Chapman, CTSI Executive Director RE: Personnel Actions RECEIVED NOV 1 3 2018 WELD COUNTY COMMISSIONERS With the election now complete and the pending change of some elected officials, the exposure and possible claims concerning personnel actions may increase due to the desire of the newly elected officials to restructure their departments. For this reason, on behalf of the Colorado Counties Casualty and Property Pool (CAPP), I would like to remind you of the extreme potential of litigation and the tremendous costs associated with improper personnel actions. In addition, as you know, the pool has a $10,000 deductible for these types of claims. At this time, I would like to request that you readdress this issue with all elected officials (incumbents and newly elected) before the newly elected officials take office. Also, please advise all those concerned that they should consult with your legal counsel before implementation of any personnel action (termination, demotion, change of classification, etc.) so that a review of proper procedures may be provided to assist them in the process. Be advised that some personnel actions may produce a liability exposure to you and/or the newly elected official as individuals and/or as representatives of the county. As we have discussed with you in previous meetings, it is our intent to help you minimize the risk and exposure to your county and CAPP whenever possible.
