RE: APPROVE LETTER OF AGREEMENT CONCERNING DESIGNATED EMERGENCY
RESPONSE AUTHORITY (DERA) AND AUTHORIZE CHAIR AND DIRECTOR OF
OFFICE OF EMERGENCY MANAGEMENT TO SIGN - MOUNTAIN VIEW FIRE
RESCUE DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Letter of Agreement Concerning the
Designated Emergency Response Authority (DERA) from the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Office of
Emergency Management, to Mountain View Fire Rescue District, commencing upon full execution
of signatures, with further terms and conditions being as stated in said letter of agreement, and
WHEREAS, after review, the Board deems it advisable to approve said letter of
agreement, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Letter of Agreement Concerning the Designated Emergency Response
Authority (DERA) from the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Office of Emergency Management, to the
Mountain View Fire Rescue District, be and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair and the Director of the Office
of Emergency Management be, and hereby are, authorized to sign said letter of agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of October, A.D., 2018.

Brief description of the problem/issue:
Commissioners, the state requires the BOCC to identify a Designated Emergency Response Authority (DEAR)
for unincorporated areas of each County. The BOCC identified the Office of Emergency Management as the
Department in the County to handle hazmat issues by resolution. As the County continues to grow with risks
related to hazmat the Mt View Fire Department has joined with the Boulder County Hazmat Authority to deal
with Hazmat Response. As you know a part of Mt View's Fire District is in Weld County, the attached
agreement letter provides the ability for Mt View Fire to respond to hazmat incident within their district and
utilize the Boulder County Hazmat Authority resources for support.
We (Weld County OEM) will maintain DERA designation and still be responsible for costs associated with
hazmat spills and cleanup, follow up on paperwork etc. Our Office will also maintain communication with the
Boulder Hazmat Authority on all hazmat spills and coordination meetings.
I believe this is a good step moving forward and does not cost the County any funding utilizing this agreement
letter. Frank Hauge has reviewed the letter from the County Attorney's Office and did not see any issues with
the letter.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
Agree to the letter and allow Mt View Fire District to work as an extension of OEM for the DERA in their
District. The letter will be presented to the BOCC for signature after Mt View and I sign the letter.
The other option is become a part of the Boulder Hazmat Authority through the IGA. This will cost us an
estimated 10, 000.00 a year.

Re: Designation under Designated Emergency Response Authority ("DERA")
Dear Chief Beebe:
Under §29-22-102, C.R.S., I perform the duties of the DERA for Weld County. A portion of the Mountain
View Fire Rescue District ("District") sits in Weld County.
The DERA statute requires me to provide for a hazardous materials response within Weld County. The
statute further states that I may accomplish this task through agreements with public agencies or
private parties.
With your participation in the Boulder County Hazardous Materials Response Authority, it is now clear
that the District is in the best position to initially respond to hazardous materials incidents in the portion
of Weld County within the District. Accordingly, I hereby designate the District as my representative
under DERA authority to respond to hazardous materials incidents within the Weld County portion of
the District and to also function as incident commander for such responses.
I fully expect the District to rely on its participation in the Boulder County Hazardous Materials Response
Authority to bring necessary skills and assets to any response. I will support the District in execution of
these responsibilities.
By this letter I am not pledging any financial aid nor creating any relationship not contemplated by the
DERA statute. Neither Weld County nor the District are waiving any rights or privileges by virtue of this
letter. The relationship created by this letter may be terminated by either of us upon 10 -days written
notice.
