RE: DESIGNATION OF ALVIN GARCIA AS CARETAKER OF BASEBALL DIAMOND.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board that
there is a need for someone to maintain and operate a baseball
diamond on property owned by Weld County, such property being
described as follows :
All that part of the Southwest Quarter of
the Southeast Quarter of Section 25, Town-
ship 6 North, Range 66 West of the 6th
Principal Meridian, Weld County, Colorado,
lying South of County Road 64 , being more
particularly described as follows:
Beginning at the Northwest corner of the
Spanish Colony, thence North 0°20 ' 7 " East,
128 . 00 feet to a point in the South line
of County Road 64 ; thence along the South
line of County Road 64 North 85°35' 25"
West , 758 . 93 feet; thence South 0°20 ' 19"
West, 195.72 feet; thence North 89 °17 ' 28"
East, 757 . 15 feet to the point of begin-
ning;
Said parcel contains 2 . 813 acres more or
less .
WHEREAS, Alvin Garcia, 1415 North 25th Avenue , Greeley,
Colorado, has been maintaining and operating a baseball field
at such property, and
WHEREAS, the Board wishes to designate Alvin Garcia as
caretaker of such field.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that Alvin Garcia, hereinafter
referred to as caretaker, has the right and authority by this
Resolution to operate and maintain a baseball diamond on County
owned property in accordance with the following provisions :
1. Such authority is limited to the following described
property:
All that part of the Southwest Quarter of

ship 6 North, Range 66 West of the 6th

Said parcel contains 2 . 813 acres more or less.
2 . The authority to charge a fee is to be limited to
organized tournament baseball games .
3 . Caretaker may charge Five Dollars ($5 .00) per game
played in an organized tournament and no more .
4 . Caretaker, in order to collect such fees, shall have
the responsibility of lining the field and furnishing
bases and other equipment needed in such tournaments.
5. In consideration of this designation, caretaker shall
have the responsibility of controlling weeds and
maintaining the baseball diamond. Caretaker shall
also provide toilet facilities .
6 . Caretaker shall also have the privilege of operating
a concession stand on such property during tournament
games. Caretaker shall have the sole liability and
responsibility for such concession and shall indemnify
and hold harmless Weld County from any liability
arising from such operation.
7 . Caretaker shall have the responsibility for establishing
reasonable rules and regulations for the use of the
baseball field by the public.
8. Caretaker shall not prohibit use of the property by the
general public.
9 . This designation may be terminated at any time by Weld
County with or without notice.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
September , A.D. , 1979 .

ACCEPTANCE OF DESIGNATION
THIS IS TO CERTIFY that Alvin Garcia, as on September 27
1979 , accepted the designation of caretaker for the operation of
a baseball diamond granted by the Weld County Board of County Com-
missioners as set forth in a Resolution adopted by that body on
September 26 , 1979 . Caretaker agrees that he will be
bound by and observe and carry out the terms and conditions of
such designation.
