RESOLUTION NO. 18-R-50 A RESOLUTION OF INTENT TO ANNEX CERTAIN PROPERTIES IN WELD COUNTY, COLORADO TO THE TOWN OF FREDERICK, SAID ANNEXATION TO BE KNOWN AS THE "GORACKE ANNEXATION" WHEREAS, a petition for annexation of certain properties has been filed with the Board of Trustees of the Town of Frederick and The Goracke Living Trust, 2105 Baguette Drive, Castle Rock, Colorado, 80108; and WHEREAS, the Board of Trustees has reviewed the petition; and WHEREAS, the Board of Trustees wishes to permit consideration of the property for annexation and zoning, as requested in the petition; and WHEREAS, the Board of Trustees has reviewed the petition and desires to adopt by Resolution its findings in regard to the petition; BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK, COLORADO, AS FOLLOWS: Section Y. The petition, whose legal description is attached hereto as Exhibit A and incorporated by reference herein, is in substantial compliance with the applicable laws of the State of Colorado. . Section 2. No, election is required under C.R.S. §31-12-107(2). Section 3. for in the petition. Section 4.. The Board of Trustees will hold a public hearing for the purpose of determining if the proposed annexation complies with C.R.S. §31-12-104, and with C.R.S.: §31-12- 105, and will hold a public hearing to determine the appropriate zoning of the subject property as requested in thepetition, at the Frederick Town Hall, 401 Locust, Frederick, Colorado 80530, at the following time arid date: 7:00 P.M., July 10, 2018 No additional terms and conditions are to be imposed except those provided Section 5. Vol. The exhibits contain maps:showing the present and proposed boundaries of the Town of Frederick; the existing public improvements, and the existing and proposed land use patterns in the area to be annexed. I.:. Project. Description — Goracke Annexation The property proposed for annexation. has a total of 5:218 'acres. The Goracke property is generally located north of WCR 16/Tipple Parkway, approximately 1/10. of a mile'east of Silver Birch Boulevard:. The land proposed to be annexed: is owned by the David and Lori Goracke Living Trust. The. pro ert owner has relayed to staff that they would like to construct a sin le family house on p. p Y.. . Y... ... g Y ... the property following the annexation. Currently the property has the zoning designation of "A", Agricultural, by Weld County. In conjunction with the proposed annexation, the:zoning is proposed to change to "R-1", Residential Low Density District in conformance with the Town's Land Use Code. *Adjacent land uses include agriculture; residential low density, and rural residences on:large lots. An annexation agreement will be finalized prior to the public hearing. II. Municipal Services Municipal services for the Goracke Annexations will be provided in the following manner:: • Electricity Electric services couldbe provided by either the Town; of Frederick or United Power. There are existing underground electrical lines that run directly adjacent to the property. • Telephone Telephone services are able to be provided as desired by the developer. Land lines are available from CenturyLink. 1'Page • Water • Sanitary Sewer Water service is available to be served by the Town of Frederick. Existing water lines are near the property but will, have to be extended to the property once developed. Sanitary sewer service is more than 2000' from the property line. If sewer services is extended to within 400' of the property line prior to development then connect to sewer will be required. • Fire The property is currently served by the Frederick -Firestone Fire Protection Department and will maintain the same. • Police Police service will be provided by the Town of Frederick Police Department. Street Maintenance Maintenance of public roadways within the annexation will be provided by the Town. III. Method of Financing the Extension of the Municipal Services The Town of Frederick is not obligated to provide municipal services that require a physical extension of facilities such as water line, sewer lines, or road construction. Either these types of services are provided by separate agreement with a special district or are services that are funded through mill levies associated with the property taxes generated by developed lots. IV. Special Districts The area to be annexed is included within the following special districts: • Carbon Valley Recreation District • St. Vrain Valley School District RE1-J 2IPage V s Northern Colorado Water Conservancy District • Longmont Conservation District ✓ Frederick -Firestone Fire Protection Department • High Plains Library District V. The property is approximately 5.432 acres in size and is proposed to be zoned Residential Low Density (R-1) by the Town of Frederick. I intend on developing a one single family detached dwelling unit on the property once it is annexation into the Town. The property is currently vacant land and is zoned agricultural by Weld County. David Goracke Goracke Annexation Review Criteria Analysis Annexation Review Criteria Analysis 1. The proposed annexation is consistent with the policies and goals of the Town's adopted Comprehensive Plan; Staff Comment: The proposed annexation and zoning assignment is consistent with the 2015 Comprehensive Plan. The land use designation for the property is Single Family Detached which directly correlates to the proposal. 2. The proposed annexation promotes geographical balance of the Town's land use pattern; Staff Comment: The 2015 Comprehensive Plan identifies the intended future land use of the property to be Single Family Detached which not creates a geographic balance between the various land uses within in the community as identified in the 2015 Comprehensive Plan 3. Adequate services are, or will be, available to support the development expected to result from the proposed annexation; Staff Comment: Existing electric and water lines run directly adjacent or near to the property which could support any future development of the property. If sewer is extended to within 400' of the property prior to the development of the single family home then the home will be required to connect. 4. The proposed annexation provides for a continual and rational boundary; and Staff Comment: The boundaries of the proposed annexation are entirely within the Town of Frederick's Planning Area and are contiguous on two sides with the existing Town boundaries. 5. The proposed annexation is needed to accommodate future land use requirements. Staff Comment: The 2015 Comprehensive Plan identifies the property in the Future Land Use Map as Single Family Detached. Other: 3. 14 Step 6: Staff and Referral Agency Review Period Once an application is submitted, Town staff will perform a "sufficiency review" during which time they take inventory of the contents of the application and ensure that all components have been submitted. Staff may take up to a week to perform this review. At the end of the sufficiency review, staff will make the applicant aware if components of the application are missing or are incomplete. Otherwise, the application can proceed directly to the review process. Town Staff and outside referral agencies have 21 days to review the application, plus 7 days for processing for a total of approximately 4 weeks before initial comments will be available to the applicant. Once the review period has elapsed, staff will compile a "development review committee report" which contains all comments submitted by reviewing agencies. When complete, staff will email the report to the applicant, project manager or other appropriate contact person. After staff submits the report, it is incumbent upon the applicant to make the requisite changes to the plans or other documents, or provide information that may be missing. Staff is available by email, phone or in -person to discuss the comments and help the applicant work through project issues. After the required changes have been made, the applicant must re -submit the plans or other information to staff for another review. Depending upon the nature of the changes, revised plans may be re -submitted via email for review prior to public hearings (major and minor applications). However, it is possible that re -submittal of full plan sets may be required if revisions are significant. The following are some tips from staff on how to get through this process as quickly and efficiently as possible: • Respond to review comments as quickly as possible. Delayed response to comments is one of the biggest issues that delays projects. Remember, that staff still has to review the resubmittal, and that can take time; • Communicate with staff. If your response to staff comments is going to take more time than you anticipated, let us know. There are times that we don't hear from applicants for extended periods of time. We need to know what your intentions are in order to keep things on track; • Plan ahead and be patient. We are willing to move as quickly as possible in order to reduce processing time, but we may need two or three weeks for subsequent reviews.
