RESOLUTION
•
IMPROVEMENT DISTRICT NO. 1-77 •
WHEREAS, on January 4, 1977 , a Street Improvement
District petition was presented to the Board of Trustees of the
Town of Johnstown, Colorado, which met the requirements of the
law as provided, and •
WHEREAS, said petition requested the improvement of streets,
to-wit : paving, curb and gutter , as follows: East Charlotte
from Parish to 9ngove.. , Angove to East South First Place; and
all of East South First Place , except Lots 10 and 11 in Block 4,
and Lots 14 and 15 in Block 5 , Town of Johnstown; and
Angove Avenue from South First Place to the Highway, all in the •
Town of Johnstown , Colorado, and
WHEREAS, the petition having met the requirements .of law,
NOW, THEREFORE, BE IT RESOLVED That Improvement District No.
1-77 shall consist of East Charlotte from Parish to Angov ; •
Angove to East South First Place; and all of East South First
Place, except Lots 10 and 11 in Block 4 , and Lots . , . , 14 and
15 in Block 5 , Town of Johnstown; and Angove Avenue from South
First Place to the Highway , all in the Town of Johnstown , Colo-
rado; and '
FURTHER, that the Town attorney draft a Resolution setting
forth the preliminary order and notice for creating said improve-
ment district and have said ordinance ready for first reading on
or before April 4 , 1977.
PASSED AND ADOPTED this 1414 day of March, 1977.

PRELIMINARY ORDER
RESOLUTION
IMPROVEMENT DISTRICT NO. 1-77
WHEREAS, on January 4, 1977 , a street improvement petition
was presented to the Board of Trustees of the Town of Johnstown,
Colorado, which requested the improvement of streets with paving,
I • curb and gutter based on the specifications of the Board of
Trustees of the Town of Johnstown , Colorado , and
WHEREAS, after carefuly study by the Board of Trustees of
the Town of Johnstown, Colorado, and following an informal meet-
ing of all property owners involved on January 10 , 1977, at 7 :30
P.M. in the Town Hall , and

WHEREAS, as a result of this informal meeting , the Board of
Trustees was encouraged to proceed with the formation of Improve-
ment District No. 1-77 , and
WHEREAS, it was determined that from the signed
e s gned petition and
filed with the Town Clerk of the Town of Johnstown, Colorado,
more than fifty percent (50%) of the frontage involved favored
the district and that more than fifty percent (50%) of the owners
involved favored the district , and •
WHEREAS, the details and specifications shall be in conformity
with rules and regulations of the Town of Johnstown, Colorado, pre-
viously adopted for improvement districts within the Town of
Johnstown , Colorado, and
•WHEREAS, the improvement district shall be paid over ten (10)
equal annual installments plus 514 _% interest and the payments
shall begin' on January 1st of the year following completion of the
improvement ; that is , if the assessing ordinance is issued in the
• year 1977 , the payments and interest shall begin January 1 , 1978 ,
and
it
•
WHEREAS, the district shall encompass the property adjacent
• to Fast Charlotte from Parish to Angrove; Angrove to East South
First Place: All of East South First Place, except Lots 10 and 11
in Block 4 and Lots 14 and 15 in Block 5 , Town of Johns-
town; and 'Angove Avenue from South First Place to the Highway,
all in the Town of Johnstown, Colorado, and
WHEREAS, the Freese Engineering has determined the estimated
cost to be $ 34,164_78 , and
WHEREAS, a map of the district is now on file with the Town
Clerk of Johnstown , Colorado , and
WHEREAS, a schedule showing approximate amounts to be.
assessed upon the several lots or parcels of property within the
district is on file with the Town Clerk of Johnstown, Colorado, and
WHEREAS, no contracts will be let for any amounts exceeding
the estimate so made, except that costs of collection, inspection,
incidentals and interest may be added thereto.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. All of the above recitals are incorporated into this
Resolution as though said recitals were set forth here in full.
2. This Resolution constitutes the preliminary order that is
required by Colorado law.
3 . The proper notice now be prepared and published concern-
ing the forming of Improvement District No. 1-77.

IMPROVEMENT DISTRICT NO. 1-77
AN ORDINANCE CONCERNING THE IMPROVEMENTS OF STREETS IN THE
TOWN OF JOHNSTOWN, COLORADO, SPECIFICALLY EAST CHARLOTTE
FROM PARISH TO ANGROVE; ANGROVE TO EAST SOUTH FIRST PLACE;
ALL OF EAST SOUTH FIRST PLACE; EXCEPT LOTS 10 AND 11 IN
BLOCK 4 AND LOTS 12 , 13 , 14 AND 15 IN BLOCK 5 , TOWN OF
JOHNSTOWN; AND ANGIOVE AVENUE FROM SOUTH FIRST PLACE TO
THE HIGHWAY; ALL IN THE TOWN OF JOHNSTOWN, COLORADO, WITH
PAVING, CURB AND GUTTER AS SPECIFIED BY RESOLUTION HERETO-
FORE PASSED BY THE BOARD OF TRUSTEES OF THE TOWN OF JOHNS-
TOWN, COLORADO, ON MARCH 7, 1977 , AND CREATING AN IMPROVE-
MENT DISTRICT, ORDERING THAT SAID IMPROVEMENTS BE MADE BY
THE TOWN OF JOHNSTOWN, COLORADO, AND ASSESS THE COSTS THERE-
OF, AND CERTIFY AND COLLECT THE SAME AS BY LAW PROVIDED.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF JOHHNSTOWN,
COLORADO:
Section 1 . That all of that portion of Fast Charlotte from
Parish to Angtove; Angtove to East South First Place; all of Fast
South First Place, except Lots 10 and 11 in Block 4 and Lots 1A,
VI , 14 and 15 in Block 5 , Town of Johnstown, Colorado, and Angtove
Avenue from South First Place to the Highway, all in the Town of
Johnstown, Colorado, is hereby ordered to be improved by the own-
ers of the frontage of land and lots adjacent to and abutting on
said portion of said streets and avenues by improving and repair-
ing the same with paving , curb and gutter , all the foregoing im-
provements to be made and constructed and the same be done and
assessed the costs thereof against the adjacent property and the
owner or owners thereof .
Section 2. That all of said portion of said paving , curb
and gutter as herein described is ordered to be improved as
above specified and according to the specifications of said Town
of Johnstown, Colorado , in accordance with the established grades '

and in conformance with the specifications thereof ; and that the
costs of the paving, curb and gutter , exclusive of incidentals
expenses , based upon ten (10) year payment plan, is estimated
at $ 34 ,164.28,* or $ 16.00 per front foot , together with inter-

est at the rate of five and/percent (54%) per annum from date con-
struction is completed. The necessary incidental expenses shall
include advertising , abstracting , postage , legal fees , engineer-
ing fees and collection costs , together with interest as provided
above until certified to the County Treasurer for collection, and
interest thereafter in accordance with the laws in such cases made
and provided.
• The costs of said above described improvements shall be
assessed against the adjacent and abutting lands and lots, and
the owners thereof , in accordance with the benefits derivedtereby
as the same may be determined under the provisions of the 'prdi-
nances for the Town of Johnstown, Colorado, and the laws of the
state of Colorado applicable thereto.
Section 3. That the portion of said paving , curb and gutter
along said streets and avenues herein described and lands and lots
adjacent thereto and abutting thereon is hereby designated as
"Improvement District No. 1-77. "
Section 4. That the portion of said paving , curb and gutter
included in "Improvement District No. 1-77" are owned by the fol-

Section 5. That the costs of said improvements shall be paid
in the first instance by Town warrants drawn upon funds hereby
created and designated in "Improvement District No. 1-77 Fund" and
all moneys derived from the assessments thereunder shall be used
to redeem warrants drawn upon said fund and for no other purpose.
Section 6. That the funds shall be initially raised by
forming a bond district and said district shall be bonded for the
•
expenses of this improvement district and the costs of this bond-
ing shall be assessed against the district .
Section 7 . That the proper notice as required by state
statute has been given for the formation of the "Improvement Dis-
trict No. 1-77. "
Section 8. That the petition asking for the formation of
this district was subscribed by the required number of owners of
property as well as the required amount of footage within the
boundaries and adjacent to this "Improvement District No. 1-77. "
Section 9 . It is hereby declared that this ordinance is
necessary for the immediate preservation of the public peace ,
health and safety , and that this ordinance shall take effect ten
(10) days after its final publication.
