enough time to review and submit comments. Commissioner Freeman stated he feels confident with moving forward with the Second Reading. Commissioner Cozad suggested submitting any questions or comments to the Department of Public Works. Mr. Barker stated the goal is to get this completed before the new LAP process goes into effect February 1, 2019. Commissioner Conway expressed his frustration with moving forward and stated he will not be present at the Second Reading on December 19, 2018, therefore, he would like a work session scheduled before he leaves so he can be present. • Commissioner Cozad suggested a work session be scheduled the week of December 10, 2018, when all five (5) Commissioners are available to address any questions or concerns before the Second Reading. • Commissioner Freeman moved to approve on First Reading and schedule a work session for the week of December 10, 2018. Seconded by Commissioner Cozad, the motion carried unanimously. Minutes, Monday, November 26, 2018 2018-3774 Page 3 BC0016 PLANNING: 1) CONSIDER RESUBDIVISION, RES18-0004, TO CONSOLIDATE LOTS 1-3 AND PART OF LOTS 4-6, BLOCK R, OF EVANS ADDITION SUBDIVISION AND PART OF ABANDONED UNION PACIFIC RAILROAD RIGHT-OF-WAY (IN CONJUNCTION WITH 1AMRECX18-08-4742) INTO ONE LOT- EVEZICH TRUST FBO, JOLENE FAYE GITTLEIN, C/O JOLENE AND TIMOTHY GITTLEIN, CO- TRUSTEES: Michael Hall, Department of Planning Services, presented the application for a Resubdivision, stating the purpose is for a lot line adjustment to consolidate Lots 1-3 and part of Lots 4- 6, Block R, of Evans Addition Subdivision and the abandoned Union Pacific Railroad Right-of-Way, which is located south and east of the original centerline into one legal lot. He stated the amended Lot B of the Recorded Exemption will increase in size and the Lot which is part of the Resubdivision will be squared off. He explained by doing this it will prevent title and legal lot issues. He stated no new lots are being created by the Resubdivision and the minimum lot size is one (1) acre because it is located in a historic townsite. Mr. Hall displayed the photos of the property and its location. Tim Gittlein, applicant, stated he wants to consolidate some of the lot lines and do some clean-up of legal descriptions and title for ease of development in the future and thanked Mr. Hall for his guidance during the process. No public input was offered concerning this matter. el Commissioner Cozad moved to approve Resubdivision, RES18-0004, to consolidate Lot 1-3 and 4- 6, Block R, of Evans Addition Subdivision and part of the abandoned Union Pacific Railroad Right-of- Way. Seconded by Commissioner Conway, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2018-11 was approved on Second Reading and Code Ordinance #2018-10 on First Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
