RE: RECORDED EXEMPTION NO. 236 - GEORGE BAIN and ELIZABETH BAIN.
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 29th day of November, 1976, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that a
certain parcel of land, being the property of George Bain and
Elizabeth Bain, 3724 Weld County Road #6, Erie, Colorado 80516,
being more particularly described as follows:
A tract of land located in the NEa, Section 27,
T. 1N. , R. 68W. , 6th P.M. , Weld County, Colorado,
more particularly described as follows :
Beginning at the northwest corner, E1/2, NE4, said
Section 27, considering the west line of the Ek,
NEa, said Section 27, to bear North 0° 00 ' 00"
East with all other bearings relative thereto;
thence South 0°00 ' 00" East, a distance of
1, 319. 11 feet;
thence South 89°43 ' 50" West, a distance of
471. 25 feet;
thence North 0°00 ' 20" West, a distance of
1, 001. 36 feet;
thence North 89°48 ' 50" East, a distance of
11. 25 feet;
thence North 0°00 ' 00" East, a distance of
318. 43 feet;

The north 30 feet of the described parcel shall
be for County Roadway purposes, said parcel con-

shall include the 30 feet for County Roadway.

pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended, and Section 2-1A (3) of the Weld County
Subdivision Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove

to review by the County Engineer of Weld County, Colorado, as
to the mode of access to Weld County Road No. 6 from said real
estate.

RE : Lot Size Variance #37 and Recorded Exemption 236
Dear Commissioners:
The attached application, plat, and related items are in
reference to a request by George Bain for a lot size vari-
ance and a recorded exemption. The parcel of land in
question is described as part of the NE* of Section 27,
T1N, R68W of the 6th P.M. , Weld County, Colorado. Said
property is located 2-3/4 miles east and 1 miles south
of Erie and immediately east of Leisure Living Subdivision.
The subject property contains 14. 195 acres of predominantly
Class III irrigated soils. The request is to split the
property into parcel of 9.665 acres and 4.53 acres. Mr.
and Mrs. Bain currently reside on the proposed 9.665 acre
parcel . The 4. 53 acre parcel is being created for residential
purposes. The parcel in question is currently surrounded on
three sides by residential development; Carol Heights and
Leisure Living Subdivisions are developed immediately adjacent
on the west and Baker Subdivision lies immediately northeast
of the Bain' s property.
On November 26, 1976 the Weld County Board of Adjustment
granted a variance of 155 feet from the requirement of 180
feet of lot frontage onto a public road as required in Section
3. 14 of the Weld County Zoning Resolution, and Section 9-4(A) (3)
of the Weld County Subdivision Regulations.

Based upon the information submitted and the adopted policies
in the County, the Planning Commission staff recommends approval
for the following reasons:
1. Due to the size of the subject parcel ( 14. 195 acres) and the
existing residential development on three sides of the pro-
perty, development of the parcel for agricultural purposes
and especially for any intensive agricultural operation
would not be compatible with the existing land uses in the
area. The splitting of the property into two lots for
residential development would be a more compatible land use
with the existing residential development on the surrounding
properties.
2. The Town of Erie has indicated they have no opposition to the
request and feel the development would be consistent with
surrounding land uses.
3. The request complies with the provisions of Section 9-4 (A)
of the Weld County Subdivision Regulations .

RE : Applications for a Lot Frontage Variance, Lot Size
Variance and a Recorded Exemption on a parcel of
land described as pt. of the NE4 of Section 27, T1N,
R68W of the 6th P.M. , Weld County, Colorado.
Dear Mr. Gain :
Your applications and related materials for the above
described requests are complete and in order. I have
tentatively scheduled the hearing by the Board of Adjust-
ment on your lot frontage variance request for November
26 , 1976 at 2 : 00 P.M. If the lot frontage variance is
approved by the Board of Adjustment , then the Board of
County Commissioners will hear and decide upon your
applications for a lot size variance and a recorded
exemption the following Monday which is November 29, 1976
at approximately 9: 30 A.M. Both meetings will take place
in the County Commissioners' Rearing Room, First Floor,
Centennial Center, 915 10th Street , Greeley, Colorado.
It is recommended that you and/or a representative be there
to answer any questions either Board might have with respect
to your applications.
If you have any questions with regard to the above matter,
