HomeMy WebLinkAbout20183747.tiffRESOLUTION RE: APPROVE ACCEPTANCE OF ASSIGNMENT FOR PURCHASE OF PROPERTY AND AGREEMENT TO AMEND/EXTEND CONTRACT AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - DAVID AND LINDA SPAHN/GREAT NORTHERN PROPERTIES, LLLP/JOHN WHEELER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a request to accept the Assignment for Purchase of Property and Agreement to Amend/Extend Contract between the David and Linda Spahn ("Seller") and Great Northern Properties, LLLP ("Buyer"), with further terms and conditions being as stated in said assignment; said property being described as follows: Lot B of Amended Recorded Exemption, AMDRE- 3776, being part of the NE1/4 of Section 13, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado; being further described as Parcel #120713100090, Account #R3523605, Vacant Land consisting of approximately 14.7 acres (640,332 square feet), and WHEREAS, the Board had authorized county staff to locate a site to purchase for a future Public Works facility, and WHEREAS, an acceptable site has been located and is under contract for purchase with Great Northern Properties, LLLP, and WHEREAS, Great Northern Properties, LLLP, is willing to assign said purchase contract to Weld County, and WHEREAS, after review, the Board deems it advisable to approve said Agreement to Amend/Extend Contract, a copy of which is attached hereto and incorporated herein by reference, and accept the assignment of said property as described herein. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Assignment for Purchase of Property and Agreement to Amend/Extend Contract between the David and Linda Spahn ("Seller") and Great Northern Properties, LLLP be, and hereby is, approved and accepted.
