The Board may suspend or revoke this permit, or assess a civil penalty, upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties, to you as permittee can result; 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 5. It is your responsibility to notify the Office of any changes in your address or phone number; 6. Upon permit issuance and prior to beginning on -site mining activity, you must post a sign at the entrance of the mine site, which shall be clearly visible from the access road, with the following information (Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. 7. The boundaries of the permit boundary area must be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance. 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Construction Material Rules and Regulations in effect at the time the permit is issued. 9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date (if there are changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example, a permit with the anniversary date of July 1, 1995, the annual fee is for the period of July 1, 1994 through June 30, 1995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the permittee, to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. 10. For joint venture/partnership operators: the signing representative is authorized to sign this document and a power of attorney (provided by the partner(s)) authorizing the signature of the representative is attached to this application. -7 - NOTE TO COMMENTORS/OBJECTORS: It is likely there will be additions, changes, and deletions to this document prior to final decision by the Office. The Timmerman/Wells Pit will be located north of Weld County Road 104 and west of Weld County Road 119 at the location shown on Exhibit B-1. The geology at the proposed site is mapped as the White River Group (Scott, 1978), which contains the upper and middle Oligocene Brule Formation and underlying lower Oligocene Chadron Formation. The Brule Formation consists of sandy to slightly clayey sandstone. The Chadron Formation consists of clayey blocky siltstone and montmorillontic clay. Tweto (1979), indicates that other material types include conglomerate rocks. D-2 MINING METHOD AND TIMETABLE The primary commodity to be mined will be sand and gravel (aggregate) for use as road base by the construction and oil and gas industries. The operator plans no production or sale of secondary or incidental products. The material will be excavated using standard earth moving equipment to consist of excavators and loaders. No blasting of the material will be required to excavate the resource. The excavated material will be loaded into off -highway haul trucks and be taken to the processing area shown on Exhibit C -B1. The processing area will consist of a crusher and screening plant to develop a suitable material to sell to the construction and oil and gas industries. Water consumption for mining and processing of the material will be minimal and will consist of dust suppression for haul roads and crushing and screening of the aggregate. The Timmerman/Wells pit proposes to produce approximately 500,000-1,000,000 tons of aggregate per year with a maximum exposed mining area at the end of operations of approximately 37 acres. The mining operations are anticipated to last for a period approximately 2 years, depending on market conditions. Topsoil removed from mining areas will be stockpiled for reuse during site reclamation. Due to the short duration of the mining activities and relatively small excavation footprint, reclamation will start at project termination. E-3 REVEGETATION The premining vegetation at the site consists of sparse native grassland. At the end of mining the disturbed areas will be revegetated. The revegetated area will be approximately 37 acres as shown on Exhibit F. Vegetation will be reclaimed using a native seed mixture on disturbed areas. Stockpiled topsoil will be spread across the site and tilled to a depth between 4 and 6 inches to provide an adequate surface for seeding. Planting of the seeds will occur between November 1st and May Pt after the termination of mining. Establishment of new vegetation outside of this time period is not advised because early germination and dry conditions can result in a failed attempt and require reseeding. Our proposed seed mix was provided from a northern Colorado seed company (Arnolds Custom Seeding) and is specifically engineered to perform well in the arid northeastern grasslands of Colorado. The seed mix provided in Table 1 was developed based on seed availability, soil map units, regional climatic conditions and professional experience. The fertilizer mix will be chosen after soil testing to select the most appropriate and efficient composition. Reseeding using a grass drill to seeding depth of'A" to '/" is the preferred reclamation method and historically has provided the best plant development. However, the applicant may elect to use broadcast seeding or hydroseeding with protective mulch in areas inaccessible by the grass drill equipment. Where broadcast seeding is used, the seed mixture should be incorporated by raking or harrowing the seed. Shrubs and/or trees will not be planted. The vegetation growth and density will be documented at the end of end of the first growing season, and documentation will continue until final bond release has been obtained from the State. Post reclamation inspections to document vegetation growth will be conducted early in the first growing season to monitor for noxious weed growth and will continue until the planted and native species are reestablished to approved densities. Noxious weeds will be managed through integrated methods in accordance with the Colorado Noxious Weed Act (CRS 35-5.5). E-4 POST -MINING LAND USE Prior to mining operations the land was used for rangeland and oil and gas development. The proposed reclamation plan will return the land to pre -mining use. There will be no reduction in available acreage for use as rangeland and no change to surface water flow that would adversely impact livestock or vegetation growth. Water flow in the ephemeral streams only occurs temporarily after a precipitation event. G-2 GROUNDWATER According to water well permits obtained from the Colorado State Engineer Division of Water Resources (CDWR) online database, approximately 8 water wells are located within 1/2 -mile of the impacted area. Based on review of the water well applications, groundwater near the site is reportedly present at a depth between 60 and 730 feet below ground surface. The maximum excavation depth during mining will be approximately 50 feet below the existing ground surface. Therefore, groundwater is not anticipated to be encountered or impacted during mining. The project area is comprised of flat land with slightly higher elevation sand bluffs along the edges of the site. This site contains no wetland, riparian, nor open water areas. The NDIS data was examined and species grids were obtained from the Colorado Gap Analysis Project (COGAP, 2015) to obtain information on species present in the region. Common wildlife within Weld County, which may occur on or within the project area, includes a variety of reptiles, mammals, and birds. Amphibians are unlikely to occupy the site because they generally require habitats along floodplains of streams or riparian areas where soft soils and a food source are available. Common species of reptiles, such as the lesser earless lizard, plains garter snake, prairie rattlesnake, and gopher snakes may inhabit the area. None of which are listed as threatened or endangered species. The Pawnee Grasslands are home to a wide variety of birds that use the grasslands for year- round habitation, nesting, and temporary roosting during migration. Raptors and songbirds are common throughout the grasslands and include the Swainson's hawk, prairie falcon, meadowlark, homed lark, and lark bunting. None of which are listed as threatened or endangered species. Since water is not located within the project area, waterfowl are not expected to utilize the location. Mammals are also expected to be found within the impacted area. Due to the lack of riparian, wetland and open water, both small and large mammals are not common within the impacted area. Mule deer, pronghorn, and coyote are some of the few large mammals likely to traverse the area. The impacted area is also considered to be suitable habitat for the desert shrew, desert Exhibit H dacx 1 Engineering Analytics, Inc. None of which are listed as threatened or endangered species. A list of threatened and endangered species in Weld County was obtained from the U.S. Fish & Wildlife Service (U.S. Fish & Wildlife, 2015) and includes: black -footed ferret, bald eagle, American peregrine falcon, Mexican spotted owl, least tern, whooping crane, piping plover, Preble's meadow jumping mouse, Colorado butterfly plant, and Ute ladies' -tresses. The habitat for the threatened and endangered species includes old -growth forest (Mexican spotted owl) and wetland, riparian, and open water. These habitats are not present within the impacted area so these species are not expected to be present. The population and reintroduction sites for the black -footed ferret is extremely limited in Colorado. There are currently only 21 black -footed ferret reintroduction sites throughout 8 states, Canada and Mexico. No reintroduction sites are located within the impacted area. No designated critical habitat for any federally -listed species is located on or near the site. It is possible that mining and reclamation activities may temporarily disturb wildlife within the vicinity of the impacted area. Impacts will be associated with the temporary loss of shrubs and grasses due to site development within the lower grassland area and removal of the sand hills along the perimeter of the work area. Reclamation activities will include topsoil application and reseeding with native vegetation. With the exception of the northern portion of the sand bluffs on the west side of the site, the local drainage patterns will remain consistent with pre -mining conditions. The sand bluffs will be graded to a maximum 3H:1V slope in disturbed areas, and the western -most area will be graded to form an area of internal drainage that will flow to the surrounding area to the south. Concentrating drainage on the west side may ultimately provide an increased variety and/or robustness of vegetation and animal habitat. Since the area will be reclaimed and reseeded with native vegetation, no permanent loss of habitat or long-term impacts to migratory birds will occur. Badland Series The Badland series soils consist of gently sloping to steep erosional slopes in soft claystone, sandstone and siltstone. Badland soils are located along the northeast edge of the impacted area and comprise less than 1% of the total area. Badland soils support little vegetation with limited value for livestock grazing and wildlife habitat. Bushman Series The Bushman series soils consist of well -drained sandy loam located on calcareous loamy alluvial fans. The units are thick, with the depth to bedrock at greater than 60 inches. Bushman series soils comprise approximately 4% of the impacted area on slope grades ranging from 3 to 9%. Cascajo Series The Cascajo series soils consist of drained gravelly sandy loam located on the backslopes and shoulders of dissected upland ridges. Otero Series The Otero series sandy loam are deep, well -drained calcareous soils on moderate to highly - dissected plains and alluvial fans. Cc: Bill Moser — Wells Trucking, LLC The pre -mining vegetation is consistent with the short grass prairie region typified by warm and dry (to warm and very dry) plant associations of the Central Shortgrass Prairie Ecoregion (Hazlett, 1998). Vegetation on the affected lands was mapped using aerial photography and the resulting delineations were confnmed and characterized by traversing the affected lands on foot. The survey was performed during the winter season. Light snow cover was present throughout the site, with occasional deposits of snow which limited view of portions of the ground surface. Vegetation observed during the field reconnaissance includes Yucca glauca (soapweed, Spanish bayonet), Buchloe dactyloides (buffalo grass), Gutierrezia sarothrae (snakeweed). Dormant vegetation due to seasonal variations limited the ability to identify all species of vegetation present on the site. No vegetation indicators were found that suggest the presence of wetlands, riparian areas, or other sensitive habitat types. The vegetation across the pre -mining area is mapped using two units. Although no significant change in the type of vegetation was encountered between the units, relative differences in the abundance of bare ground and shrub cover were observed. The Lower Grassland map unit denotes areas characterized by minor amounts of Yucca glauca cover and greater than 10% bare ground. The Upper Grassland map unit is delineated by the topographically higher sand bluffs along the perimeter of the site with at least 10% of Yucca glauca cover and minor amounts of bare ground. The locations of the Upper and Lower Grasslands are shown on Figures C-Cl and C -C2. Other portions of the site were developed with oil and gas operations infrastructure without appreciable amounts of vegetation. Examination of reasonably available historical aerial photographs show that the area is stable, with little visible change over the last 15 years. The abundance of overall ground cover appears to be variable during different years and seasons. The breakdown of the total acreage by vegetation type across the pre -mining area is: 1. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 5. Upon permit issuance and prior to beginning on -site mining activity, you must post a sign at the entrance of the mine site, which shall be clearly visible from the access road, with the following information (Rule 3.1.12): 0 � w so a. the name of the operator, b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. 7. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Construction Material Rules and Regulations in effect at the time the permit is issued. 9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date (if there are changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example, a permit with the anniversary date of July 1, 1995, the annual fee is for the period of July 1, 1994 through June 30, 1995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty.
