FINDINGS AND ORDER OF THE BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been informed, in accordance with Section 35-72-103(1), C.R.S., that dust is blowing from the following described parcel of land: S1/2 SW1/4 of Section 22, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, said parcel is owned and operated by Mile 250, LLC, do Bob Erlich, 1853 Chesapeake Circle, Apt. B, Johnstown, Colorado 80534, and WHEREAS, staff from the Department of Public Health and Environment has inspected the above described parcel of land, and WHEREAS, pursuant to the information and the inspection referred to above, a hearing before the Board was held on the 16th day of May, 2018, and WHEREAS, Mile 250, LLC, c/o Bob Erlich, was notified of said hearing by first class mail on May 4, 2018, and was in attendance at said hearing, and WHEREAS, pursuant to Section 35-72-103(1), C.R.S., upon consideration of all information submitted by Mr. Erlich and the Department of Public Health and Environment, the Board did make the following Findings of Fact to support dismissal of the Dust Blowing Complaint hearing: 1. That such blowing can be prevented or materially lessened by treatment of the soil. The property owner has demonstrated that they are willing to treat the soil and work in good faith to remedy the situation. 5. That property damage DOES NOT appear to be resulting from soil blowing. (b) If the board finds, after consultation with the local district board of directors, the state conservation board, or an extension agent with expertise in soil conservation or soil science, and after consultation with local owners or occupiers, including the owner or occupier of the land from which soil is blowing, that soil is blowing from the land in sufficient quantity to be injurious to private property, including crops, grasslands, fences, fencerows, irrigation canals, ditches, or livestock on adjacent or other land, or to roads, barrow ditches, fences, or other public property because of soil being blown thereon, the board shall determine what, if anything, can be done to prevent or materially lessen the blowing of soil from the land. If the board determines, after the consultation, that the complaint lodged with it falls under article 3.5 of this title, the board shall not take further action. If the board finds, after the consultation, that an emergency exists, that the blowing is occurring, that property damage appears to be resulting from the blowing soil, and that it can be prevented or materially lessened by treatment of the soil, the board shall issue a citation to the owner as listed upon the records of the county assessor and to the occupier, if known to the board, specifying the nature of the treatment required and the extent thereof, the date by which the treatment is to be commenced, and the date it is to be completed. (2) Notice of such citation shall be given by personal communication, if possible, and by mailing a copy thereof by registered mail addressed to each of the persons to whom the citation is directed at the address as shown on the records of the county assessor; otherwise, service of such citation shall be made as provided by the Colorado rules of civil procedure for the service of summons. Such citation shall also be posted in a public place in the county courthouse in the county in which said land is located. The complaints were reported to the WCDPHE on April 13, 2018, April 16, 2018, and April 23, 2018. In response to the complaints received, the WCDPHE conducted an inspection of the property and the surrounding area on April 13, 2018, April 14, 2018, and April 25, 2018. The purpose of the inspections was to determine the impact of fugitive dust blowing offsite from the property owned by Mile 250 LLC. Based on the inspection of the property and the volume of complaints received, the following observations were made: The property that is a source of soil erosion and blown dust is not protected from wind erosion by plant growth or cover. The complaints were received from residents who are primarily downwind from the property. Winds are generally from the N -NW. All complaints received by the WCDPHE were from complainants who reside in the Serenity Ridge subdivision. This subdivision is located directly South of parcel no.: 106122300017. The Serenity Ridge subdivision is located within the Town of Berthoud. The property is located in unincorporated Weld County in the C-4 Zone district and the permitted proposed use is a motorcycle, ATV and bicycle recreation facility. The facility was not in operation at the time of any inspection. It was reported that the facility has not yet been in operation in 2018. Photos taken onsite during the April 25, 2018 inspection show that the subject property is devoid of vegetation and that the property is experiencing windblown erosion. Photos received from complainants show blowing dust during the April 17, 2018 high wind event as well as dust deposited on landscaping, home exteriors, and home interiors from the same event. The property may benefit from re -seeding the exposed dirt areas adjacent to the riding track and water truck spraying as methods of suppressing fugitive dust. Blowing Dust at Motocross Track Hi Larry, It was nice to talk to you this morning I'll try to go through a brief history of the recent complaints at the facility The property is located at 20125 Interstate 25 Frontage Rd and is owned by Mile 250 LLC and the contact for the owner is Bob Erlich (970) 381-1396 This property is zoned as commercial property and was operated previously as a motocross track The facility has not been in operation as a motocross track since November 2017 The property is divided into two parcels The West parcel sits along WCR 7 on the NE corner of WCR 42 directly North of the Serenity subdivision which is where the complaints originate from We started receiving complaints regarding blowing dust at the facility on 4/13/18 when we had that week of high winds The complaints were received through 4/18/2018 Currently on the West parcel, there is an oil and gas rig but otherwise, there is no other activity The owner told me that they had previously hired a helicopter to come and spray for weeds on the entire property but stated that they would stop having that done to allow for weeds to grow back They are going to be sent a letter requesting their presence at a hearing in front of the Board of County Commissioners that will likely take place on May 16, 2018 You will probably be cc'd on the letter as well as the soil conservation district I know that commercial property does not usually fall under your prevue but we are wondering if you would have any recommendations on how property of this type could be managed to help prevent wind erosion and dust blowing offsite? While larger particles may sting and irritate your eyes, smaller particles, known as PM10 and PM2.5, are of most concern to people's health because they are too small to be filtered out by your nose and your body's other natural defenses. This fine dust is inhaled deep into your lungs where it can cause increased problems like; lung irritation, emphysema, asthma, bronchitis, heart disease, and allergic reactions. Fugitive Dust Regulations Dust that is generated and released into the air as a direct result of man's activities, which includes materials left by man exposed to wind, is called "fugitive particulate emissions". The Weld County Department of Public Health and Environment (WCDPHE) uses the Air Quality Control Commission Regulation No. 1 to evaluation dust emissions at facilities around Weld County. Regulation No. 1 requires that fugitive particulate emissions do not travel off of the property from which they originate. A certified observer is required to make the determination of whether visible dust is traveling off property. The observer must be positioned with the sun at their back, and cannot make a determination when windspeeds are in excess of 30 mph. 2 5/15/2018 Complaints Received April 13, 2018 - Received complaint of fugitive dust from the property blowing South into the Serenity Ridge subdivision. It is steeply angled and consists primarily of fine sand. We advise hydroseeding with a sterile triticale in a two stage process. The first stage applies seed, fertilizer, tackifier and a small amount of hydro -mulch to promote better contact with the soil. The second stage applies the balance of the hydro -mulch and tackifier. This can be scheduled and completed within 2 weeks, depending on weather. 2) COVER CROPPING THE REMAINING AREA- The recommended cover crop is sorghum when a late May or early June planting is planned. Sorghum grows well in the heat and provides some weed suppression as well as erosion control. This will be applied with a seed drill. 3) DORMANT SEEDING OF GRASS ON TOTAL AREA- The recommended grass to plant during winter would be an aggressive dryland pasture mix. This consists of several varieties of wheatgrass and some wildrye. This will be applied with a seed drill into the residue of the cover crop, except in steep areas where the seed will be broadcast.
