WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Robert J. Rotthaus, Eugene W. Freeman, and
Henry F. Markus, Greeley, Colorado, and more particularly de-
scribed as follows:
•
Part of the Southeast Quarter (SE3) of Section 30 lying
South and West of the County Road as now laid out,
Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly de-
scribed as follows:
Beginning at the Southeast Corner (SE Cor) of said
Section 30 and considering the East line of the South-
east Quarter (SE4) of said Section 30, as bearing
North 00°00'00" West, with all other bearings con-
tained herein being relative thereto;
Thence North 00°00'00" West, along said East Line,
1324. 56 feet;
Thence South 86°41'55" West, 60. 10 feet to the True
Point of Beginning and the West ROW Line of the
existing County Road;
Thence along the South and West ROW of the existing
County Road as now laid out by the following nine (9)
bearings and distances:
North 00°00'00" West, 728. 83 feet;
North 27°47'00" West, 39.48 feet;
North 42°01'49" West, 230. 69 feet;
North 49°29'05" West, 251. 65 feet;

Said described parcel of land, containing 81. 462 acres,
more or less, and
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of

Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Robert J. Rotthaus, Eugene W. Freeman,
and Henry F. Markus, Greeley, Colorado, be exempted from the defini-
tion of the terms "subdivision" and "subdivided lands" as provided for in
the new Weld County Subdivision Regulations at Section 2-1A. , (3) adopted
August 30, 1972.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30thday of April, A. D.,
1975.

Dear Sirs:
The attached plat and other items are in reference to an application by
Robert J. Rotthaus, Eugene W. Freeman and Henry F. Markus for a Recorded
Exemption. The parcel in question has a total of 81 .462 irrigated acres.
This parcel will be split into lots of 1 .851± acres and 79.611± acres.
Based upon information submitted and the Weld County regulations, the
Planning staff recommends approval for the following reasons:
1 . The proposed land split is in compliance with the Weld County
Comprehensive Plan in that it promotes agricultural use of the
land.
2. The proposed land split complies with the intent clause,
Section 9-2 of the Weld County Subdivision Regulations in that
non-productive agricultural lands are being utilized.
All requirements for Recorded Exemption have been met.

as long as the meter is set within property adjacent to its existing water line.
