HomeMy WebLinkAbout20180385.tiffHEARING CERTIFICATION DOCKET NO. 2018-10 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0068, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY SIX (6) MILES LONG (20 -INCH NATURAL GAS PIPELINE ORIGINATING AT THE FORT LUPTON GAS PLANT [USR17-0059] AND TERMINATING AT AN INTERCONNECT) IN THE A (AGRICULTURAL) ZONE DISTRICT - DISCOVERY DJ SERVICES, LLC A public hearing was conducted on February 7, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Clerk to the Board, Esther Gesick/Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Evan Pinkham Public Works Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated December 28, 2017, and duly published January 2, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0068, for a greater than 12 -inch high pressure natural gas pipeline approximately six (6) miles long (20 -inch natural gas pipeline originating at the Fort Lupton Gas Plant [USR17-0059] and terminating at an interconnect) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the applicant's intent to construct and operate a natural gas pipeline named the Milton West 20 -inch Pipeline which will connect to the Fort Lupton Gas Plant and to the Milton Hudson Interconnect. He stated this pipeline will increase the overall pipeline transfer capacity of natural gas, reduce the burden on Weld County roads, and promote safer transport in the County. Mr. Ogle stated the pipeline will be constructed within a permanent easement of 30 feet and include above ground equipment to include a launcher at the Fort Lupton Gas Facility and a launcher at the Milton Hudson Interconnect. He reported the pipeline to be within the three (3) mile referral area of the Towns of Lochbuie and Hudson, and the Cities of Brighton and Fort Lupton, and he reviewed the referral responses from these municipalities. He states the applicant has attained private easements negotiated with private land owners and he reviewed the pipeline route, safety and emergency procedures, maintenance, pipeline markers at intersections, and Department of Transportation regulations. He stated referrals were sent to 18 agencies and five (5) referral responses were received with comments that have been incorporated into the staff recommendation. He displayed the site map and entered the favorable recommendation of the Planning Commission into the record as written. e Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements and reported the County roadways that the pipeline will cross to include CRs 12, 35, 37, 41, CR 12 Section Line, and CR 39 Section Line. He stated, during construction, the maximum number of vehicles proposed is 20 per day with five (5) semis, and the Department of Public Works is requiring an Improvements Agreement and submittal of evidence of a Right -of -Way Permit for any work performed in the rights -of -way. • Hayley Balzano, Public Works Engineer representative, presented the drainage and grading requirements and stated this application meets exception #1.A.5 for pipelines and she reviewed the typical Conditions and Development Standards related to Engineering. El Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions, stating portable toilets and bottled water are acceptable during construction and after construction, and no other services will be required. He asserted an Air Emissions Permit may be necessary if over 25 acres are disturbed, and he stated DS #11-17 address Environmental Health items. • Matthew Norton, Compliance Manager, represented the applicant and introduced the members of the team that were present. He provided a PowerPoint presentation and reviewed the company history, hiring practices, experience in pipeline construction, and Goal Zero Philosophy which means zero incidents, zero NOVs and zero lost time incidents. He continued by reviewing capital, safety and design, emphasized the pipelines are built to Department of Transportation (DOT) Standards, exceed state and federal depth cover standards, have x-rays on all welds, protected coatings on pipelines, markers at road crossings, hydrostatic testing, and he stated they had a recent construction audit with no findings. Mr. Norton stated the pipeline is monitored 24/7/365 and he reviewed the qualifications of operators, the stop work authority practice, leak detection and monitoring, block valves at several locations to isolate concerns, and stated they are a member of call before you dig, and promote rigorous pipeline integrity. He mentioned they want to be good neighbors and have volunteered the water tanks at the plant for fire department use, if needed, and they participate in Weld County LEPC meetings, and work with other operators. He stated this project consists of 32,000 feet of 20 -inch pipeline, which is about six (6) miles, and will transport only natural gas to the gas plant and then process it and deliver it to other parties for use. Mr. Norton displayed a map of the pipeline route and stated pipelines are the most efficient way to move product. He noted 75 percent of the homes and businesses in Colorado are heated with natural gas and Discovery is proud to be a part of that service. He discussed the planning that goes into a pipeline project to include route selection, attaining rights -of -way, and communicating with surrounding property owners and considering the topography and biological eco-systems that could be impacted. He asserted reclamation is a priority and they want to focus the project on safety of the neighbors and stewardship of the land. • No public testimony was offered concerning this matter. 2018-0385 PL2522 HEARING CERTIFICATION - DISCOVERY DJ SERVICES, LLC (USR17-0068) PAGE 3 In response to Chair Moreno, Mr. Norton indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed. Commissioner Freeman moved to approve the request of Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0068, for a greater than 12 -inch high pressure natural gas pipeline approximately six (6) miles long (20 -inch natural gas pipeline originating at the Fort Lupton Gas Plant [USR17-0059] and terminating at an interconnect) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Cozad, and it carried unanimously. There being no further discussion, the hearing was completed at 10:51 a.m. This Certification was approved on the 12th day of February, 2018.
