Home My WebLink About20180468.tiffRESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR SHARING OF 2018 VOTER SIGNATURE VERIFICATION AND REGISTRATION SERVICES AND AUTHORIZE CHAIR TO SIGN - TOWN OF ERIE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement for Sharing of 2018 Voter Signature Verification and Registration Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Clerk and Recorder's Office, and the Town of Erie, commencing February 12, 2018, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement for the Sharing of 2018 Voter Signature Verification and Registration Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Clerk and Recorder's Office, and the Town of Erie, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Between the dates of March 20th, 2018 and April 3rd, 2018 the Town of Erie would like to use election judges that worked for Weld County previously that specialize in Voter Registration and Signature Verification to help conduct the election for the Town of Erie. Due to the state's security requirements, Erie must hire someone qualified to access the statewide voter registration system. We have done this previously for Erie in 2016. There will be no cost to the county and the Town of Erie will be billed after the election for all costs associated with the election. What options exist for the Board? (Include consequences, impacts, costs, etc. of options) Approve the IGA so Erie can utilize the services of the voter registration and signature verification specialist. Parker, CMC Town Clerk Enclosures INTERGOVERNMENTAL AGREEMENT FOR THE SHARING OF 2018 VOTER SIGNATURE VERIFICATION AND REGISTRATION ,SERVICES THIS INTERGOVERNMENTAL AGREEMENT ("IGA") is made and entered into effective as ofthe t a.p day of F toruart- , 2018, A.D. between the COUNTY OF WELD, a political subdivision ofthe State of Colorado, whose address is P.O. Box 758, 1150 O Street, Greeley, CO 80632, hereinafter referred to as, "Weld County," and the Town of Erie, a political subdivision of the State of Colorado, with address of P.O. Box 750, 645 Holbrook Street, Erie, CO. 80516, hereinafter referred to as, "Erie." Both entities may be referred to herein individually as "Jurisdiction," or collectively as "the Jurisdictions." WITNESSETH: WHEREAS, intergovernmental agreements to provide functions or services, including the sharing of costs of such services or functions, by political subdivisions of the State of Colorado, are specifically authorized by C.R.S. §29-1-203, and other sections of the Colorado Revised Statutes, and WHEREAS, Town of Erie is in need of the services of Voter Signature Verification and Registration, and WHEREAS, Weld County employs Voter Signature Verification and Registration Specialists, and said professionals have time available to offer to assist Town of Erie in Voter Signature Verification, and WHEREAS, Weld County is willing to share the services of its Voter Signature Verification Specialists with Town of Erie, pursuant to the terms of this IGA, in order to assist Town of Erie. NOW, THEREFORE, in consideration of the mutual promises and covenants expressed herein, the Jurisdictions agree as follows: 1. Sharing of Voter Signature Verification and Registration Services. Weld County consents to having its Voter Signature Verification and Registration Specialists spend a portion of their time each week assisting the Town of Erie in Voter Signature Verification and Registration. Weld County reserves the right to assign or recall Voter Signature Verification and Registration Specialists as necessary. The Weld County Voter Signature Verification and Registration Specialists shall keep careful track of their time spent. Weld County shall bill Town of Erie for all costs of said professionals on Town of Erie work, at the rate of $17.50 per hour, which shall include all costs for said professional's time and travel expenses incurred by Weld County. The Voter Signature Verification and Registration specialists will be present at the Town of Erie for the 2018 Municipal Election on the following dates and times: aotg-oci) Tuesday, March 20th, 2018 to Friday March 23rd, 2018 from 8:00 a.m. to 5:00 p.m. and Monday March 26th to Friday March 30th , 2018 from 8:00 a.m. to 5:00 p.m. and Monday April 2nd, 2018 from 8:00 a.m. to 5:00 p.m. Tuesday, April 3rd, 2018 (Election Day) from 7:00 a.m. to 7:00 p.m. 2. Employment Status of Voter Signature Verification and Registration Specialists. Nothing contained in this IGA, and no performance under this IGA by the Voter Signature Verification and Registration Specialists shall in any respect alter or modify the status of said professionals for purposes of worker's compensation or their benefits or entitlements, pension, levels or types of training, internal discipline, certification, or rank procedures, methods, or categories, or for any purpose, or condition or requirement of employment. 3. Insurance Coverage for Voter Signature Verification and Registration Specialists. Weld County shall maintain its own insurance coverage, for both liability and damage, for the Voter Registration Specialists. 4. Assignment. This IGA shall be binding upon the successors and assigns of each of the Jurisdictions hereto, except that neither Jurisdiction may assign any of its rights or obligations hereunder without the prior written consent of the other Jurisdiction. 5. No Third -Party Beneficiary. It is expressly understood and agreed that enforcement of the terms and conditions of the IGA, and all rights of action relating to such enforcement, shall be strictly reserved to the Jurisdictions, and nothing contained in this IGA shall give or allow any such claim or right of action by any other or third person on such IGA. It is the express intention of the Jurisdictions that any person other than the Jurisdictions receiving services or benefits under this IGA shall be deemed to be an incidental beneficiary, only. 6. Amendments. Amendments to this IGA may be made only upon unanimous consent by both Jurisdictions. Such consent shall become effective upon its receipt in writing at the addresses set forth above. 7. Termination. Either Jurisdiction may terminate this IGA, with or without cause, upon ten (10) days prior written notice sent to the other Jurisdiction at the address set forth above. 8. Execution of IGA. This IGA may be executed by each Jurisdiction on a separate signature page. Original signature pages will be held by each Jurisdiction.
