RE : APPROVAL OF CONDITIONAL USE PERMIT NO. 28 : 77 : 5 FOR A MOBILE
RELAY STATION ON A TRACT OF LAND IN THAT PORTION OF THE NW4
OF SECTION 14, TOWNSHIP 3 NORTH, RANGE 61 WEST OF THE 6TH P.M. ,
WELD COUNTY, COLORADO - CORNHUSKER FARMS/MOTOROLA C & E ,
1842 17TH AVENUE, GREELEY, COLORADO 80631.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 7th day of September, 1977,
at the hour of 9 : 00 o' clock A.M. , for the purpose of hearing the
application of the Cornhusker Farms/Motorola C & E, for the granting
of a Conditional Use Permit for a mobile relay station on the
following described real estate, to-wit:
That portion of the Northwest Quarter of Section 14 ,
Township 3 North, Range 61 West of the 6th P.M. ,
Weld County, Colorado more particularly described
as follows:
BEGINNING at the Northwest corner of said North-
west Quarter; thence along the West line of said
Northwest Quarter, South 1565. 65 feet to the TRUE
POINT OF BEGINNING: thence continuing South 227 . 45
feet; thence East 225. 95 feet; thence North 227 . 45
feet; thence West 225 . 95 feet more or less to the
TRUE POINT OF BEGINNING.
The above described parcel contains a gross acreage
of 1. 18 acres more or less.
WHEREAS , the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of the
Conditional Use Permit for a mobile relay station, and
WHEREAS, Section 3. 3.D. 4. r. of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District on
the grant of a Conditional Use Permit by the Board of County Com-
missioners , and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully in-
formed and satisfied that the request for a Conditional Use Permit
for a mobile relay station on the hereinabove described real

estate, complies with all of the conditions as set out in Section
3. 3.D. 2. of the Weld County Zoning Resolution,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
Cornhusker Farms/Motorola C & E, 1842 17th Avenue, Greeley,
Colorado, 80631 , for a Conditional Use Permit for a mobile relay
station on the hereinabove described tract of land, be , and
hereby is, granted, subject to the Development Standards contained
in the Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the reasons for approval contained
in the Planning Commission Recommendations dated September 7 ,
1977 , be, and hereby are, incorporated as the findings of fact
_of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
-and seconded, adopted by the following vote on the 12th day of
September, A.D. , 1977.

Be it Resolved by the Weld County Planning Commission that the
application for Mobile Relay Station
covering the following described property in Weld County,
Colorado, to-wit:

Commissioners for the following reasons:
1. The request -is in conformance with the Weld County Comprehensive
Plan and the intent clause in the Agricultural District , Section
3. 3(A) of the Weld County Zoning Resolution, since it would be

Compatibility with the surrounding area, harmony
with the character of the neighborhood and existing
agricultural uses, need for the proposed use, its
effect upon the immediate area, its effect on future
development of the area and the health, safety, and
welfare of the inhabitants of the area and the
County. "
This determination is based upon the following :
A. The Weld County Health Department has indicated the
proposal is in compliance with all applicable Weld County
and State Health Standards and Regulations.
B. The Weld County Engineering Department has indicated they
were unable to identify any engineering problems with
this request .
C. The Colorado Geological Survey has indicated that geologic
constraints pertaining to this development are minimal
and they have no objections to the approval of this request.
D. To date, our office has not received any opposition from
any of the surrounding property owners.

Cornhusker Farms/Motorola C & E - CUP
DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel shall be a
mobile relay station and tower approximately 170 feet in
height and all uses permitted by right in the Agricultural
District as set forth in Section 3. 3(B) of the Weld County
Zoning Resolution.
2. The Conditional Use Permit area shall be maintained in such
a manner so as to prevent soil erosion, fugitive dust , and
the growth of noxious weeds.
3. The Conditional Use Permit shall be limited to the plans
submitted and governed by the development standards stated
above and all applicable Weld County regulations. Any changes
to the plans and/or development standards shall require
approval of another Conditional Use Permit before such
changes shall be allowed.

DISCUSSION: Mr. Hubbard explained his request for wishing to place
a two-way radio mobile relay station on Wiggins Hill . The station
will be for commercial use only and will be 150 ' high with a 20 '
antenna. Mr . Hiatt asked if there has been a change regarding the
system of lighting the tower and Mr . Hubbard stated that the tower
was being erected according to FAA standards . Red lighting will be
used . Tom Honn then read the staff recommendations and Development
Standards . Mr. Hubbard stated he agreed with the Standards.
MOTI02: : Be it therefore resolved to recommend approval with the
Development Standards to the Board of County Commissioners. Motion
by Percy Hiatt , seconded by Ben Nix. A vote of "aye" by Percy
Hiatt , Ben Nix, Frank Suckla, Jerry Kiefer , Chuck Carlson , Harry
Ashley , Marge Yost , Bette Kountz , Irma White . Motion carried.

DISCUSSION: As there was no representation from the church , Tom
Honn read the letter received from Pastor John Kingrey which
explained the reason for the request for an expansion of the
church. The letter stated that the present church is not large
enough to facilitate Sunday School and fellowship . They also need
a Sunday School office and a larger pastor ' s study . He then read
the staff recommendation and Development Standards . There was no
further discussion .

Mr, Honn,
In reference to our application for a mobile relay station on the
Wiggins Hill, I believe all requests have been met regarding the
Conditional use Permit and Building Permits so this can be brought
before the Planning Commission.
Motorola is asking for these permits to install and operate a Two-
Way Mobile Relay station on the Wiggins Hill to increase Mobile

1. Lease of site. Lessor leasesitite described o t the r•'vetsc .,ide to Mototol:t'(herein called Motorola).
2. Use of Site. The site is to be used for for installation, operation and inointenancc of two-war radio
equipment, including base sty:lions, antenna poles or masts, cabling or wiring, and accessories used there-
with. Motorola and its sub-tenants end licensees shall have the unrestricted right to enter or leave the
site at all reasonable times. Motorola may sublet or lizeusc•others to use it, and may make minor altera-
tions to it. All equipment or other property attached to or otherwise brought onto the leased site shall at
all times be personal property.
3. Term. The term of this lease is indicated on the reverse side. Motorola shall have the option to renew
this lease fat- a like period by mailing written notice to Lessor at least 30 days before the expiration of
the term indicated on the reverse side. If the site heccenes unfit or undesirable for use for Motorola's pur-
poses, Motorola may terminate this lease by mailing written notice to Lessor, which shall be effective 30
days after it is mailed by Meterola. If Motorola holds over at the end of the term, it shall create a month to
month tenancy subject to the provisions of this lease.
4. Rent. Each month during the term of this lease and while Lessor is not in default hereunder Motorola
will pay to Lessor in advance the monthly rental indicated on the reverse side.
5. Liability. Motorola will carry during the term of this lease the following insurance with the customary
coverages and exclusions:
Bodily Injury — — S500,000. for injury to any person,and S1,000,000. for all injuries sustained
by more than one person in any one occurrence.
Property Damage— S1,000,000. for damage as a result of ally one accident.
Rooftop Damage — $100,000. for damage as a result of any one accident.
Motorola agrees to furnish Lessor with certificates of the insurance carrier certifying that lloturoln has the
above specified insurance, and it is agreed that Motorola'e liability shall he limited to the risks and
amounts covered by this insurance. • •
6. Condition of site. During the term of this lease Lessor shall keep the leased site and the premises of
which it is a part in good condition and repair. Upon termination or expiration of this lease Motorola will
surrender the site to Lessor in good condition except (a) for reasonable wear and tear, or (h) for damage
due to causes beyond Motorola's control or without its fault or negligence, or (c) for both.
7. Exclusive agreement. Lessor will not allow anyone. except Motorola and its sub-tenants to enter upon
ur occupy the site or to use the premises of which the leased site is a part for radio or television trans-
mitting.
8. Notices. Any notice or demand required or permitted to be given or made hereunder shall be sufficiently
given or made by certified mail in a sealed envelope, postage prepaid, addressed in the ease of Motorola
to Vice President and General Manager, Motorola Communication Division, 1301 E. Algonquin Rd.,
Schaumburg,I11.60172, and addressed in the case of the Lessor as set forth on the reverse side of this
agreement. Any such notice or demand shall be deemed to have been given or made at the time it is de-
posited in the United States Post Office. Motorola or the Lessor may from time to time designate any other
address for this purpose by written notice to the other party.
9. Waiver. Failure or delay on the part of Motorola or the Lessor to exercise any right, power or privilege
hereunder shall not operate as a waiver thereof.
10. Prior negotiations. This contract constitutes the entire agreement of the parties hereto and shall
supersede all prior offers, negotiations and agreements.
11. Amendment. No revision of this contract shall be valid unless made in writing and signed by an of-
ficer of Motorola and an authorized agent of the Lessor. •
