HomeMy WebLinkAbout20180833.tiffHEARING CERTIFICATION DOCKET NO. 2018-29 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0060, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - JUSTIN HERSH A public hearing was conducted on March 28, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro -Tern Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Ryder Reddick Public Works Department representative, Evan Pinkham Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 12, 2018, and duly published February 15, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Justin Hersh, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0060, for one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Ryder Reddick, Department of Planning Services, presented a brief summary of the proposal and stated the existing second dwelling was approved under USR-1062, on December 11, 1995; however, there was a stipulation that the USR may not be transferred to any successor. Mr. Hersh is a successor and has an active Zoning Violation, ZCV17-00192, due to the aforementioned reason, and needs a new USR Permit for the second dwelling to comply. Mr. Reddick reviewed reasons for compatibility and stated the second dwelling would allow the applicant to house friends and family or be used as a rental for additional income. He reviewed the USRs within one (1) mile of the site and stated there has been no correspondence received regarding this application. He reported the site to be located in the three (3) mile referral area of the Town of LaSalle, reviewed surrounding uses, displayed images of the site and adjacent lands and entered the favorable recommendation of the Planning Commission into the record as written. 12 Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements and stated the site is accessed from County road 43. He provided the average daily traffic counts to include truck percentages and reported the traffic narrative cc. Mr. Pinkham stated there is no tracking control or Improvements Agreement required; however, the applicant does need to obtain an Access Permit. In response to Commissioner Cozad, Mr. Pinkham confirmed there was no Access Permit required for the previous USR; therefore, the applicant needs to apply for an Access Permit, at no additional charge, for the existing access. • Hayley Balzano, Public Works Engineer representative, presented the drainage and grading requirements, and stated this site is excepted from the requirement for a drainage report and detention pond design. U. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating Central Weld County Water District provides water service to both homes and each home does have a permitted septic. • Justin Hersh, applicant, stated she and her husband grew up in the country and simply want to live on the farm and raise their kids. She explained they found out they needed a permit, so they are going through the process. Ms. Hersh stated they want to use the second dwelling to rent out to family that can help out with the farm and maintenance of the property. ID No public testimony was offered concerning this matter. • In response to Chair Moreno, Ms. Hersh stated she has reviewed the Conditions of Approval and Development Standards and agrees with them. • Commissioner Kirkmeyer recommended deleting Conditions of Approval (COA) #1.A and #4. Commissioner Cozad suggested removing COA #1.6.6. Commissioner Freeman suggested deleting Development Standards (DS) #6 and 7. The Board agreed to the aforementioned changes. • In response to Chair Moreno, Ms. Hersh indicated she has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. IR Commissioner Kirkmeyer moved to approve the request of Justin Hersh for a Site Specific Development Plan and Use by Special Review Permit, USR17-0060, for one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
