WHEREAS, a public hearing was held on July 7 , 1976 ,
in the chambers of the Board of County Commissioners , Weld
County, Colorado, for the purpose of hearing the petition of
Amoco Production Company, Denver, Colorado, requesting a
change of zone from "E" (Estate District) to A-UD (Agricultural
Unit Development) , and
WHEREAS, the petitioner was present, being represented
by Mr. John Lang and its counsel, Mr. Lou Gaskins, and
WHEREAS, the Board of County Commissioners heard all
the testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request of the petitioner and studied the recommendations
of the Weld County Planning Commission as submitted, and having
been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Amoco Production Company,
Denver, Colorado, for change of zone from "E" (Estate District)
to A-UD (Agricultural Unit Development) , said area being more
particularly described as follows:
A tract of land located in that part of the Wi of the
SEa of Section 6 , Township 1 North, Range 66 West of
the 6th P.M. , being more particularly described as
follows:
Commencing at the Northeast corner of the W1 of the
SEa of Section 6, Township 1 North, Range 66 West of
the 6th P.M. ; thence South 00°17 ' 20" East, 560 . 00 feet
on an assumed bearing along the East line of the WI of
the SEa of said Section 6, thence South 88°33 ' 00" West,
15 . 00 feet parallel with the North line of the 141/2 of
the SEa of said Section 6 to the Northeasterly corner of
the Grandview Addition to Weld County as described at
Reception No. 1536603 of the Weld County Public Records;
thence South 00°17 ' 20" East, 308 . 00 feet along the most
Easterly line of the Grandview Addition to the Southeast
corner of said subdivision; thence South 80°46' 10" West,
635. 00 feet along the South line of the Grandview
Addition to the Southwest corner of said subdivision;
thence South 54°11 ' 36" West, 93. 12 feet to the True Point
of Beginning.
Thence South 27°36 ' 13" East, 766. 94 feet parallel to the
Easterly line of that tract of land as described in
Book 1523 on Page 563 of the Weld County Public Records;
Thence West, 460 . 93 feet;
Thence North 06°15 ' 00" West, 683 . 70 feet parallel to the
East right-of-way of U.S. Highway No. 85 as described in
Book 1406 on Page 294 of the Weld County Public Records;
Thence East, 180. 00 feet to the True Point of Beginning,
containing 5. 000 acres, more or less,
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be
installed shall be approved by the State Health Department.
2 . All applicable subdivision regulations and zoning
regulations shall be fol]naed and complied with in accordance
with the zoning resolutions of Weld County, Colorado.

3 . That said change of zone is granted herein on
condition that petitioner submit emended plans for such develop-
ment for the approval of the Weld County Planning Commission
and subsequent recording of said plans in the office of the
County Clerk and Recorder of Weld County, Colorado; otherwise
the County may take action to rezone the property to its
present classification.

I hereby certify that pursuant to a notice dated June 2 ,
1976, duly published June 4 , 1976 and June 25, 1976 in
the Greeley Booster, a public hearing was held on a re-
quest by Amoco Production Company for a Change of Zone,
E to A-UD, at the time and place so specified. Four
Commissioners were present (Commissioner Carlson was
absent) constituting a quorum. Following discussion,
Commissioner Moser made a motion to grant the request.
The motion was seconded by Commissioner Jacobucci and
it carried unanimously.

In accordance with the request made in your letter of April 22, 1976,
and in support of Amoco's request for an AUD on a 5 acre tract in the
W/2, SE/4, Section 6, T1N, R66W, I am attaching hereto the following
items:
1. USGS Map of Flood Prone Areas
2. Surveyor's plat indicating the ground elevation
and location of our proposed well.
As additional information, and in response to your question in this
regard, I wish to advise that the NE corner of our tank battery site
(shown on our AUD plan) will be 1580' FSL and 2060' FEL of Section 6,
T1N, R66W. The ground elevation of our tank battery will be the same
as shown for the well site (4895') . The USGS map shows the maximum
flood level in this area to be approximately 4900' . In order to flood-
proof our tank battery site, we plan to install a minimum of 2' of
compacted earth below our tanks and production unit and to anchor our
tanks by cementing 41 " OD oil well casing 4' into undisturbed earth in
10" diameter holes, then weld the casing to the tank. Our production
unit skid base is about 3' in width and 13' in length. We will place
a concrete block foundation 12" in thickness and 2' wider and 2' longer
than the skid base and anchor the vessel to this concrete block. We
believe these precautions will provide adequate protection for any
possible flooding.

TO PETITIONERS FOR CHANGE OF ZONING
WELD COUNTY, COLORADO
Answers to the following questions must be submitted in writing with
your petition requesting a change of zoning. It is necessary that the
planning commission have these answers to act on your petition.
Q. 1. Is it impractical, impossible, or undesirable to develop the
land according to its current zoning classification.
A. Yes. Present zoning is estate and no oil and gas operations can
be conducted on the land in this zoning category.
Q. 2. Would the proposed rezoning benefit the entire County by allowing
a typical development which is needed and cannot locate in other parts
of the County.
A. Yes. This area is producing oil and gas. This product is necessary
for public use and it will increase the basis of County revenue. This
land is restricted in its use due to it being in a flood plain.
Q. 3. Would the proposed rezoning benefit lands adjoining the area
requesting the change.
A. Yes. It would provide added tax and resource benefits to the entire
community.
Q. 4. What features apply to the property requesting rezoning which make
it logical to rezone this tract and not to rezone in a similar manner
surrounding properties which may have like land use characteristics.
A. The land is in a flood plain and its use is restricted. Rezoning
will allow this tract to be used in a more beneficial manner.
Q. 5. Why are other areas in the County already zoned according to the
requested classification, unsuitable for the development which is proposed.
A. The spacing regulations of the Colorado Oil and Gas Conservation
Commission allow the spacing for gas wells of 320.00 acre. This location
will afford the most suitable location for a well site in the unit to include
the town of Fort Lupton, Colorado.
Q. 6. What proof of evidence is available that the original rezoning is
faulty or that changing conditions in the area justify rezoning at this time.
A. This area is now productive of oil and gas and the existing estate zoning
does not allow oil and gas operations.
Q. 7. Please submit Economic or other evidence that the area covered by the
petition, needs additional Commercial or Business in the area. (To be
answered on changes requested for Business or Commercial) .

Q. 8. Give some evidence of the proposed business or commercial enterprises

such Agricultural Unit Developments. These factors include, but are not

A. Yes. After drilling operations are completed, there will be only a
minimum amount of activity at the well site..
Q. 2. Harmony with the character of the neighborhood.
A. At edge of Fort Lupton city limits, next to a U. S. Highway.
Q. 3. Need for the proposed development.
A. Area is productive of oil and gas. This location will be in the
spacing pattern as set by the Colorado Oil and Gas Conservation Commission.
Q. 4. The affect of the proposed Agricultural Unit Development upon the
future development of the area.
A. Will use the well site to a fuller degree and can extend resource
and economic benefit to area.
Q. 5. The affect of the proposed Agricultural Unit Development upon
the future development of the area.
A. This area is in a flood plain and it cannot be used for more than its
present use without a lot of fill work being done. The operation in this
area can provide economic activities in this area.
Q. 6. Whether or not an exception from the zoning resolution requirements
and limitations is warranted by virtue of the design and amenities incorpor-
ated in the development plan.
A. The oil and gas operations will take up a part of the surface area only.
Q. 7. That land surrounding the proposed Agricultural Unit Development can
be planned in coordination with the proposed Agricultural Unit Development.
A. Adjoining land is highway and subdivision of Fort Lupton, Colorado.
Q. 8. That the proposed change to Agricultural Unit Development district
is in conformance with the general intent of the comprehensive master plan.
A. This change will allow this tract to be more fully utilized.
Q. 9. That the existing and proposed streets are suitable and adequate to
carry anticipated traffic within the proposed district and in the vicinity
of the proposed district.
A. This operation will have no major impact in the area, after operations
have been completed, traffic will be minimal.

The Ft. Lupton Planning Commission met in regular session 5/13/76
at which time the zoning change request from Amoco Production Co.
was reconsidered. As a result, the Commission approved, by motion,
to allow the zoning request and use the access route as shown on
your map. However, Amoco Production Company must repair any damages
resulting from the operation and all complaints must be corrected
immediately.
The Planning Commission also suggested locating the well as close
to Highway 85 as permissable.
