WELD COUNTY COUNCIL
May 19, 1976
COUNT?CLERK AND RECORDER
The Weld County Council met in renular session in full conformity
with the Weld County Home Rule Charter at 401 N. 15th Avenue,
Greeley, Colorado, on Wednesday, May 19 at the hour of 2 o'clock.
ROLL CALL: The meeting began with an invocation by Mr. John Martin, President.
On roll call the following members were present:
President,. John T. Martin
Vice President, Nancy Clark
Councilman, Floyd Oliver
Councilman, Lacy Wilkinson
Councilman, Bob E. White
Also present: Secretary, Bonnie Hickman and 4 members of the press.
MINUTES: The minutes of May 5, 1976 were accepted unanimously by motion of
Floyd Oliver. and second by Nancy Clark.
REPORTS
OFFICE LOCATION: John Martin reported he received a cal] from Commissioner
Glenn Billings regarding whether the Council would be willing to
remain in their present location (the old Drivers' License
Building) until Phase 2 is completed on the new Weld County Services
Building. Mr. Billings stated the reason for the delay is that
the office space allotted to the Council is very small. Nancy
Clark made a motion that a letter be sent to Glenn Billings stating
that the Council will remain at their present location and will
expect to have office space when Phase 2 is opened. Floyd Oliver
seconded. Carried unanimously.
EVALUATION OF ROAD DISTRICT SHOPS VISITED: It was reported that the Council
visited the district road shops on Tuesday, May 11th at Ault,
LaSalle, and Johnstown. The Greeley shop will be visited on
Monday, May 24, 1976. It was considered an educational trip to
all.
Discussion followed in which members stated various concerns.
Some areas of possible future consideration would be: purchasing
policies, shop supervision, organization of the road districts,
personnel policies, training and the overall work of the road
districts.
A report will he submitted by Nancy Clark on the observations and
opinions of the council members which will be incorporated with
the final purchasing report.

VISIT TO ASSESSOR'S OFFICE: The Council also visited the Assessor's office
the morning of May 11th. Two matters of concern noted were:
1) the lack of appraisers for the assessor to complete his XNUtigq appraisal,
and 2) the possibility that new employees in the assessor's office
are being paid more in comparison with employees who have worked
there for several years. Council members were concerned that the
. County wage scale is not equal, even though last year the County'
spent $50,000 on a personnel study which resulted in a rules and
regulations manual.
Floyd Oliver will submit a report on this visit and will also look
into the problem of unequal wages.
COUNTY ATTORNEY: It was reported that Robert N. Miller is running for
re-election for District Attorney.
Nancy Clark reported that two new assistant County attorneys are now
employed and requested letters he sent to the new assistants inform-
ing them of Council office hours and meeting times, and welcoming
them to attend an; meeting and -that the Council is looking forward
to working with them in the future.
Mr. John Martin reported that the Commissioners have not appointed
a new County Attorney to this Hate. The Commissioners are seeking
further information on the preferred applicant's background. Nancy
Clark waid the Council can assume that someone will be hired soon '
and will take office in July.
Nancy Clark reported asking the Commissioners of the necessity of
Mr. Sam Telep remaining in attendance at all meetings even though
two new assistant attorneys have been hired. There was no answer
regarding this question.
COMMUNICATIONS: John Martin reported that John Miller has resigned from his
position on t he Communications committee.
Nancy Clark reported that the Commissioners appointed a new assistant
director of communications, Ward Carpenter. She obtained no reason
why an assistant was necessary, except that the budget called for
one.
It is believed that Ward Carpenter is the son of Judge Carpenter.
Nancy Clark tried to find out anything that would negate that
occuring (nepotism) , but could find nothing in the charter. John
Martin volunteered investigating the necessity of hiring an
assistant director of communications.
PURCHASING: Bob White mentioned that rnveral. times Lacy Wilkinson has brought
to the attention of the Council the fact that the County has been
spending many more dollars in purchasing from other than state
price lists. Mr. White requested Lacy Wilkinson compile a list of
what the County paid on purchases since January 1976 in comparison
with the savings that could have been made in purchasing from
state price lists.

John Martin presented a report on "Preference to Weld County
Bidders. " (see attached report) Discussion followed on the
necessity of stating percentages of preference to local bidders
in bid requests. It was finally decided that setting a percentage
would discourage outside bidding and the charter does not state
the necessity of one. As a result, Bob White made a motion to
accept Mr. Martin's report with the omission of the last
sentence. Nancy Clark seconded and the motion carried unanimously.
Floyd Oliver suggested having all bids bonded to insure bidders
from withdrawing after being accepted.
INTERN PROGRAM: Nancy Clark reported visiting Colorado State University's
School of Business in response to the action taken at the last
meeting of investigating the possibility of having an intern
student aid the Council in doing a study of County purchasing
concerns. She also talked with the University of Northern
Colorado's director of the internship program, Dr. Paul Rohrer.
He informed Mrs. Clark that an intern program involves a ten
week full-time position with remuneration. There is also the
possibility of having students interested in doing a "special
project" for the Council, but still getting credit from UNC.
Mrs. Clark made an appointment with Dr. Rohrer to meet with the
Council on Monday, May 24th, at 1:00 P.M. The Council agreed
by motion of Floyd Oliver to hold a worksession at this time.
RESOLUTION: John Martin read a resolution prepared by Robert Miller, D.A.,
regarding the salaries of the county commissioners. Floyd Oliver
moved the Council adopt this resolution with Rob White seconding.
Motion passed with 5-0 vote.
LEAGUE OF WOMEN VOTERS: Nancy Clark presented a report from the League
of Women Voters regarding the county budget process entitled,
"Statement to Weld County Board of Commissioners Concerning
the Budget Process." They urged the Commissioners to adopt
suggested procedures "to enable Weld County residents to take
their proper role in the budget-making process."
CORRESPONDENCE: The Council received a letter from the Greeley Independence
Stampede inviting the Council to ride in the town parade on July 3rd.
Nancy Clark made a motion to notify the Stampede Office that the
Councilvrill be in attendance and would like to be assigned together
to an appropriate vehicle. Floyd Oliver seconded and carried.
Bob White made a motion that the secretary send a letter to Mr.
Billings informing him that the Council will be in attendance at
the dedication of the new Weld County Services Building. Nancy
Clark seconded. Motion carried.

COUNTY AUDITOR: Floyd Oliver reported that the County Auditor, Mr. Rill
Siebert, will attend the next meeting of June 2nd.
There being no further business, the meeting was adjourned by the president.

Report on "Preference to Weld County Bidders", Section 14-9-(3)
The County Commissioners shall give preference to resident Weld County
bidders in all cases where the bids are competitive in price and quality.
The provision to give preference to resident Weld County bidders was
a loyalty consideration to County tax paying citizens. An effort also to
keep Weld County dollars in Weld County as much as possible and insure
employment to Weld County residents.

Accepted bids are bound by the requirement that in all cases the bids
must be competitive in price and quality.
Specifications must accompany bid solicitations clear enough and complete
enough to avoid misunderstanding. When such bids are received by the
Commissioners a determination made that the item does in fact meet the
specified requirement the low bid must be accepted. Any exception must be
justified and entered in the minutes of the meeting at which the purchase
was made.
Whenever a Weld County bidder receives preference the bid must be
competitive.
Competitive means contest - an effort by two or more equally matched
individuals or forces for a particular goal, position or reward. Fair competition
is when the rules are the same for each participant, the winner being able to
surpass the other contenders.
The County Commissioners' first responsibility is to the individual tax
payer. Therefore, restraint must be exercised in taking liberties with tax dollars.
The County Charter provides for the County Commissioners to set bidding
procedures, recognizing the fairness in special consideration for local
bidders. In establishing areas of preference care should be taken to encourage
outside bidding. Outside bidders are desireable and necessary. The Commissioners
shall accept the bid they find most beneficial to the County.
All bidders should be fully aware of bidding procedures and the Commissioners
should adhere carefully to their rules.
It is reasonable for the Commissioners to have some flexibility in
considering each bid due to the complexities that will arise. However, some
so-called competitive bids have been accepted for thousands of dollars more
than the low bid. The reason; preference to local bidders. Not only does this
cost the tax payer extra money but allows an area of suspicion.
With ample consideration given to the proper order of priorities
competitive bidding can be effectively achieved with the present bidding
procedures adopted by the Commissioners.

RESOLUTION
RE: SALARIES OF WELD COUNTY COMMISSIONERS
WHEREAS, the Weld County Council has , by majority
vote, agreed that the salaries of the Weld County Com-
missioners should be increased and equalized.
WHEREAS , Section 13-8 (1) of the Weld County Home
Rule Charter states that the Weld County Council shall
set the salaries of all elected officials and further-
more, in the case of County Commissioners, the Charter
provides for a delay in the effective date of said
salary increases so as to provide for equal compensation
for all commissioners at all times and;
THEREFORE BE IT RESOLVED, that all Weld County
Commissioners shall be paid $15,000 per year commencing
January 11, 1977.
IT IS FURTHER RESOLVED that commencing the second
Tuesday of January, 1979 , all Weld County Commissioners
shall be paid $17 ,500 per year.
The above and foregoing Resolution was , on Motion
