WHEREAS, the Board 'of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, .the Board of County Commissioners of Weld County, Colorado held a public hearing on the 9th day of July, 1979 at the hour of 9: 00 o' clock a.m. for the purpose of hearing the applica- tion of Richard M. Barnes for the granting of a Conditional Use Permit for a horse training facility on the following described real estate, to-wit: Lot A of Recorded Exemption 0801-18-3-RE332 recorded in Book 843, Reception No. 1764509 Weld County records and located in the South- east Quarter of Section 18, Township 6 North, Range 64 West of the 6th Principal Meridian, Veld County, Colorado. WHEREItIS, the petitioner was presents and WHERE1S, evidence was presented in support of the granting of the Conditional Use Permit for a' horse training facility , and WHERE S, Section 3. 3.D. of the Weld County Zoning Resolu- tion author1izes such a use in an Agricultural District on the granting o$ a Conditional Use Permit by the Board of County Commission I�rs, and WHEREAS, the Board of County Commissioners of Weld County, Colorado hlatd all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Well County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a horse training facility on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3.D. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated July 3, 1979 be, and he eby are, incorporated as the findings of fact of the Board of C unty Commissioners in this matter. W., Section 36, T2N, R68W LOCATION: 1 mile west of Frederick - APPEARANCE: Lou Gaskins-Attorney; John Lang, Senior Staff Engineer DISCUSSION: Mr. Lang stated that they first obtained the Special Use Permit in 1915 for the compressor station which presently has three 1, 000 horsepower compressors . These compressors are used to take gas from oil and gas wells in the surrounding areas and compress the low pressure gas up to 430 lbs. This pressure is then pushed through a pipeline 4 miles east of the site to Spindle Plant. It is there that dry gas is yielded which is suitable for use in residential or industrial type operations. They now need one additional compressor at the site hich will be located on three acres adjacent to the other three compre sors . The purpose of the additional compressor is to give them the capacity that when one of the other compressors needs to be shut downito. overhaul, etc. they will not have to reduce oil production in the field. - Tom Honn then read the staff ' s recommendation for approval with the Development Standards and the comments . There was a letter received by the staff from Union REA stating that they have no objection to this as long as the proposed change does not encroach within 20 feet. of the existing underground pipeline located east of and parallel to the west line of the section. Mr. Gaskins stated this Would not encroach the property in any way nor interfere with the right-of-way. Mrs. Kountz asked what the duration would be for the compressor. Mr. Lang responded at most approximately 1Z to 2 _ years after the peak period. •Ben Nix asked if noise would be a problem. Mr. Lang stated that the operation is basically inaudible. Mr. Hiatt stated he fi ld checked the proposal and found it to be a very quiet operation an .saw no problem with it. • Planning Commissic '4inutes 'Page 2 _. - July 3 , 1979 . Barnes desires to establish a horse training facility on this prope ty for approximately 6 to 20 horses . He has a lease with an option to uy the property at present. He has begun to build a permanent residence with a barn and other necessary training facilities yet to be constructed. Mr. Barnes ' primary occupation is raising horse . A full time trainer will be hired and a residence will also be built fo" him. There will be no horses boarded at the property. Tom Honn then read the Planning Staff' s recommendation for approval along with the Development Standards and comments. Some discussion followed regarding possible flooding, but the site is too high for this to occur. MOTION: Be it therefore resolved to recommend approval with the Develo me Standards to the Board of County Commissioners based on the Planning Staff' s recommendation. NW4, Section 35, T5N, R66W LOCATION: 51150 44th Avenue; Greeley, Colorado APPEARANCE: Tomas Mondragon DISCUSSION: Mr: Mondragon is presently employed full time, but wants to furnish Greeley and surrounding areas with firewood for energy conservatio purposes. Approximately 300 cords of wood will stored on the northeast part of the property. Mr. Otis asked if the applicant was aware of any possible rest1rictive covenants for conducting a business from a person' s home in a subdivision. Mr. -Mondragon stated he was not aware of any, but would check Into it before proceeding with the business. Tom Honn then read the Planning Staff' s recommendation for approval along with the Development Standards and the comments . Mr. Honn also stated that in the Planning Staff' s opinion an additional item should be added to Development Standard #5 which states that the request will be in compliance with CRS - 35-4-101 et. lseq. _ 1973 as amended. This is a state statute as it regards pests . Discussion followed regarding this . There was also some discussio regarding Development Standard #6 in regard to the property having a neat and orderly appearance: There are presently two vehicles on the property. Mr." Mondragon stated that he wants to make trailers out of them for haulin the firewood. Chairman Carlson then asked if anyone in the audience wishe • 'Manning Commission inutes _. Page 3 , July 3 , 1979 to make a co ent regarding the request.At this time Juan DeLaRosa, Mr. Mondragon�s neighbor to the east, stated that he was concerned that the property ould become unsightly and junky looking, but he has no objection to Ir. Mondragon storing firewood. Mr. Nix then commented that he was concer ed about the operation and what the County could do if the operation were to get out of control. Fred Otis stated he feels the definitions a d Development Standards need to be more strictly drawn as regards : 1) The fence-needs more clarification where it will be located; 2) cars should be enclosed on the property; 3) Should be a limitation on the size of the fence. A great deal of discussion followed in this regard. MOTION: Be i therefore resolved to recommend approval with the Developmei Standards and the addition to Development Standard #5 as recommended by the Planning taff. Also that the staff include within the Development Standards a m ximum area to be determined of 20 , 000 square feet; a 10 foot fence be placed no closer than 10 feet from the property line; and that there be a maximum height to the fence of 8 feet. CONSIDER A REICOMMENDATION TO AMEND SECTION 4. 5. , GENERAL SIGN REQUIREMENTS, WELD COUNTY ZONING RESOLUTION. DISCUSSION: Tom Honn stated that at the last Planning Commission meeting they recommended striking from the Resolution the section regarding annual renewal of signs. This amendment is to add two new sections. (See attached ame 'dments) . The subject was then brought up as to what the . definition is� of a sign and what the difference is between a commercial sign and any other sign. It was the general feeling of the Planning Commission that it is not appropriate to approve something that could be . a violation but cannot be enforced. MOTION: Be t therefore resolved to recommend approval based on the Planning Staff' s recommendation. Motion by Ben Nix, seconded by Jerry Kiefer. A vote of "aye" was cast by Ben Nix and Jerry Kiefer. Motion carri Id for denial. . ..Planning Commissiot ,_, inutes - Page 4 , July 3 , 1979 CONSIDER A RECOMMENDATION TO AMEND SECTION 6. 6, UNIT DEVELOPMENTS , WELD COUNTY ZONING RESOLUTION DISCUSSION: om Honn explained that there is a problem that the current regul tions have created that allows certain types of development in a given zo e district in a given situation. This involves the High Density Zone istrict. A person can build an apartment building or condominium b cause it is a single unit of ownership with no actual subdivision t4king place on the property. This could not be allowed if a person w*nts to create a townhouse because it creates a separate interest. He then explained the unit development procedure and restrictions nd the suggested amendments to it. (See attached) Harry Cross stated that he agrees with Mr. Honn and that this should be amended. MOTION: Be i therefore resolved to recommend approval based on the Planning Staff ' s recommendation to the Board of County Commissioners . Motion by Jer y Kiefer, seconded by Ben Nix. The work session has not yet been held, therefore, the Planning Staff recommended the request be continued to the July 17 , 1979 Planning Commission meeting. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County, State and Federal Health Standards and Regulations pertaining to air quality, water quality, noise emission and appropriate disposal systems. 4. All accesses shall have the approval of the Colorado Division • of Highways. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Colorado Division of Highways. 5. Barnes for Conditional Use Permit Dear Ladies and Gentlemen: The purpose of this letter is to request a Conditional Use Permit for t e above named applicants, and to set forth some of the procedural de ails required for such a permit. The following is the proposed operation, as proposed by Richard M. a d Nancy J. Barnes. First, attached as Exhibit "A" of this letter, is a copy of the Lease and 0 tion Agreement entered into between the Barnes' and the record owner, Mr. Larry A. Littlefield. As you will see, the same provides the Barnes' with adequate indicia of title and control of the premises, for the applied for Conditional Use Permit. i . The Barnes ' propose to operate an equine training facility, which operation is the procurement, raising, training and ultimate sale of horses by the Barnes' . All horses will be owned by them, and in no fashion is th•s facility to be determined a boarding facility. The applicants propose to have a maximum of twenty head of horses, and minimumgt• six head, not counting foals or other horses under 'one ye r of age. As art of this application, there appear certain documents showing the layout of the proposed facility, making a maximum use of otherwise un sed farm ground, which may have gone for single—family dwelling and residential use. The Barnes' propose to have this facility as proposed, so that they may have a facility for the care, training and look—out of t ese valuable animals. Application of Ri .rd M. and Nancy J. It will not be used for the growing of cr ps, other than a personal garden,, and it' s only other use will be the etting down of the facility to prevent an accumulation of dust and du t producing material. There should be no odor, noise, safety hazard or traffic congestion produced as a result of this proposed operation, of er than the owners themselves and their trainer. Very few vehicles will use the facility other than an occasional sale on the premises, not expected to be held more often than once to three times per year. In all ther fashion, the applicants propose that the use will be no greater, s far as vehicles entering and exiting the paved road (Highway 392) , than is presently done. All orse manure and other wastes will be removed by one of the following methods. All manure deposited by the horses and other animals will be scooped up on a periodic basis and applied to the remainder of the property in the normal fashion in which fertilizer is applied in W ld County. All sanitary waste from the residences are to be attached to the properly designed system, which is part of this application. The applicants wish to point out that the system was provided and designed by a registered engineer to fit the premises and the soil cond. ions therein. Add•tionally, the applicants have purchased a water tap from the North We d County Water District, and will attach this, for sanitary water, to the residences and other facilities used by humans. All oadways will be graveled to prevent the creation of a dust problem, whi h is necessary for the healthful raising of the animals. There shall e one entrance upon the Highway (Colorado 392) , and all other roads ithin the premises shall be maintained by the applicants, and not maintained by the County or any other public entity. The applicants propose to live on the premises, together with their trainer, and to have all facilities, including the horse barns, fences and residences constructed in such a manner as to be asthetically attractive, functional and healthful in an environment. The existing right of way on State Highway 392 is 60 feet, 30 feet each side of the centerline. Projected traffic volumes on this highway indicate the need for a total o 120 feet of right of way. We ask that an additional 30 feet be protected long the south boundary of this property by setback, reservation, or dedication (preferably the latter) as local zoning laws and regulations permit. 2. The construction of any new driveway to a State Highway requires a Driveway Permit. The proposed system and leach field are to provide sanitary sewer ser- vice to two modu-ar homes and a small office. The site is located as shown above and is 5.8 miles East of Lucerne on the North side of State Highway No. 392. The land drains from East to West with a fall of about 4' in 330' . A "tail water" ditch crosses the Southwest Corner of the site running Southeasterly. A seep ditch (about 6' deep) lies approxi- mately 470 feet orth of the highway and runs from East to West. Both ditches had small amount of water from the continuous running seep ditch. The site has a moderate glowth of grass and' is presently being used as pastureland. Recent rains have left the soil damp. Three trenches w re excavated to 8 feet of depth. All trenches showed about. 14" of topsoil a d organic root system. The remainder was uniform and consisted I of a light brown silty clay soil . Free water existed at 6' in Trench 1 & 2 and about 3' in rench 3. 0 Mr. Richard M. Based on these r sults and the design procedures recommended by the Weld County Health Departmen , the resulting system is shown in the calculations and sketch. All septic tanks, leach fields and installation should be in accordance with County Regulatio s. The entire site is made up of Otero sandy loam, 1 to 3 percent slopes, (53-B). This i�d a deep, well drained soil with a typical surface layer of brown sandy ]foam 12 inches thick. The underlying material, to a depth of 60 inc es, is a pale brown calcareous fine sandy loam. Permeability is apid, surface runoff is slow and water erosion hazard is low. However, this soil is susceptable to wind erosion and care should be taken to main ain surface soil protection during the windy season to prevent excessiv soil loss.
