RE: APPROVE ADOPTION OF WELD COUNTY ROAD 29 ACCESS CONTROL PLAN
WHEREAS, the Board of County. Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 8, 2018, the Board was presented with a proposed Weld County
Road 29 Access Control Plan, on behalf of the Department of Public Works, and
WHEREAS, after hearing testimony, the Board deemed it necessary to continue this
matter, to allow adequate time to hold another public meeting and invite the Mayors and Town
Managers to assist with clarifying the plan.
WHEREAS, after review, the Board deems it advisable to adopt said plan, a copy of which
is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Road 29 Access Control Plan be, and hereby is, adopted.
The above and foregoing Resolution was, on motion duly made.and seconded, adopted
by the following vote on the 26th day of February, A.D., 2018.

SUBJECT: Resolution Adopting Weld County Road 29 Access
Control Plan
At its regular Board meeting on January 8, 2018, the Board of County Commissioners voted to
continue this item to February 26, 2018, in order to schedule two public meetings and answer
questions from the public regarding the Weld County Road 29 Access Control Plan. Those meetings
were held January 29, 2018, from 6:00 to 7:30 p.m. at the Weld County Administration Building and
February 12, 2018, from 6:00 to 7:30 p.m. at the Nunn Town Hall. Newsletter emails were sent out
to those who signed up for them and notice was posted on the WCR 29 ACP webpage. The first
newsletter announcing the meeting dates also included some potential "frequently asked questions."
Each meeting was attended by at least 35 people. Staff also met with land owners at the Public Works
building and answered questions on the telephone.
Most questions were in regards to the functional classification of the road and plans for improvements,
though there were also a few suggested changes to the ACP, described below. Naturally, land owners'
main concern regarding the ACP is the effect it could have on their existing accesses. Appendix A
makes recommendations regarding how existing Accesses with Safety Concerns could be modified
to meet spacing and sight disctance criteria. In many cases, the most viable option would be to
consolidate accesses, which could require accesses on adjacent properties to be relocated to the
common property line and shared between the two property owners. However, Appendix A also
states: "These recommendations are not intended to be a definitive set of instructions, but to guide
developers, land owners, staff, and elected officials when development or road improvements are
proposed or contemplated."
Further, the Access with Safety Concern Policy on page 57 of the ACP states: "Accesses with Safety
Concern, indicated on the maps in the Plan, shall be eliminated, relocated, consolidated, or movement
converted (e.g., restricted to right-in/right-out) as soon as feasible, when development occurs, with
change of use, or when the road is widened, whichever occurs sooner." The inclusion of the phrase
"when the road is widened" has been mentioned by several people as concerning. Therefore, staff
recommends revising this policy to add "if' after "when" and add a clarifying paragraph. The new
policy would read as follows:
Accesses with Safety Concern (ASCs), indicated on the maps in the Plan, shall be
eliminated, relocated, consolidated, or movement converted (e.g., restricted to right-
in/right-out) as soon as feasible, when development occurs, with change of use, or when/if
the road is widened, whichever occurs sooner.

For the purpose of this policy, "widened" shall mean when/if additional right-of-way is
acquired along WCR 29. Prior to beginning the process of acquiring right-of-way, the
recommendations in Appendix A should be reviewed, and where the recommendations are
deemed feasible, the agency acquiring the right-of-way should discuss addressing ASCs
with property owners as part of the right-of-way acquisition process. The intent of this
policy is not to force accesses that existed on separate parcels prior to adoption of the ACP
to be shared. When it is deemed unfeasible to eliminate, relocate, or consolidate ASCs, the
agency should consider options for restricting turning movements through installation of
medians, for example. The goal should be improving safety on the corridor by reducing the
number of ASCs while realizing it may not be possible to address every one. Accesses very
close to intersections and those most feasible to address should take priority.
Based on discussions with property owners specific to their accesses, staff proposes the following
additional revisions to the ACP:
1. Rebecca and Lee Seward asked us to clarify in Appendix A for their access (E-42) that they
own the landlocked parcel behind their RE lot as well. Here is the orginal language: "Gated.
13.36 -acre lot. Access shown as proposed on RE -3734 in 2004. Original RE in 1973. 2008
house." Staff proposes revising it to the following: "

(2004). The approximately 35 -acre parcel to the east is under the same ownership and uses C-
42. Original RE in 1973. 2008 house.

2. Kyle Gilbert pointed out that he has three accesses on his property in Nunn. The third access
(C -106a) was added to the map as Agricultural and the north access was changed from
Residential to Agricultural. Mr. Gilbert indicated that was agreeable.

The following revisions are also proposed, based on changes that have occurred since the maps and
spreadsheets were prepared:
1. E-97 should be revised from Future to Residential since a building permit has been issued for
this property. The access permit was issued before the Functional Classification Map was
updated and met spacing criteria at that time, but no longer does. Therefore, it and E-96 need
to be shown as ASCs due to spacing.
2. E-98 and E-100 should be revised from Future to Residential since building permits have been
issued. These accesses meet current spacing criteria.
3. W-70 and W-71 previously stated they were part of an RE that had not yet been recorded.
Since the RE has now been recorded, that language will be removed in the spreadsheet.

As mentioned earlier, many of the questions and comments at the meetings recently held were about
the Functional Classification Map and the county's plans for improvements to WCR 29, so a couple
of points may be worth reiterating here. The Functional Classification Map was updated in May of
2017 and changed WCR 29 north of Highway 392 to an arterial road classification. However, it was
modified from the standard right-of-way width for arterials, which is 140 feet, to 100 feet, except
north and south of major intersections for turn lanes. The ultimate future cross section shown in the
ACP is for a two-lane paved road with 8 -foot paved shoulders and 2 -foot gravel shoulders within the
100 feet. (See graphic at the end of this memo.) Major intersections would have turn lanes, which
improves safety and reduces congestion. However, the current plans for improving WCR 29 are to
work within the existing right-of-way and only have approximately one -foot paved shoulders and.
one -foot gravel shoulders. Again, we are generally not looking at acquiring right-of-way for this
project.
So this means existing accesses can remain as they are until a change of use such as redevelopment
occurs. With a change of use, accesses would be required to be brought into compliance with the
spacing criteria to the extent feasible.
The towns adopted the ACP and IGA on the dates below.
• Ault: August 9, 2017
• Severance: September 18, 2017
• Eaton: September 27, 2017
• Nunn: October 9, 2017
• Pierce: December 11, 2017

Control Plan
The Weld County Road 29 Coalition, which includes the towns of Severance, Eaton, Ault, Pierce,
and Nunn as well as the county, decided at their last meeting on July 25, 2017 that the towns would
adopt the Access Control Plan and an intergovernmental agreement to implement it before we
scheduled the resolutions for the Board of County Commissioners to do the same. The towns adopted
the ACP and IGA on the following dates:
• Ault: August 9, 2017
• Severance: September 18, 2017
• Eaton: September 27, 2017
• Nunn: October 9, 2017
• Pierce: December 11, 2017
The main objective of this Access Control Plan is to provide safe access to properties on the WCR 29
corridor between State Highway 392 and WCR 100, which can be accomplished through the
following goals:
1. Improve corridor safety.
2. Coordinate construction improvements.
3. Promote economic vitality.
4. Protect infrastructure investments.
5. Maintain the functional integrity of the corridor (safety, mobility, and capacity).
To accomplish these goals, the ACP contains requirements for access spacing, sight distance,
auxiliary lanes, and width of accesses. It also contains policies on the width of the right-of-way for
the corridor, addresses accesses with safety concerns, new accesses, and new road connections. Other
policies address future traffic signals, speed limits, weight limits, road cuts, and school bus stops. The
ACP states accesses that do not meet the criteria in the plan can remain as they are, but they should
be addressed as soon as feasible, when development occurs, with change of use, or when the road is
widened, whichever occurs sooner.

The ACP is intended to be used by Weld County Public Works staff when designing improvements
on the corridor, by the towns as they annex portions of the road (the northernmost mile is already in
the Town of Nunn), and by developers so that they will know the requirements for access onto the
corridor. The ACP also contains a process for amending the plan in order for it to remain a "living
document."
The attached resolution adopts the Weld County Road 29 Access Control Plan and the policies it
contains. An intergovernmental agreement among the county and the five towns follows this agenda
item.
Notice of this hearing was published December 29, 2017 in the Greeley Tribune, posted on the WCR
29 ACP webpage and on the county's legal notices webpage, and emailed to those who provided their
emails at the public meeting held June 13, 2017. A newsletter was also emailed out to those signed
up for those emails. The towns were notified by email as well.

January 29, 2018 here in the Events Center and the second being on February 12, 2018, from at the Nunn

While most of the questions pertained to the functional classification of the road and future construction
plans for improvements on WCR 29, there were a few suggested changes to the ACP.

movement converted (e.g., restricted to right-in/right-out) as soon as feasible, when development occurs,

A. Proj tat, Background
Weld County Road (WCR) 29 is a unique for now Weld County road west of US Highway 85
because of its continuous right-of-way in place between State Highway 392 and WCR 100.
WCR 100 is a collector road that connects to Interstate 25 to the west at Wellington. The Weld
County Board of Commissioners decided it would like to see an Access Control Plan (ACP)
developed for this corridor due to increased traffic and the geographic proximity to the
surrounding towns. Weld County staff, led by Weld County Commissioner Mike Freeman,
began meeting with elected officials and staff from the towns of Severance, Eaton, Ault,
Pierce, and Nunn in June of 2016 and a coalition was formed to meet monthly to discuss the
development of the ACP.

B. Purpose
Each access point creates potential conflicts between through traffic and traffic using that
access. Each conflict is a potential crash. Access management improves safety by separating
access points so that turning and crossing movements occur at fewer location, This allows
drivers passing through an area to predict where other drivers will turn and cross, and provides
space to add turn lanes.

Agreeing to certain common standards and policies for the corridor helps ensure the
communities with jurisdiction on the corridor are collaborating on regional goals that are best
for the travelling public and not working at cross purposes. For example, if one community
were to promote the corridor as a truck route and another to discourage trucks from using it,
that could result in a waste of resources and frustration for the people involved, including
motorists.
C. Goals and objectives
one of the first things the coalition did was develop a list of goals for the WCR 29 ACP. The
main objective of the WCR 29 ACP is to provide safe access to properties, which can be
accomplished through the following goals:
1. Improve corridor safety.
2. Coordinate construction improvements.
3. Promote economic vitality.
4. Protect infrastructure investments.
5. Maintain the functional integrity of the corridor (safety, mobility, & capacity).

The southern half of the WCR 29 corridor traverses somewhat hilly terrain that can, in places,
obstruct the view of oncoming traffic. More detail on these sight distance hazards is presented
in Chapter Ill, Access Requirements.
WCR 29 is paved from SH 392 to north of WCR 70 and between WCR 74 and SH 14 with two
travel lanes but no shoulders or very narrow shoulders, sometimes due to steep roadside
ditches near the roadway. The pavement is deteriorated in some areas. Between WCR 70 and
WCR 74 Weld County Public Works treats the road surface with magnesium chloride for dust
control due the traffic volumes. North of SH 14, the road is untreated gravel.
The ditches and fences in areas along the corridor has naturally limited the location of
accesses. Other areas have no fences or ditches, which makes it possible for vehicles to enter
and exit the road at any point, which can be a safety concern for motorists already on the
roadway.
The current right-of-way width is 60 feet. Power lines and water lines are in place within the
right-of-way for much of the corridor. There are stop signs on WCR 29 at SH 392, WCR 74, SH
14, and WCR 100.

North WCR 98, the road is within Nunn's town limits and maintained by the town, where it is
called Eisenhower Road. WCR 29 ends at WCR 100 approximately one-half mile west of US
85.

B. Crash Data
There were 17 reported crashes in the subject area between the beginning of 2014 and the
end of 2016, one of which was a fatal crash on February 21, 2015 at the intersection of WCR
74 and WCR 29. There were four other crashes that resulted in injuries.

Until recently, Weld County had no designated collector or arterial roads between State
Highway 14 and WCR 100 west of WCR 33. In May of 2017, the Weld County Board of
Commissioners adopted on third and final reading Ordinance #2017-01 designating WCR 29
between SH 392 and WCR 100 an arterial road. Several residents came to the Commissioner
hearings as well as the Planning Commission meeting that preceded it. As a result of public
input, the Board of County Commissioners decided to leave the section of WCR 29 south of
SH 392 a local road. The section north to WCR 100 was designated an arterial road, but with
100 feet of right-of-way rather than the standard 140 feet, except for the intersections of SH
392, WCR 74, SH 14, WCR 90, and WCR 100.
WCR 29 south of SH 392 is unpaved and is within the City of Greeley's growth area, which
designates the road as a two-lane minor arterial on its transportation plan. This area is within
the North Greeley Rail Corridor Subarea Plan and is designated as part of the northwest
industrial -rail corridor south of WCR 66 on its comprehensive plan. WCR 29 ends at WCR 64
(0 Street) approximately one -quarter mile west of 71St Avenue.
The 100 -foot future right-of-way for WCR 29 between the major intersections will allow for a
two-lane road with eight -foot paved shoulders. Drainage swales and utilities will take up the
rest of the right-of-way outside of the roadway. The 140 -foot right-of-way at the major
intersections will allow for both left- and right -turn lanes. Figure 5 depicts a typical cross-
section for reconstruction of a 40 -foot road within 100 feet of right-of-way. No timeline for
reconstructing the road to this standard has been established.

Currently, land along WCR 29 is almost all agricultural and large -lot residential with oil and
gas facilities thoughout the area. The land between SH 392 and WCR 98 is zoned Agricultural
on either side of WCR 29, except for the Gold Stone Creek Subdivision, which is zoned Estate.
Nunn's comprehensive plan shows the area along WCR 29 north of WCR 98 as low- and
medium -density residential. There is a subdivision called Prairie View Subdivision on the west
side of WCR 29 south of 4th Street that was platted 2006 and has not been developed. No
additional right-of-way along WCR 29 was platted, but the plat did include drainage and utility
easements along WCR 29.
South of WCR 98, the town's comprehensive plan shows the future land use as undeveloped
agriculture. The planning area extends to WCR 92. Figure 7 shows the town's Land Use
Concept Plan Map.

determining change -of -use, further discussed in Chapter V, Plan Recommendations. The type
of access may also determine its width. For example, accesses used by large trucks and farm
equipment are usually much wider than residential accesses.

III. ACCESS REQUIREMENTS
A. Access Spacing
The minimum spacing between accesses or between accesses and intersecting roads on WCR
29 is 660 feet (1/8 mile) as measured from the center of the access or street. Spacing
accesses farther apart improves safety and mobility on the corridor.
B. Sight Distance
For roads with a 55 mile per hour speed limit, the minimum sight distance is 550 feet for a
passenger car. Even relatively short hills can block a driver's view of oncoming traffic, for
example, when a driver is attempting to turn left into an access, or enter onto the road from
an access. Sight distance can also be blocked by curves in the road, but there are no such
cases on WCR 29, which is generally straight north and south.
C. Auxiliary Lane Requirements
Auxiliary lanes (or turn lanes) allow a driver to merge with traffic after turning onto the road,
or exit (diverge) the travel lane before turning. They are useful in maintaining the safety, traffic

flow, and operation of the road. Proposed developments that warrant installation of auxiliary
lanes based on the resulting type and amount of traffic to and from the development must

Most existing accesses on the WCR 29 Corridor do not meet the minimum spacing
requirement, which can lead to uncertainty for drivers trying to determine where other drivers
may be exiting or entering the road. Some accesses do not meet the minimum sight distance
due to hills obstructing the driver's view. Accesses with safety concerns are indicated on the
maps in the next chapter with red boxes and "SD" is for sight distance or 66S" for spacing.
Accesses that don't meet either minimum standard are labelled accordingly. Since sight
distance is a greater safety concern than spacing, Weld County hopes to work with landowners
to relocate these accesses to safer areas in the future.
This Access Control Plan recommends most of the accesses with safety concern be allowed
to remain as they are for the time being, until the property develops or redevelops, the use of
the property or access change from its current use, or the road is reconstructed.
See Appendix for specific recommendations regarding accesses.

F. Access Control Techniques
There are generally four ways unsafe accesses can be addressed: The access can be
eliminated so the property uses an access on a side road instead, especially if it is a lower
classified side road. It can be relocated to a safer location, usually either farther from other
accesses or aligned with an access across the street. Where there are multiple accesses on
one property, they can be consolidated into one access. Finally, if the access needs to stay
where it is, the access can be made safer by movement conversion; which is restricting it from
a full -movement access to one where only three-quarter movements or right turns are allowed,
for example. This is referred to as a "right-in/right-out" access. This movement conversion is
best accomplished with a raised median or other barrier in the center of the road.
1. Elimination
Access elimination is typically used at locations where a property has more than one access
point. See Figure 13 below depicting access elimination.

2. Relocation
Access relocation is a method that would either align opposite approaches to create a more
familiar intersection design or move an existing access point to a new location, such as a side
road. Offset accesses can create a situation with overlapping left turns, which could result in
a head-on collision. Figure 14 below shows an example of access relocation.

3. Consolidation
Access consolidation is used to reduce the number of access points along the corridor. Refer

The purpose of access movement conversion using median treatments is to eliminate some
turning movements to reduce the number of conflicts between left turning vehicles and
through vehicles on the road. Sometimes a full -movement access is converted to a 3
intersection by restricting left turns on exiting, but not entering, vehicles. More commonly, a
right-in/right-out (RI/R0) would be used to eliminate all left-hand turning movements.
Typically, a median or some type of barrier is required. Refer to Figure 16 below.

PLAN POLICIES
The WCR 29 working group developed the following Access Control Plan policies, which
the county and each of the towns shall enforce to the best of their ability, unless an
amendment is granted in accordance with Chapter VI, Plan Amendments:
A. Right -of -Way Policy
The ultimate future right-of-way width shall generally be 100 feet except at the
following intersections it shall be 140 feet for 1,800 feet north and south of the
intersections: SH 392, WCR 74, SH 14, WCR 90, WCR 100. New development and
redevelopment shall dedicate or reserve additional right-of-way if the ultimate right-
of-way width is not already existing. Setbacks for new structures shall be measured
from the ultimate future right-of-way.
B. Access Policies
1. Additional Access. Only new accesses that comply with the Access Control Plan
criteria shall be permitted. No new accesses to WCR 29 that do not comply with
the Access Control Plan criteria shall be permitted from existing legal parcels
unless approved through the plan amendment process, in accordance with Chapter
VI, Plan Amendments. New lots shall share accesses where feasible in order to
minimize the number of additional accesses.
2. New Accesses to be located on Side Roads: New access onto WCR 29 shall not be
permitted unless access to a lower classified road is not feasible and the proposed
access meets the spacing requirement below and does not interfere with the
location, planning, and operation of the general street system or access to nearby
properties.
3. Access Spacing: No new full -movement access shall be permitted within 660 feet
of an existing access or intersection, as measured from the center of accesses or
streets.
C. Collector & Arterial Road Spacing Policy
No new public road shall intersect with WCR 29 unless the new road is constructed
to an arterial or collector standard and it is located at least one -quarter mile from
any other existing public road(s) intersecting WCR 29. If accesses exist within 660
feet of the new road, a median or medians restricting all such existing accesses to
right-in/right-out movement shall be installed on WCR 29 to ensure the safety and
integrity of the corridor is maintained.

D. Change of Use Policy
Use of existing accesses shall be restricted to the current use category identified
in this ACP as of the date on page 2 of this document. Change of use of the
property/access will require the existing access to be brought into compliance with
spacing criteria or eliminated. Change of use is defined as a use substantially
different from the previous use of a building or land unless such change can be
shown to have no effect on vehicular circulation or traffic volumes anticipated to
u se the access.
E. Access with Safety Concern Policy
Accesses with Safety Concern (ASCs), indicated on the maps in the Plan, shall be
e liminated, relocated, consolidated, or movement converted (e.g., restricted to
right-in/right-out) as soon as feasible, when development occurs, with change of
u se, or when/if the road is widened, whichever occurs sooner.
For the purpose of this policy, "widened" shall mean when/if additional right-of-way
is acquired along WCR 29. Prior to beginning the process of acquiring right-of-way,
the recommendations in Appendix A should be reviewed, and where the
recommendations are deemed feasible, the agency acquiring the right-of-way
should discuss addressing ASCs with property owners as part of the right-of-way
acquisition process. The intent of this policy is not to force accesses that existed
o n separate parcels prior to adoption of the ACP to be shared. When it is deemed
unfeasible to eliminate, relocate, or consolidate ASCs, the agency should consider
o ptions for restricting turning movements through installation of medians, for
example. The goal should be improving safety on the corridor by reducing the
n umber of ASCs while realizing it may not be possible to address every one.
Accesses very close to intersections and those most feasible to address should
take priority.

F. Traffic Signal Policy
Traffic signals shall only be installed at major arterial intersections and only when
such intersections meet warrants in accordance with the Manual on Uniform Traffic
Control Devices (MUTCD).
G. Speed Limit Policy
Posted speed limits on WCR 29 are 55 miles per hour (mph) south of approximately
WCR 98 and 35 mph north of WCR 98. The speed limit along WCR 29 will remain
55 mph unless a jurisdiction provides a valid safety reason for speed limits to be
altered in accordance with the MUTCD, CRS §42-4-1102 with a traffic investigation,
or a speed study performed by Weld County Public Works, through a plan
amendment request in accordance with Chapter VI, Plan Amendments, to ensure
the request does not adversely affect the functional integrity of the corridor.
Regardless of jurisdiction, south of approximately 7th Street in Nunn the speed
limit on WCR 29 shall be 55 mph. Speed limits may be reduced within one -quarter
mile of traffic signals and other controlled intersections.
H. Load Limit Policy
Regardless of jurisdiction, there shall continue to be no weight limits on WCR 29.
I. Road Cut Policy
In order to preserve the integrity of the road surface, road cuts will not be allowed
in any section of road that has been reconstructed after adoption of this Access
Control Plan. Crossings will only be allowed to be placed under the road by boring
underneath it. The minimum crossing depth for lines will be 10 feet below the
lowest roadside ditch flowline elevation, except for oil and gas lines whose
minimum depth will be 15 feet below the lowest roadside ditch flowline elevation.
J. School Bus Stop Policy
School Districts RE -2 and RE -9 bisect the corridor. School districts are encouraged
to work with local government agencies to ensure bus stops are appropriately
identified in safe locations. It is recommended school buses use side roads, private
properties (driveways), or private accesses (oil and gas) for loading and unloading
children whenever possible and should only stop on WCR 29 in safe locations as
determined by an engineered safety analysis.

VI. PLAN AMENDMENTS

The WCR 29 working group developed the following process for amending the ACP:
1. Proposed amendments, such as traffic signals, new accesses that don't meet
the ACP criteria, or speed limits, shall be submitted by one of the entities
participating in this ACP (Weld County, Severance, Eaton, Ault, Pierce, or Nunn).
2. Proposed amendments shall be considered by the WCR 29 committee
consisting of one representative from each entity.
3. Proposed amendments shall be submitted to Weld County Public Works for
distribution and scheduling of a committee meeting.
a. The submittal request shall include a written description of the proposed
amendment to the ACP, including engineering supported justification for
the amendment, and supporting traffic safety analysis to show the
amendment will not adversely impact the corridor from its current level
of service.
b. The submitting entity will be given an opportunity to present its request
to the committee and answer questions.
4. The committee will review the submittal for consistency with the ACP.
5. Four of the entities must vote in favor of the proposed amendment in order for
it to take effect. No proxy votes will be allowed.

Appendix A: Access Descriptions and
Recommendations
Weld County Public Works staff inventoried existing accesses using aerial photography as well
as driving the corridor multiple times, examined plats, and access permits on the corridor. The
spreadsheets on the following pages contain the following columns:
• An access number keyed to the maps in Chapter IV
• The house or building address number
• The use category for each access
• A description including information on access permit, if any, and recorded exemption
(RE) plat, if any
• A listing of whether the access has a safety concern (spacing or sight distance)
• A recommendation for correcting the safety concern, if any
The following pages are recommendations both to land owners, staff, and elected officials for
future actions to reduce the number of accesses on the corridor to ensure they meet spacing
and sight distance criteria. There are currently no changes planned or budgeted for access
modification. In many cases, there are multiple actions that could potentially be taken by
landowners; for example, relocating an access north or south or to a side road. Changes to
the access on one property can affect the possible changes on adjacent properties, making
the process of determining a best course of action more complicated. These
recommendations are not intended to be a definitive set of instructions, but to guide
developers, land owners, staff, and elected officials when development or road improvements
are proposed or contemplated.

On June 13, 2017, Weld County hosted a public meeting on the draft WCR 29 Access Control
Plan, which was attended by more than 50 people. Postcard notices were sent to all
landowners within a half -mile of the project area. Notice was also provided on the County's
website, along with information about the project. A questionnaire was included in the
handouts at the meeting and on the website.
The majority of comments on the questionnaire responses related to maintaining the gravel
portion of the corridor and speeding. A few respondents mentioned the need for intersection
improvements as well. The responses submitted are on the following pages.

Increased traffic last 5 years. Intersections at Hwy 14 and WCR 74 can be congested morning & evening work traffic. WCR 29
and WCR 78 intersection is blind and will be higher safety risk with ANY WCR 29 Corridor improvements. Would be prudent to
include intersection improvments at Hwy 14, 74, Hwy 392 along with any construction plan for new pavement from WCR 100
to 392. If not done then, they will quickly become more of a problem.

traffic is at a high rate of speed on the gravel portion from CR100 to hiway 14. Very dangerous and damages road. Ruts after
rainstorms and mud buildup is also a concern. The school bus stops in the middle of the road because there is no room to pull
over. There are large trucks that use this road and they go very fast. I have had to put another set of tires on my car (plus
plugged holes in several tires after that)since moving here 2 years ago.

Comments:
This creates multiple issues and compounds access issues and separation of properties as well as maintenance cost. This property
is 100 years old and should not be impacted in such adverse ways.
The widening of this road for shoulders, additional lanes or other right of way items will destroy trees on this property that are rare and
irreplaceable. Additionally, widening the road with shoulders or other right of way widening or improvements will bring traffic to close
existing houses (especially on this property) allowing for vehicle/house collisions as seen far too often on the news.
Neither the County nor town will should be allowed to negatively impact property, make wore safety conditions, nor unfairly impact the
land owners by widening the right of way. Sharing of driveways will create numerous legal situations, add expenses and limit access
to or properties for ag and related purposes.
The changing of the WCR right of way width has been done without fair notice to the affected people along WCR 29. Also, there are
other roads that already have a wider right of way access that will serve the same purpose rather than creating new issues, safety
concerns and related problems along WCR 29.

I will not be able to attend the January 8th WCR 29 Access Control Plan review due to some family medical issues. I
wanted to make 2 comments now that I see the full plan vs. the drafts and maps that were part of the June 13, 2017
Open House and would ask that you carry them forward for me in the correct manner. I apologize for not being in
attendance but the situation is such I need to attend to the family issue.
1. W31 access is listed just as Agricultural, ditch road access. In reality it is both ditch road and residential. I have seen
Larimer & Weld use the road on the north side of the ditch once to dump concrete for erosion control (they typically use
the improved ditch road on the south side at W30 access point), but I maintain the north side road (mowing, grading,
spraying) as I use it for access to maintain the perimeter of our property. We built our house in 1984-85 and I built the
fence with legal right-of-way set back and a fence gate for use right at the W31 access point which I have used to bring
in machinery if I can't get it in our WCR 78 normal access. I have also used W31 for car/truck access in the winter when
WCR 78 is blown in with snow and we can't get out until it is plowed. That portion of 78 is lower than the field to the
north so it will have 2-3 ft drifts blown over the road with snow. In those cases we drive down to the W31 access point,
through the fence gate and onto WCR 29 which is typically blown free of snow being a north -south road. Given that I
would think W31 should more appropriately be categorized as Agricultural, Residential access, somewhat similar to W29
to the south.
2. The Plan Amendments section includes the process and entities who are to review amendments but there is no
mention of representation of any landowners along WCR 29 as part of the committee, who in my mind are the key
stakeholders living in the environment with all associated issues along the corridor, including safety. The
representatives from the entities listed have a stake but unless the area is annexed, it seems more as an `arms -length'
interest. As a corollary, if one of the city entities had an access amendment within their jurisdiction but had no
representation on the review committee, I would think it would be viewed as a problem.
I would propose inclusion of at least one WCR 29 resident on the amendment committee. I realize the process of
selection and continuity is more ill-defined than a committee representative from an entity, but the position could be
appointed by the district County Commissioner who would be aware of residents in the area.
I apologize for the late timing of the comments and must admit I lost track of the process until I received your email a
few days ago highlighting the upcoming review on January 8.
Thanks for considering the comments. I realize it is only the voice of one person and there are a lot of voices to
consider.

FYI and for my file:
Dr. Seward just called me to ask if we could make the change to the ACP he requested in his email and the voicemail he
left me yesterday. I explained that staff cannot make any changes at this point, but the BOCC could and it will have his
email and he would have an opportunity to address the Board at the hearing if he wants. I explained that the
spreadsheet he's referring to where it says to consolidate his access with his neighbor's is just a recommendation and he
wouldn't be forced to consolidate, except maybe in the case of redevelopment, but even then his neighbor would have
to agree to consolidate his access as well. I explained that if we were to purchase additional right-of-way, we would
probably negotiate with land owners to reduce the number of accesses where we could. I said the Board might
authorize offering land owners compensation as an incentive to consolidate accesses in the future, but I couldn't say for
sure. He asked about 49 and I said we were able to get some accesses improved but I didn't know how many. I
reiterated that no one was forced.

In reviewing the WCR 29 ACP I found that our driveway (E-42) is to be consolidated with (E-43) as is the neighbor to the
north (E-44). It states our lot size in error as 13.36 acres and fails to take into account that we farm approximately 40
acre behind this frontage and three other properties. Our farm requires access for equipment and loads of hay or
produce. Additional turns would not be practical for our farming operation. Not having convenient and practical access
adversely impacts the use and value of our property. Please alter the plan to give us direct and straight access to WCR
29 as we currently have.

Yes, please include that the ACP refers to the `widening' terminology at least three times, which is completely against
what the commissioners were representing at the July meeting. I was at the July meeting and the newsletter doesn't
represent the residents/audience input accurately. It's so comical how political officials twist the truth to make it look
like the residents were 'for' this proposal. The only thing residents were 'for' was the paving of WCR29 from 100 to 14.
Please also include my comments about weight limits, and noise issues. This would be an environmental concern.

Jim,
I'm drafting some comments that I would like to be considered during Monday's meeting on CR29, and will send them
over soon. However, I've got a question for you. In the few reviews with residents North of 392 and CR29, we were told
that the road improvements were not for purposes of being widened. Yet, in your .ppt presentation, #7 states the
following, "Recommend school buses use side roads or private accesses/driveways for drop-off and pick-up of children
once the road is widened. up of children once the road is widened "
This is contradictory to everything the county commissioners have been sharing.
On #5, "Continue to have no weight limits on WCR29" only encourages large trucks, dump trucks and oil and gas related
vehicles to use 29. Currently, many dump/trash trucks use CR29 quite heavily as they speed, lose trash and don't have to
adhere to decibel levels, especially when the road is not patrolled by County Deputies. At least 4x weekly, a workover rig
uses 29, and while it travels within the posted speed limits, I'd venture to say it's outside the maximum allowable noise
levels for Colorado's Noise Abatement statue.
By attempting to pass this ACP for 29, you're inviting larger and louder vehicles.
The continued pressure of the county commissioners pushing the adoption of CR29 is undesired by the residents along
CR29 South of hwy 14 to state hwy 392 because of environmental concerns and because many residents either don't
want hard -surface roads for privacy reasons or don't want to give up parcels of land for widening. There are more
critical roads that need attention, like east to west, CR74 or even state hwy 392. It is my opinion, that creating a second
thoroughfare from Nunn to Greeley isn't what the residents want, but rather paving from Nunn to Hwy 14.
I'm quoting Adam Mann from Science magazine law of road congestion: "New roads will create new drivers, resulting in
the intensity of traffic staying the same." Intuitively, if you expand or improve our road network you're just inviting more
traffic and congestion.
Another question, did you get permission to use the photograph showing the small hill near 36506 COUNTY ROAD 29?
only ask because this resident listed their house for sale around the start of all this, and after 175 days on the market,
and price reduction 450K, I wonder if the new buyers know what they're moving into? I wonder if this didn't impede
their sale.

The panel, approved the road being changed to Arterial, without the consensus of the residents, and it would appear,
while even trying to follow more democratic protocols such as informing the residents, this adoption is promoting
economic vitality for towns that aren't even that close by. I mean Eaton is 5 miles, Ault is 6 miles, and Severance is 4
miles. I don't really care to watch Nunn grow, the Centennial highway and all its improvements are more than
acceptable means to travel from Nunn to Greeley.

Commissioners,
The Town of Eaton hosted its regularly scheduled meeting on February 15th, 2018 and
there was an agenda item to hear public concerns regarding WCR 29. During this
meeting 4 community members expressed concerns about the proposed Access Control
Plan (ACP) and the way in which it has been rolled out. We did have 2 members from
the county public works staff available as well to answer questions. Upon hearing many
of the concerns being brought forth from those community members and having received
multiple emails as well the Eaton board is concerned that items of concern have arisen
and may have not yet been addressed by the Board of County Commissioners. The Eaton
Town Board voted unanimously to send a letter to the Weld County Board of
Commissioners asking them to hold off on the passage of the ACP until all information
that is being brought forth by these concerned citizens is properly discussed and
considered in a public setting. The 14,aton Board fully understands the need and
importance of long range transportation planning in the region, along with that we
understand the role of the ACP as presented. The Eaton Board wishes that prior to the
passage of the ACP that all current concerns are addressed for the WCR29 corridor. The
Eaton Board appreciates the County Commissioner's regional collaboration on the ACP
anc hope that the Commissioner's share in our boards desire to make the ACP as accurate
and reflective of the corridors needs as possible.
