A public hearing was conducted on March 7, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro -Tern Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Clerk to the Board, Esther Gesick Planning Services Department representative, Kim Ogle The following business was transacted: la I hereby certify that pursuant to a notice dated January 31, 2018, and duly published February 5, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Pioneer Land Company, LLC, do Northern Colorado Constructors, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR17-0072, for Mineral Resource Development Facilities, including Open Pit Mining (sand, gravel and stone) and Materials Processing in the A (Agricultural) Zone District. Commissioner Kirkmeyer made this a matter of record. • Kim Ogle, Department of Planning Services, presented a brief summary of the reason for deferring the application indefinitely to the Department of Planning Services to allow staff to assist the applicant in complications that have arisen related to easement procurement. • J.C. York, J -T Consulting, represented the applicant and stated the applicant is working with the Department of Public Works concerning access issues. He clarified that once that is resolved, they will proceed with the public hearing process. U. Bradley Windell, surrounding property owner, stated his residence is located on an 1863 historic farm with water rights, which is located adjacent to the subject site. He stated the farm is now surrounded by gravel mines and oil and gas operations. He expressed concern with potential health impacts as related to the proposed use. Chair Moreno clarified this matter is being referred back to the Department of Planning Services to allow additional time for the applicant and staff to review certain issues. If the issues are addressed, then staff will re -notice the future hearing dates. (USR17-0072) PAGE 2 Commissioner Cozad moved to defer the request of Pioneer Land Company, LLC, do Northern Constructors, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR17-0072, for Mineral Resource Development Facilities, including Open Pit Mining (sand, gravel and stone) and Materials Processing in the A (Agricultural) Zone District, to the Department of Planning Services for further consideration prior to presenting to Planning Commission and/or the Board of County Commissioners, based on the recommendations of Planning staff. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:12 a.m. This Certification was approved on the 12th day of March, 2018.
