Weld County Public Works, Planning Services and the County Attorney's Office have reviewed the above - mentioned signed original document and observed the following: The Department of Public Works and the Department of Planning Services received a request from Leeward Renewable Energy, LLC, requesting that the Board of County Commissioners consider accepting collateral in the form of a company check (Union Bank #145000598) in the amount of $15,000.00, for the above -mentioned agreement. What options exist for the Board? 1. Have this BOCC Hearing item be placed on the next available agenda as part of the Consent Agenda. 2. Have this BOCC Hearing item be placed on the next available agenda as part of the Regular Agenda. Recommendation: Option 1. The Departments of Public Works, Planning Services and the County Attorney's Office are recommending approval of the agreement and collateral, and that this item be placed on the next regularly scheduled BOCC Hearing, as part of the Consent Agenda. Regards, Chris AGREEMENT FOR PLACEMENT OF TEMPORARY WIND MONITORING TOWERS THIS AGREEMENT ("Agreement") is made and entered into this i7 day of , 2018, by and through the County of Weld, State of Colorado, acting through its Board oCounty Commissioners ("County") and Leeward Renewable Energy Development, LLC ("Leeward Renewable Energy"), whose address is stated in the attached letter designated as Exhibit "A." WITNESSETH WHEREAS, Leeward Renewable Energy, LLC, by letter, dated January 2, 2018, requesting approval for the placement of three (3) wind monitoring towers ("Towers") to be used temporarily to determine whether the site is feasible for the placement of a utility -scale wind power project in Weld County, on real estate being more particularly described as: The W1/2 of Section 25, Township 12 North, Range 60, The S1/2 of Section 21, Township 12 North, Range 59 and the NE1/4 of Section 4, Township 11 North, Range 59, all located West of the 6th P.M., Weld County, Colorado ("the Properties"), said letter providing more information, and WHEREAS, Leeward Renewable Energy, in its letter of Exhibit A, has provided adequate proof and justification for the temporary placement of said wind monitoring towers in accordance with the terms and conditions of this Agreement, and WHEREAS, County consents to such temporary placement of three (3) wind monitoring towers on the properties described above in accordance with the terms and conditions set forth herein. NOW, THEREFORE, in consideration of the foregoing and the acceptance and approval of the following conditions, County and Leeward Renewable Energy agree as follows: 1. The above recitals are incorporated herein by reference. 2. Leeward Renewable Energy shall submit to County a final and complete USR application, when and if Leeward Renewable Energy decides to place wind turbines on the properties permanently. 3. Leeward Renewable Energy shall provide to Weld County a performance guarantee cash deposit in the amount of Fifteen Thousand and 00/100 ($15,000.00) ("Guarantee Deposit"). 4. Said Guarantee Deposit shall be held by the County pending final resolution and determination of a USR application or removal of the Towers. 5. In the event the USR is not approved, or at the end of three (3) years after signature hereunder, whichever is later, Leeward Renewable Energy shall have six (6) months thereafter to dismantle the Towers and return the Properties to its existing condition, and within thirty (30) days of the completion of this dismantling the Guarantee Deposit shall be returned by County to Leeward Renewable Energy. 7. Please accept this letter as my official request to proceed with the installation of three temporary meteorological towers to measure the wind in our area of interest. The Meteorological towers will be kept in place for approximately two years and will measure the wind concurrently with our company applying for a USR to build the Mountain Breeze Wind Farm. The three locations identified by our meteorologist and authorized by the landowners under our long-term lease agreement are as follows; 1. Brian and Andrea Kinnison - Located in the NW 1/4 of Section 25, Township 12, Range 60. 2. Glen Klawonn - Located in the SE 1/4 of Section 21, Township 12N, Range 59. 3. O&M Harms, LLC - Located in the NE 1/4 of Section 4, Township 11, Range 59. The precise location can be supplied prior to installation or post installation if required. The tower itself is a 60meter single -pole structure with guy wires affixed at six levels on four sides. It can be installed in as little time as a single day. It is anticipated that all three towers will be installed within one week. The towers are temporary structures that are currently planned to be in place for 2 years. The tower is designed to withstand winds of up to 90 miles per hour at 40 meters above ground level. Attached are the technical drawings of the tower. I have also included topographic drawings of the three locations with this application.
