Those present were: Ronald Heitman, Chairman/Weld County Planning Commission Bill Elliott Chuck Carlson John Weigand Jim Graham Harry Ashley County Commissioner present: Norman Carlson Others present were: Gary Fortner, Director of Planning Glen Paul , Health Department Sam Telep, County Attorney Cindy Teleo, Assistant County Attorney Ray Reib, Northern Colo. Water Conservancy District A letter dated February 26, 1976, regarding Parkland Estates from Gary Fisher, Colorado Land Use Commission, was briefly reviewed by Planning Com- mission members. The weld County Planning Commission held a reiularly scheduled meeting on Tuesday, larch 2, 1976, at 1 :30 P. M. , in the County Commissioners meeting room, second floor, Public Health Building, Greeley, Colorado. Roll Call was as follows: Ronald Heitman, Chairman Present Bill Elliott Present Harry Ashley Present Jim Graham Present Chuck Carlson Present Marge Yost Absent J. Ben Nix Absent John Weigand - Absent Dean Severin Absent As a quorum was present, the meeting proceeded as scheduled. SUBJECT: Minutes MOTION: By Harry Ashley, to approve minutes of February 3, 1976, as submitted. Seconded by Carlson. A unanimous vote of "aye. " MOTION CARRIED. 1255 standpoint, Staff does not observe any problems with this expansion or any detrimental effects on the environment; 3) The Weld County Health Department has reviewed the application and has recommended for approval with the following comments: a) the lagoons be designed according to the number of hogs; b) the effluent of lagoons not to enter the surface or ground water. 4) The Weld County Engineering Department reviewed the application and has commented that the existing access is approved and that any new access would need approval prior to installation; 5) No response has been received from the Gale- ton Fire District, or the Owl Creek Supply and Irrigation Company; 6) A petition supporting the application has been signed by some of the surrounding property owners and has been made part of the application. Planning Office has not received any objections to this application from any of the other adjacent property owners; 7) the Soil Conservation Service has reviewed the application and has commented that the land in Section 29 already has facilities to prevent the hoglot waste from reaching the stream below the' feedlot; and 8) the Eaton School District has no present objections to the request for the Special Use Permit. SUBJECT TO: 1 ) The Special Use Permit shall be limited to the plans submitted and governed by the development standards as stated on the Special Permit plat. Any changes to the plans and/or the development standards shall require approval of another Special Use Permit before such changes shall be allowed. There is an existing mobile home on the property now, and Mr. Andrews may possibly request three additional ones (permanent type) in the future. Mr. Heitman explained to Mr. Andrews that the mobile home regulations are in the process of being revised and that it may be a requirement that all mobile homes meet the Uniform Building Code. RESOLUTION: Be it therefore resolved by the Weld County Planning Commission to recommend to the Weld County Board of County Commissioners, that the request of Andrews and Company to expand a hog farrowing operation (SUP 296) is granted subject to staff recommendations, and subject to any additional mobile homes to be placed on the property being in compliance with the Uniform Building Code or the held County Zoning Regulations which are in effect at the time these mobile homes are to be placed on the property. APPLICANT: Andrews and Company Tape 628 (#2961 - 3365) CASE NUMBER: SUP 297:76:2 LOCATION: NW1 Sec. 20 T7N R64W SURJECT: Hog finishing operation APPEARANCE: Harry Andrews DISCUSSION: Mr. Andrews explained that the hogs will be totally confined. Only one building will be completed this year and the operation is expected to be completed by 1980 (structures) . The Weld CourLy Planning staff recommends approval for the following reasons: 1257 ,r 1 ) The proposed hog finishing operation agrees with the Weld County Comprehensive Plan in that the Plan states: "Expansion and development of agri-business and agriculturally oriented industry will be encouraged, provided these enterprises do not ad.,ersely affect the total economy or environment. " It is felt that with the design and controls proposed in this operation, there is little chance for adverse impact on the surrounding environment; 2) the Weld County Extension Service has reviewed the application and has commented, "The proposed area in con- finement buildings is adequate space for the proposed number of hogs proposed in this finishing operation. This operation appears well planned from a design standpoint. Planning staff does not observe any problems with this operation or any detri- mental effects on the environment; 3) the Weld County Health Department has reviewed this application and has recommended for approval with the following comment: "The sewage system and lagoons shall be designed to the number of hogs and effluent shall not enter the surface or ground water. " 4) A petition supporting the application has been signed by adjacent property owners to the north, south, and east; and 5) no response has been received from the Owl C:'eek Supply and Irrigation Company, the Eaton School District, or the Caleton Fire District. SUBJECT TO: 1 ) The Special Use Permit shall be limited to the plans submitted and governed by the development standards as stated on the Special Use Permit plat. Any changes to the plans and/or the development standards shall require approval of another Special Use Permit before such changes shall be allowed; 2) approval for the proposed accesses shall be obtained from the Weld County Engineering Department prior to publication of the hearing of this case before the Board of County Commisisoners (this approval has been obtained) ; and 3) resolution of the request by Mr. Virgil Ottinger for a 300' wide strip of ground to act as a buffer zone on which there would be no swine manure. The reason for such a request is solely to Prevent the spread of any diseases. There is no problem with the location of any of the hog operation facilities within 300' of Mr. Ottinger' s property since the west boundary of the Special Use Permit area is 500' from Mr. Ottinger's east property line. However, at this time there is no restriction on the use of said 520' strip of ground between Ottinger's property and the Special Use Permit area for the spreading of hog manure. There are letters of objection tothe proposed hog finishing operation on file from Knapps, Foxes, and Hortons. Mr. Andrews son exnlained that he visited these people and explained the operation to them. He feels that they are no longer as strongly opposed. Mr. Ottinger did appear at this meeting and he expressed concerns regarding a buffer zone to prevent diseases. Mr. Andrews commented that he should be able to spread manure on this unused land up to his property line. 1258 RESOLUTION: Be it therefore resolved by the Weld County Planning Commission to recommend to the Weld County Board of County Com- missioners that the request of Andrews and Company for a hog finishing operation (SUP 297) is granted subject to staff recommendations, and subject to items 10, 11 , and 13 on the develop- ment standards being revised. Planning Commission members feel that any problems regarding the spreading of hog manure and diseases can be worked out through a gentlemen's agreement. Motion by Chuck Carlson. N. + ifs r, Andrews and Company Hog Finishing Unit (Proposed) Special Use Permit Development Standards 1 . The confined hog finishing on the hereon described I0?sue 17"acre parcel located in part of the NWT of Section 20, T7N, R64W of the 6th P. M. , Weld County, Colorado, shall be limited to 8,000 hogs (40 to 225 pounds live weight) and one (1 ) feed mill capable of producing 101 tons of hog feed per day. 2. All phases of the hog finishing operation shall be enclosed within buildings. 3. Dust abatement shall be practiced by maintaining sufficient ground cover to prevent erosion and by preventing internal roads and activities from being sources of vagrant dust. 4. Water shall be supplied by the North Weld County Water District and will be adequate in quantity and quality for all domestic and stock uses. 5. The sewage system for the confined hog finishing operation shall con- sist of the proposed lagoon as shown on the plat. Each of the three proposed residences shall have an individual septic tank. All sanitary and disposal requirements will comply with Weld County and State Health Regulations. 6. There shall be no discharge from any of the existing or proposed lagoons into streams, other bodies of water, or adjacent drainage systems. 7. An application for a discharge permit shall be filed with the Water nuality Control Division of the Colorado Department of Health prior to any building permits being issued. Proof of the granting of such a permit shall be forwarded to the Weld County Planning Commission within thirty days of issuance of the discharge permit. 8. All buildings shall be set back a minimum of fifty feet from the Special Use Permit area boundary. 9. Access shall be limited to the 1 existing points as shown hereon. A . - 10. Proposed employment shall consist of five full time employees 11 . Additional housing for the Special Use Permit areas shall be limited to the three proposed residences as shown hereon. Said residences shall be built in conformance with the provisions of the Weld County Zoning Resolution with respect to the type of structure. Building permits shall be secured prior to the construction of said residences as well as for any and all of the structures to be located on the Special Use Permit area. 12. Construction will begin within one year of approval . All construction is expected to be completed by January 1 , 1980. 13. The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above. Surely with all the barren ana empty farm lana farther to the east of that area, an area for hog finishing could be found where that type of ugly land cover and smelly oder wouldn? t be near farms and farm homes. We have contemplated living on our farm land when I retire in about ten years , and we don' t want to live on a farm near a hog finishing operation. As to attending the meeting mentioned in your letter---if my attendance would have any weight or make any difference in your decision, I would attend the meeting. However, I recall the last meeting all the farm owners in that area attended objecting to the establishment of the Weld County Trap and Target Shooting Range just to the south of my property. Every land owner adjacent to the proposed target shooting rane objected (as well as a lawyer hired by some of the people ) to the Trap and Target Shooting Range being set up on that particular property. At that meeting the final decision and discussion was tabled until another time and date. I was not notified or sent any further information after that first meeting and the shooting range was established on that property near farms and farm homes ( even though all surrounding land owners objected) . May I ask why you notify the surrounding farm owners if their objections haven' t any weight in your decisions. You are required by law to notify property owners in the surrounding area; but when all the property owners in the surrounding area object , you are still permitted to zone or give a Special Use Permit as the Planning Commission decides. Please advise me as to the time and place where the February 24th meeting will be held reviewing the Special Use Permit for the Andrews and Company' s hog finishing operation.
