The claims of Geo 0 Stevens and Hobert Frazier for services as Justice and Constable , resew pectively, were presented, examined and on motion disallowed and ordered placed on file . Coroners Account of the Inquest held upon the dead body of Wk. H. Davis was presented , examind and on motion ordered allowed for the amount stated thereon. r n The official Bond of Homer Sins as Constable in and for Justice precinct No . 5 , Evans , in re the penal sum of $1000 . was presented, and after carefully consideraing same and believing the sureties thereon to be ample and sufficient , on motion ordered that the same be approved , re- corded and placed on file . Bradfield , S G Woland and E H Abbott , viewers appointed April 6 , 1907 to view the following described line of road, viz: -- Commencing at the N E corner of Section 34, Tp . 8N . , R. 66 West ; running thence West to the N W Corner of section 32 said Township and Range . ( )2nd , Beginning again at the S E Corner of section 5 , Tp . 7N . , Range 66 West ; running thence North on section lines four miles to the S W Corner of section 16 , Tp . BN. , R. 66 West . 3rd . Commencing again at the S E Corner of section 33 , Pp . 8N . , R. 66 West ; running thence West TWO miles along the Tp . line to the S W Corner of section 32, Tp . 8N . , R. 66 West was presented to the Board when the following action was taken and entered of record , to-wit: -- The Board having carefully considered the report of the viewers herein, as well as all ob- ay jections made thereto, and finding the report correct as to form, and believing the public good I requires the laying out of the road as recommended by the viewers, it Was on motion ordered that the report be approved and adopted, and the road therein described and recommended by the viewers be and is hereby declared a public highway . The clerk is directed to record the report , plat the road as granted, draw warrants in favor of parties for damages awarded, and cause notices to be posted of opening of said road, and notify the road overseer of the proper district to open said road to travel in sixty days as required by law. Ili IN THE MATTER OF REDEMPTION OF TAX SALE CERTIFICATES . On motion of Commissioner E J Estes „ duly seconded by Commissioner Bradfield the following resolution resolution was unanimously passed and adopted, viz: -- NlEAS , On this day Ralph Voorhees of Denver , Colorado , appeared before this board and offered the sum of *500 00 in full for the redemption of tax sales heretofore made upon the dates and property ..hereinafter specified and also agreed to procure and have executed to the county, quit claim deed from the owner and holder of the SWe N of section 23 , Pp . 12N . , R. 58 of the 6th p . m. , which said property is held under tax deed erroneously issued, AND WHEREAS, it appears to the Board that all of the lands hereinafter described were bid in at the times of the sales thereof for taxes by the then acting County Treasurer of Weld County, Colorado , and that the same are still unredeemed and the certificates therefor unassigned, and that the acceptance of said offer will be to the best interests of Weld County, NOW THEREFORE, It is ordered that on the tender and payment to him of the sum of $500 . by said Ralph Voorhees or his agent , as well as the delivery to him for the county of a Quit Claim deed to the property hereinbefore described, the County Treasurer of Weld County shall issue redem- ption certificates to any persons by said Voorhees directed for the following tax sales on the 493 following lands , to-wit : --The N. E.e section 5 , Tip . 5N . , R. 65 West is erroneous in as much as there is no such description of property in Weld County, therefore it was on motion ordered that the County Treasurer be and he is hereby authorized and directed to issue to Weld - County his redemption certificate therefor to the end that the same may be removed from the tax-rolls . / 7 / IN THE MATTER OF ASSIGNMENT OF TAX SALE CERTIFICATES #100 and 103 , 1896 SALES . The application of William P. Allen for an assignment to him of Tax Sale Certificates Number 100 and 103 , sales of 1896 for the taxes of 1895 of the S.W4 of section 26 , Pp . 10N . , R . 62 West , for which he offered to pay the sum of $121 .68 was then taken up for consideration, and after duly , regularly and faithfully considering same and being well advised in the, premises , on motion it was ordered that the county Treasurer be and he is hereby authorized and directed to issue his assignment upon payment to him of the proper fees .therefor . On motion the following resolution was unanimously passed and adopted ,viz: WHEREAS , The Greeley & Northern Railway & Utility Company has under franchise , privilege and easement heretofore granted by the Board of County Commissioners of Weld County , Colorado , partially constructed its railroad grade along the West side of the county road leading from the south City limits of the city of Greeley to the South side of section 17 , Township 5N . , R. 65 West of the 6th p . m. NOW THEREFORE, Be It Resolved that said West side of said portion of County Road is hereby fixed as the right of way , easement and privilege granted to said The Greeley & Northern Railway i road aforesaid . Provided However that said right of & Utility Company for that portion of the county way and easement along said road shall at no point come within twelve and one half feet of the lot lines upon said highway . Ana now the matter of the absence of Albert W Bone , the duly elected and qualified constable in and for Justice Precinct No . 35 having been brought to the attention of the Board , and the Board having been sufficiently advised in the premises finds that the said Albert W Bone has removed from the State of Colorado and to the State of Missouri there to remain for an indeffinite period; that he has been absent from the state for more than two months and that im- mediate necessity exists for the appointment of some qualified person to perform the duties of con- stable in and for said Ault Justice Precinct No . 35 . After carefully considering the proposition set forth .n the following agreement submitted by Commissioner J Y Munson of Larimer County, and this Board believing it to be to the best intepts of Weld County that such a division of the roads be made , it was on motion ordered that Commissioner E J Estes sign said agreement in conjunction with Mr , Munson, and that the Clerk of this Board spread upon these records said agreement in full . Following is the agreement :-- Fort Collins , Colo . , Aug . 14, 1907. To , the Board of County Commissioners of Larimer and Weld Counties . , R Gentlemen: -- In the matter of the division of the roads on the county line between Weld and Larimer Counties extending through Township 4 , Between ranges 68 and 69, and between Townships 4 and 5 , range 68, and four miles in Township 5 , between ranges 67 and 68, the undersigned went over the road together on the 20th day of May , and we find that the south six miles of said road between Ranges 68 and 69 . is much more expensive to maintain than the balance of said road . Upon this portion of the read the County of Larimer has expended , since the first of January, 1907, $262 .25 , no portion of which has been paid by Weld county . We have decided to recommend that the following division of the road shall be made; that Larimer County shall take exclusive charge of that six miles of the road extending between ranges 68 and 69 in Township 4, and the West Two miles between Townships 4 and 5 , Range 68 , and that Weld County shall take exclusive charge of the balance of said Road; and that one half of the above amount which has been expended by Larimer county upon that portion of the road assigned to Larimer county shall be charged to Weld County . A petition was then presented praying for the appointment of I D Hull as Justice of the Peace in and for said justice precinct , and after duly , regulary and faithfully ly considering said petition - and being well advised in the premises , it was on motion ordered that the prayer of petitioners be and the same is hereby granted, and that I D Hull be and he is hereby appointed as Justice of the Peace in and for said Justice Precinct to fill the vacancy just caused by the resignation of Mr . 555 Griffin; Provided, first , that he will qualify as by law required . On motion of Commissioner S A Bradfield , duly seconded by Commissioner R. W DeVinny the following resolution was unanimously passed and adopted, viz: -'- WHEREAS , Voting Precinct Number 46 , known as Nunn Precinct is now included within and forms a part of Justice Precinct No . 35; and in the Judgment of this Board it should be seggregated and ta- ken therefrom and, by reason of its population, should be , and constitute in itself , a Justice pre- _ cinct of this county , THEREFORE BE IT RESOLVED that the territory included within the boundary lines of Election Precinct Number 46 as heretofore established be and the same is hereby seggregated and withdrawn from Justice Precinct Number 35, and that the same is hereby established and declared and shall be known as Justice Precinct Number 46 of said Weld County with the.' same territorial boundaries as Nunn voting Precinct Number 46 , and be it further RESOLVED that a vacancy in the office of Justice of the Peace and Constable within and for said Justice Precinct Number 46 aforesaid are hereby declared to exist by reason of the seggregation from the former territory of Justice Precinct Number 35 and that a petition signed by Horace P.
