HomeMy WebLinkAbout20180762.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 12, 2018 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, March 12, 2018, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem — Arrived at 9:04 a.m. Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Senior Accountant, Chris D`Ovidio • MINUTES: Commissioner Cozad moved to approve the minutes of the Board of County Commissioners meeting of March 7, 2018, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on March 7, 2018, as follows: 1) USR17-0044 — Kyle Kempema, 2) USR17-0072 — Pioneer Land Company, LLC, and 3) USR17-0061 — Que and Debora Fullmer. Commissioner Cozad seconded the motion, which carried unanimously. El AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PRESENTATIONS: • 1) RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN SERVICES — JO ANN WEBER: Chair Moreno read the certificate for the record recognizing Ms. Weber for her contributions to Weld County. Judy Griego, Director of the Department of Human Services, presented Ms. Weber with a plaque and pin for twenty-four (24) years of outstanding service. Nancy Lawson, Department of Human Services, thanked Ms. Weber for her service to the citizens of Weld County. Ms. Weber recounted her career with the Department of Human Services and expressed the pride she had working with Weld County Minutes, March 12, 2018 Page 1 2018-0762 BC0016 Government and enjoyed working with families and bridging relationships with her clients. Each Commissioner thanked Ms. Weber for her passion and outstanding customer service she offered to the residents of Weld County and stated she will be greatly missed. Commissioner Freeman invited her back to volunteer with Weld County. Ms. Weber thanked Bruce Barker, County Attorney, for his support. (Clerk's Note: The Board paused the meeting for a photo opportunity.) • PUBLIC INPUT: No public input was given. BIDS: 1) APPROVE BID #B1800052, CUSTODIAL SUPPLIES - DEPARTMENT OF BUILDINGS AND GROUNDS: Rob Turf, Department of Purchasing, presented the fourteen (14) bids received and stated staff recommends awarding to the bidders which met the specifications for each line item per staff's memorandum. Commissioner Freeman moved to approve staff recommendation. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. NEW BUSINESS: el 1) CONSIDER RENEWAL APPLICATION FOR A TAVERN (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - RM, INC., DBA ROOM 119: Frank Haug, Assistant County Attorney, reviewed the terms of the license renewal application and noted there are no concerns and recommends approval. Lisa Ruiz -Prieto, resident of Longmont, stated she had no further comments to add. Commissioner Cozad moved to grant said license renewal and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. • 2) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR ISLAND GROVE FENCE AND AUTHORIZE CHAIR TO SIGN - B AND B LOCAL CONSTRUCTION, LLC: Toby Taylor, Director of Buildings and Grounds, presented the details of the informal bid and stated staff recommends awarding to the low bidder, B and B Local Construction, LLC, for the amount of $5,984.00. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. ki 3) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR NEW FENCING FOR CR 15 TOWER AND AUTHORIZE CHAIR TO SIGN - B AND B LOCAL CONSTRUCTION, LLC: Mr. Taylor reviewed the details of the informal bid to fence in the new County Road 15 Tower and stated staff recommends awarding to the low bidder, B and B Local Construction, LLC. Commissioner Cozad moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. IR 4) CONSIDER TEMPORARY CLOSURE OF CR 29 BETWEEN CRS 86 AND 88: Amy Joseph, Department of Public Works, presented the terms of the temporary closure beginning March 20, 2018, through March 23, 2018, to replace a drainage culvert. She stated staff will use water for dust abatement on the gravel detour route. Commissioner Kirkmeyer moved to approve said temporary closure. Seconded by Commissioner Cozad, the motion carried unanimously. • 5) CONSIDER TEMPORARY CLOSURE OF CR 32 BETWEEN CRS 13 AND 17: Ms. Joseph reviewed the details of the temporary closure beginning March 20, 2018, through March 23, 2018, for the replacement of a drainage culvert. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. • 6) CONSIDER TWO (2) PERMANENT EASEMENTS FOR THE FUELING STATION UPGRADE Minutes, March 12, 2018 Page 2 2018-0762 BC0016 AND AUTHORIZE CHAIR TO SIGN - ATMOS ENERGY CORPORATION: Tiffane Johnson, Department of Public Works, reviewed the terms to grant two (2) permanent easements to Atmos Energy Corporation, as part of the requirements necessary for the Weld County Fueling Site Upgrade. Commissioner Cozad moved to approve said permanent easements and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. El 7) CONSIDER CONTRACT ID #1717 ENERGY AND MINERAL IMPACT ASSISTANCE GRANT AGREEMENT FOR CR 87 IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN: Don Dunker, Department of Public Works, presented the $1,000,000.00 grant for reconstruction of approximately 2.6 miles of County Road 87 between U.S. Highway 34 and County Road 46.5. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. 8) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN - BAILEY NELSON: Commissioner Freeman moved to approve said appointment and authorize the Chair to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously. PLANNING: 1) SECOND READING OF CODE ORDINANCE #2018-02, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS (NATIONAL ELECTRICAL CODE), OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read Code Ordinance #2018-02 by title only. The motion which was seconded by Commissioner Cozad, carried unanimously. Mr. Barker read the title for the record. Jose Gonzalez, Department of Building Inspection, stated there have been no changes made since the first reading. No public input was offered concerning this matter. Commissioner Kirkmeyer moved to approve on second reading. Seconded by Commissioner Cozad, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2018-02 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
