RE: GRANT OF CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
CUD-COMMERCIAL UNIT DEVELOPMENT DISTRICT FOR PETE W. SASS .
WHEREAS , the Board of County Commissioners of Weld County,
Colorado,cfpursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on October 5th, 1977,
in the Chambers of the Board of County Commissioners of Weld
County, Colorado for the purpose of hearing the petition of
Pete W. Sass , 25973 Weld County Road No. 17, Johnstown, Colorado

to CUD-Commercial Unit Development District, for a tract of land
located in Part of the Ni of the Eh of the NE4 of Section 29 ,
Township 5 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows , to-wit:
Beginning at the Northeast Corner (NE Cor) of said Section 29,
and considering the East line of said Section 29, as bearing
Southt0°00'00" West, with all other bearings contained herein
raltive thereto;
Thence South 00°00'00" West, along said East line, 30.00 feet;
Thence North 89°00'50" West, 30.00 feet to the True Point of
Beginning; Thence South 00°00'00" West, 208.67 feet;
Thence North 89°00'52" West, 208.75 feet;
Thence North 00°00'00" East, 208.67 feet;

Said described parcel of land contains 1.000 acres, more or

WHEREAS , the petitioner was present and was represented by
legal counsel, and
WHEREAS, the Board of County Commissioners heard the state-
ments of the petitioner and others in support of the application
for Change of Zone, and
WHEREAS, the Board of County Commissioners heard and reviewed
the recommendation of the Weld County Planning Commission for
denial of the Change of Zone, and
WHEREAS , Section 8 . 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a Change of Zone upon the showing by the petitioner of certain

WHEREAS, the Board of County Commissioners finds that the
request for Change of Zone meets the conditions set out in
Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of Pete W.
Sass for a Change of Zone from A-Agricultural District to CUD-
Commercial Unit Development District, on the above-described
tract of land, be, and hereby is , granted based upon the follow-
ing findings of fact, and conditioned upon the preparation of
a suitable set of Development Standards for the Unit Development
Plan.
BOARD OF COUNTY COMMISSIONERS
FINDINGS OF FACT
1. The Board of County Commissioners hereby finds that the re-
zoning of the above-described parcel of land is justified under
Section 8. 3 of the Weld County Zoning Resolution on the grounds
that changing conditions in the area now justify a new classi-
fication. The Board finds that the evidence presented by the
applicant of changing methods of farming and increasing complexity
of farm equipment necessitate the establishment of a commercial
zone on the described parcel.
2. The Board further finds that the requested Change of Zone is
justified under Section 8 . 3 of the Weld County Zoning Resolution
and that the presence of buildings suitable for the proposed use
gives the parcel unique characteristics distinguishing it from
the surrounding land.
3. The Board also finds that the rezoning request does comply
with the policies contained in the Weld County Comprehensive Plan
relating to commercial development in that the applicant has shown
that the proposed commercial use cannot reasonably be located in
an urban area due to difficulties presented by the movement of large
farm machinery through urban areas. In addition, the Board finds
that the establishment of such commercial service would be im-
practical or unprofitable within a municipality.

I hereby certify that pursuant to a notice dated August 31,
1977, duly published September 7 , 1977 and September 21 , 1977 ,
in the Greeley Journal, a public hearing was held on the request
of Pete W. Sass for a Change of Zone from A-Agricultural to
C-UD-Commercial Unit Development District. Mr. Sass and his
Legal Counsel, Robert Houtchens,were in attendance and presented
their request. No one in attendance was in opposition to the
granting of the request. After all testimony and evidence was
received and reviewed by the Board, Commissioner Dunbar made
a motion to grant the request subject to the development and
subsequent approval of development standards for the commercial
unit development plan. Commissioner Carlson seconded the motion
for which the vote was called. Commissioners Carlson, Dunbar
and Jacobucci voted aye. Commissioner Roe and Chairman Steinmark
voted nay. The motion carried.
Pursuant to the Charter the three Commissioners, voting to over-
ride the Planning Commission' s recommendation for denial, listed
reasons thereto. All three Commissioners stated that they felt that
significiant change has taken place in the area to warrant a
change of zone, and that the placement of this type operation
in the proposed area rather than within a town would be more
convenient to the users and safer with respect to vehicular
traffic.

August 16, 1977
Section 8. 3 further states, "There must be definite proof that the area
requested for change has unique characteristics which distinguish it
from surrounding lands and thus make its rezoning essential. " Again it
is the opinion of the Planning Commission that the applicant has not
demonstrated that the property in question has unique characteristics
which distinguishes it from surrounding lands.
Additionally Section 8.3 states:
"Furthermore, once a change is made, the Planning Commission must
recognize the precedent which is established, both in the
immediate area and in other parts of the county, for like rezoning
of other lands "similarly situated". "
It is the opinion of the Planning Commission that the approval of this
request would constitute "spot zoning". The approval of this rezoning
request would establish an undesireable precedent in the immediate area
and other parts of the County "similarly situated".
2. It is the opinion of the Planning Commission that the rezoning request
does not comply with the policies contained in the Weld County
Comprehensive Plan relating to commercial development.
The policies utilized to guide commercial development of this nature state:
"1. Commercial development will not be encouraged in the
unincorporated areas of the county unless it can be
shown by the developer that the proposed commercial
use cannot reasonably be located in an urban area.
2. Commercial development designed to serve the agri-
cultural base of the county should be located wherever
practical within a municipality; however, whenever
distance from a municipality makes this an impractical
or unprofitable establishment of such commercial
service, facilities within easy access to each agri-
cultural area will be encouraged."
It is the opinion of the Planning Commission that the applicant has not
demonstrated why the proposed commercial use cannot reasonably be located
in an urban area or how it would be impractical or unprofitable to locate
the commercial activity within an existing municipality.
3, The Planning Comm. has received letters of opposition to this
rezoning request from two of the surrounding property owners,

I talked with Mr. Sass who indicated he had purchased the property from
Mr. Scofield who had operated a weldi_g operation on the property since
1971 . Mr Sass said that the only reason he had located here was because
he thought there would be no problems with the zoning because of Scofield ' s
operation . Mr . Sass said he has put around $40, 000 worth of improvements

I telephoned the Scofield residence and talked with Mrs . Scofield.
She indicated that her husband did have a welding operation on the
property located in the garage while they lived there . He works
_for Hensel Phelps Construction Co . During the evenings and on
saturdays Mr . Scofield did ornamental iron work and minor repairs
on farm machinery .

EXHIBIT "A"
-Present owners, Pete W. Sass and Phyllis E. Sass, purchased the
one acre plat in early June, 1976 from Floyd Scholfield. Prop-
erty is improved with a tri-level home containing 1980 square feet,
and a metal BC steel building 30 ' x 50 ' in size, and contains a
bathroom.
Present owners wish to conduct a machine welding and light manu-
facturing business utilizing the metal building above described.
The former owners used the metal building for a metal shop for
five years prior to the sale of the property.
One hundred percent of the business conducted on this place from
March to early November is agriculturally related. At least 90%
of the business during the remainder of the year is agriculturally
related, and the other 10% consists of light manufacturing.
Repair work consists of repairing irrigation pumps, irrigation pipe,
all types of farm implements, farm trucks, tractors, and everything
used in the agricultural industry. This has been a one-man opera-
tion, but has grown to the extent that two or three persons will
have to be added as extra help during the farming season. The
trade area served by this business includes Loveland, Fort Collins,
Johnstown, Milliken, Berthoud, Greeley, and Severance .
Nearly all of the repair and light manufacturing is done inside
the steel building. Hardly ever is any work done outside the shop.
There is one sign on the outside of the building, which is 3 ' x 6 '
in size, and one on the back of the building which is 3 ' x 10 ' in
size. There are no plans for any additional signs.
This is an industry which is vital to the agricultural patrons in
the trade area. Johnstown and Milliken do not have any machine
shops, and Loveland has only one shop, which is so busy they can ' t
take any more business. The Greeley shops are so busy they post a
seven to ten day delay and this is not practical or tolerable
during the farming season.
One customer is Interstate Irrigation Company, which has an office
in Greeley, -and for whom we make shafts for trenching equipment,
fittings, bearings, bushings, pump shafts and general machine work.
Water is available to this property from the Little Thompson Water
District and the bathrooms are connected with septic tanks . Parking
-area and plan for temporary storage are shown on the plans submitted
herewith.

As owners of land adjoining this tra ct of Mr. Sass, we have
naturally given a lot of thought to his request for commercial zoning
of same. We certainly believe in the gold neighbor policy and d do
not recall our having objected to ether requests for gone changes which
we have received 3•n the past; though they -were probably agriculturally
oriented.
Our investment is quite large in this particular -farm and we expect
that we -will be farming it Tor many years to come. I do not doubt for
a bit but that Mr, Sass will keep it respectably neat in appearance.
This parcel has been sold two ar three times recently and who knows
when it might be sold again and then,what -happens? It can 1-egally get
to lonking pretty bad; this we would not like to see.
Alter due consideration we wish to voice our abjection to any zone
change of this tract. If th-ere is any way of granting Mr. Sass a permit
to "'per-ate the place as he is presently doing, keeping the premises in
presentable condition, earning a living, we have no -objection. I be-
lieve it should be an a non-conforming basis and termination cited upon
hit retirement or sale of the property.

owned by Pete W. and Phyllis E. Sass, hereby petition you to grant

We are in need of the services rendered to farmers in
this community during the farming season which is from March to
early November of the type offered by Pete W. Sass . This is an
industry which is vital to the agricultural patrons in the trade
area. Milliken and Johnstown do not have any machine shops . Love-
land has only one shop, which is so busy they can ' t take any more
business. -There is a shop at Windsor which is owned by McCoy
Construction, but it handles mainly construction work. The Greeley
shops are so busy that they post a seven to ten day delay and this
is not practicle during the farming season.
The Corner Machine and Repair is ideally located for
convenience to the undersigned. There is no place in or near
Milliken or Johnstown or Loveland that is as ideally situated as
is the present location of Corner Machine and Repair.
The points we wish to make are :
1 . This is an agriculturally related business .
2 . We know of no location near any town or municipality
in the trade area for this type of business and it is located in
an area where it is convenient for us to take our work there.

Gentlemen :
We the undersigned , customers of Corner Machine and Repair
owned by Pate W. and Phyllis 3. Sass, hereby petition you to grant
this rezoning request to charge the Zoning District Map so that the
property involved shall be r.e.:oned from A Zoning District to C-PUD
Zoning District.
We are in rimed of the service-s rendered to farmers in
this community during the farming season which in from March to
early November of the type offered by Pete W. Sam. . This is an
industry which is vital to the agricultural patrons in the trade
area. Milliken and Johnstown do not have and, machine shops . Love-
land has only one shop, which is so busy they can ' t take any more
business. There is a shop at Windsor which is owned by McCoy
Construction, but it handles mainly _construction work . The Greeley
shops are so busy that they post a seven to ten day delay and this
is not practicle during the farming season.
The Corner Machine and Repair is ideally located for
convenience to the undersigned. There is nc place in or near
Milliken or Johnstown or Loveland that is as ideally situated as
is the present location of Corner Machine and Repair.
The points we wish to make are :
1 . This is an agriculturullyrelated business .
2 . We know of no location near any town or municipality
in the trade area for this type of business and ft is located .ice
an area whsre it is convenient fair us to take our work there.
There is adequate parking in the area of the shop.
