A photocopy of the relevant portions of the zoning resolu- tions for the County of Weld and State of Colorado, as amended, originally adopted May 29 , 1961, are attached hereto and marked Exhibit "A" . 8. Having attended two open "forums" about Best-Way Paving Company's plans for mining sand and gravel on property described as Pt. NE*, Sec.2, T5n, R66W, I believe that the company intends to mine and reclaim the land in a manner that would be of minimal impact upon the environment and the surrounding community. I am satisfied that the company's intentions are honest and forthright. I realize that natural energy resources (in this case, sand and gravel) must be used in order that city and county growth may continue. Ipaaso realize/believe that open space, "greenbelt" areas are a necessary part of future planning for Weld Couhtr's metropolitan areas. Subsequently, I believe that Best-Way's proposal could provide for both these concerns. Since I am interested in wildlife and am an Audubon Society member, I believe there may be additional benefits of such a plan. One benefit would be the continuance of a "shelter" for the present wildlife population as the mining operation goes on. The other benefit would be the increase of wildlife and waterfowl which would be nurtured by the vegetation, trees and pond provided for in the final restoration. I think that each year's growth of housing developments will make such "sanctuaries" more and more desirable, and I believe that over the next 10 to 20 years such areas will be at a premium. That, in turn, would make my property even more valuable. NE4, Sec. 2, T5N, R66w. I am opposed to the granting of this request and subsequent zoning change. My husband and I are homeowners within 500 feet of the property described above. We will be adversely affected by this change in zoning. Let me point out that the neighborhood within 500 feet of the property in question represents a group of Weld County citizens who are genuinely concerned about the value of life that they, their families, and their neighbors have. They keep up their proper- ties . They pay taxes on those properties. They vote for and elect county commissioners . These people trust the elected commissioners to protect and defend the interests of the community and the county. To believe that the planning commissions or the county commissioners would grant such a zoning request is preposterous even in itself. To allow this gravel mining operation to enlarge would encourage the following things to occur in this neighborhoods 1. Devaluation of property values : Should we be forced to sell our home with a gravel pit within 500 feet, we would be obviously forced to accept less-than-market prices. Keep in mind that 500 feet is the maximum distance petitioned home owners are located away from this area. Some are divided from this operation by the distance of a city / street! The previous owners of our home J -2- did not have this problem when they sold our home to us. 2. Deterioration of the neighborhood: Should we accept below-market values, we would be asking for people who might not be interested in keeping up their properties such as renters. The existing condition of this neighborhood demonstrates obvious pride on the part of the present homeowners. 3. Health and Safety Hazards : We already have dust and noise pollution from the existing operation. If it was allowed to be 500 feet from our house, the dust and particulates in the air would settle on our lawns and in our lungs. The increased truck traff icc down 35th Avenue and 4th Street (the "emergency" exit") would cross the paths of not only Franklin but also Shawsheen students. As the grinder moves closer to our homes, the noise levels would increase. The drop-offs on the face of the mining operations, which may reach 4o feet, would pose obvious hazards to our children who would be tempted to stray to such a close obsticle such as this. The body of water to be created would represent a breeding ground for mosquitos and flying pests on top of the potential for downing. This pond's propoded depth? 45 feet! No matter how closely we watch our families, all aspects of this extended operation pose health and safety hazards to each and every one of them. "Generally, however, restrictions have been upheld where it has been shown that they are in the interest of health or safety of the people or a part of a comprehensive plan and are not arbitrary or discrimi- natory. The list of residences within 500 ' which was furnished to the Weld County Planning Staff by Lord & Associates was used for contacting people for signing a Petition in opposition to the proposed gravel pit. That list contained a possible 208 signatures . 169 of those possible signatures signed the petitions in opposition to the gravel pit. 81. 25% 2. Petitions were also circulated to residences immediately outside the 500 ' radius . Although T have lost track of exactly how many signatures were on the petitions sub- mitted, a conservative guess is at least 150 . THAT IS A TOTAL OF A MINIMUM OF 319 SIGNATURES OF PEOPLE OPPOSING THE REZONING. 3 . On Wednesday, February 1 , 1978 , the Parent Teacher Group of Shawsheen Elementary School held a special public meeting to discuss the proposed rezoning of the 45 acre parcel north of 4th Street and west of 35th Avenue for the purpose of expansion of gravel pit operation by Best Way Paving. The property owners and parents present at the meeting unanimously passed the following motion: "As a group of concerned parents and property owners meeting under the auspices of the Parent Teacher Group and residing in residential areas adjacent to the land designated as the site of the proposed gravel pit we are directly opposed to the proposed zone change and to issuance of a special permit for such an operation. " ° 4 . Large numbers of concerned citizens have attended the two Planning & Zoning Commission meetings held so far, and many have spoken in opposition. 5. The meeting held by Lord & Associates at Franklin School in January was an extremely hot, negative , hearing and was attended by almost 80 people from the list of owners within 500 feet. 1. The City of Greeley "moved to have no objections to the rezoning. . .with the recommendation that a minimum setback of 100 feet be provided. " AT NO POINT IN THE PROPOSAL IS THAT RECOMMENDATION BEING ADDRESSED. 2. The February 6 , 1978 letter to Gary Fortner from John G. Hall, Director of Environmental Health Services, Weld County Health Department states, "it does appear that muffling of both loaders and scrapers will be necessary when areas 1 , 2 , 3 , 6 , 9 , and 10 through 14 are mined. " Lord & Associates ' only reference to muffling was, "In those small portions at the site ' s perimeter, it will be necessary to provide additional exhaust muffling for the very short time duration of the stripping operations . " (emphasis added) . 3 . On December 28 , 1977 John G. Hall , Director of Environmental Health Services, Weld Co . Health Dept. , approved the request with the following provisions : 1. A fugitive dust emission permit must be applied for through the Weld County Health Department. The application for this permit must be accompanied by a pit analysis . 2. A separate emission permit application must be made before a rack (sic) crusher is added to the site. 3. A National Pollutant Discharge Elimination System (NPDES) was discharge permit shall be applied for through the Colorado Department of Health for any discharge of groundwater. IN A TELEPHONE CONVERSATION ON 2-9-78 WITH JOHN HALL, THIS WRITER WAS TOLD THAT TO HIS KNOWLEDGE NO PERMIT HAD YET BEEN APPLIED FOR FOR EITHER FUGITIVE DUST OR ROCK CRUSHER. THIS WRITER HAS PREVIOUSLY ASKED THAT DEPARTMENT TO FURNISH HER WITH A COPY OF THAT APPLICATION WHEN IT IS SUBMITTED, AND HAS NOT YET RECEIVED ONE, THEREBY ASSUMING NONE HAS BEEN SUBMITTED. 4 . December 30 , 1977 letter from Milton Baumgartner, President, West Greeley Soil Conservation District : "The amount of surface drainage discussed in the plan was to be handled by reconstruction of adequate curb and gutter along 4th Street. If temporary re- direction of the surface water is done prior to re- construction, then care must be exercised to insure that the diverted water will not inundate adjacent properties. " ON 2-9-78 IN A CONVERSATION WITH MAX KARNER, GREELEY CITY ENGINEERING DEPARTMENT, THIS WRITER WAS INFORMED THAT IT WOULD BE HIS ESTIMATE THAT IT WILL BE THREE OR FOUR YEARS BEFORE CURB AND GUTTER IS COMPLETED ON 4TH STREET. MR. KARNER GAVE THIS WRITER PERMISSION TO QUOTE HIM. 5. Page 12 also states , "it was concluded at the beginning of the design studies that detailed monitoring of the volume of particulates generated at the site was not necessary. This was determined through discussions with the U. S. EPA and the State Health Department. " I would like some specific clarification on that -- who did he talk to, what was said, what dates , or did MR. MATHIAS simply conclude that. Is it strange that this is in total contradiction to the December 28 , 1977 letter from John G. Hall from the Weld County Health Department? 6 . January 12 , 1978 memorandum from G. Frank Smith, Jr. , County Engineer: "Drainage between the 4 ' berm and 35th Avenue, and 4 ' berm and 4th Street should be controlled. According to the New York Times , June 9 , 1977 , IV, 14: 1 , the Environmental Protection Agency is starting a program to find whether there is a public health hazard associated with asbestos dust from crushed rock . The EPA found high concenttAt qns of asbestos dust from gravel operations in Montgomery County, Maryland The EPA urged this County to take strong measures to cut down on fibers which are believed to cause lung cancer . Asbestos is defined by the Encyclopedia Britannica as a general term applied to any mineral that can be easily separated--into flexible fibers . The concerns of the community include all dust created by the gravel pit operation . Since most of the community lives in a southerly direction from the pit and the prevailing winds in this area are from the north , possibilities are tremendously increased that we will experience not only dusty homes and greenery, but that the invisible dust will penetrate our lungs through natural means . It is our contention that no matter how many or what type of filters are used on the crusher or what means are used to lessen the dust during scrapping, that on more days than not , we will be subjected to a threatening menace to our health . Many-Tn the neighborhood already .suffer from respiratory ailments_ such as asthma bronchitis_, and_ wpleuresy.^ The fine , minute dust particles can only serve to worsen _ *thieir conditions as well- as affect the health of others . Pollution is also a concern of the neighborhood . On October 3 , 1974, the Denver Post reported that a gravel pit was shut down by__ two Unit-6d States agencies . A Colorado Highway Department contractor teas ordered to shut down a gravel pit in Summit County for alleged violations of water pollution regulations . A U . S . Forest Service hydrologist said silt from the gravel pit had polluted six miles of West Ten Mile Creek . The U.—S Environmental 1rotection Agency issued a similar shut-down order to the firm . This type of pollution poses a danger to the health of many people including farmers who may depend upon the water from the stream" in the gravel pit area for irrigation as well as for livestock watering . Noise pollution is also a likely probability in our neighborhood . With large equipment , machinery and rock crushers operating within 500 feet of nearly 200 homes , the noise will definitely be detrimental to the quality of life we now experience in our area . With the wind prevailing from the north , the neighbors on the south side will especially be subjected to the annoying constant din . -2- TO : Weld County Planning Commission 1 /17/78 Ralph Nader reports in the January, 1974 issue of the Ladies Home Journal that tTe Environmental Protection Agency reports that noise is a serious health -hazard to which -4U mill-ion Americans are dangerously exposed--at million in their place of work and others from proximity to Airports , construction , freeways , etc . Dr. James D . Miller of the Central Institute for the Deaf in St . Louis , and EPA consultant , estimates that a constant noise level of 70 decibels may be sufficient to retard _development of speech and reading among children . When the noise level reaches 105 decibels , as it may at a busy corner during rush hour , the probability of a hearing loss from repeated exposure approaches 100 per cent . In addition , noise can adversely affect the cardio-vascular system, helping to cause hypertension , peptic ulcers , and an abnormal lowering of vascular tone . Research indicates that noise can interrupt sleep patterns and produce emotional disturbances ranging from irritability , loss of atenl;ion , and lower work performance , _to more serious paranoidaldelusions and suicidal and homicidal tendencies . They used the A scale on a sound level meter. The A scale is one of THREE scales availabe. There are also the B & C scales . The A scale used emphasizes medium to high pitches and takes out low pitches in the analysis. The high pitches , when loud, cause hearing losses. However, it' s low pitches which cause physical problems , like cardiovascular problems, and emotional problems . . . .Low pitches sounds do not need to be excessively loud to cause these reactions . They just have to be consistent. Machinery noise , like scrapers , crushers , etc. make low pitched sounds . Because of a concern about the problems associated with low pitched noises , the B scale should have been used for the noise studies . The B scale measures both low, medium and high pitches -- in other words, those pitches throughout the spectrum of human hearing. Lastly, I am concerned about the training of the personnel who made the noise level study. On Thursday afternoon, January 26, at the corner of 5th Street and 35th Avenue Court, I visited with an employee of Lord & Associates . He told me he was a geologist and that he was taking noise level readings . That is the qualifications of those who conduct such analyses. Environmental noise analysis with accompanying octave band analysis and, most importantly, the interpretation of the findings necessitates intensive training in either industrial-environmental audiology (hearing conservation with certification in Audiology) or physiological acoustics. Even with that, extensive training in interpretation of the noise samples, e.g. their potential damage to the peripheral auditory mechanism, or their psychological repercussions must have transpired prior to the valid conduct of any noise analysis. Any individual who possesses less training should not attempt to conduct any noise survey or analysis if validity/reliability of the analysis is important for the protection of persons or their environment. Noise is so potentially damaging to people, but, on the other hand so difficult to measure and interpret, all analyses of it must be conducted by extremely well trained professionals, especially in this age of steadilly increasing environmental noise. For example: Page 29 : "Any stockpiles of overburden at the site which must be constructed will be seeded as soon as possible to minimize dust generation. " (emphasis added. ) Page 20 : "near-windless condition of the operations area. " Page 19 : " . . . it is most highly probable that the duration of the mining operation at the site will be 15 to 16 years . " (emphasis added) Page 16 : Chart shows Total Annual Precipitation, 11 . 28 in. but on Page 12 of the "Water Resource Plan" it is shown as 12. 2 in. Wind velocity is never mentioned -- Page 26 lists 3 plans for disposal of water from pit, but the accompanying "Water Resource Plan" lists only 2 . Page 2 : "Water Resource Plan" states , "The scope of the gravel operation is not expected to be enlarged in the future over what it has historically been. " However, in the mining plan they show over 50% of the area in MAJOR disturbance in the tenth phase. Page 39 : "In no case will more than five years lapse between commencement of reclamation operations and final success of reclamation. " However, Area #5 is shown as in major dis- turbance beginning in phase V and continues to phase XIII . Eight years . Page 16 : Chart shows prevailing winds predominantly from the east. Dr. Cobb, UNC Meteorologist, states there is no prevailing wind and his charts are dissimilar to those sub- mitted herein. When Mr. Kathias was questioned about this at the hearing at Franklin School , he admitted that they hadn't been able to find the book they wanted to use , so had used another one . " Page 16 , Water Resource Plan: "There is a possibility which cannot with current knowledge be anticipated, and that is that the procedure described above may result in water- logging of the surrounding non-irrigated grassland , rendering it unfit for any future development. " Page 4 , Supplemental Plan: "Along the eastern edge of the site immediately adjacent to 35th Avenue , a four-foot high, ten-foot wide berm will be constructed with a six-foot high, chainlink fence constructed on its outer edge . " Weld County Engineering Department has a plan approved and signed by Carl Hill indicating a six foot privacy fence. Which is correct? Justification for Change in Zoning Request and Special Use Review: a. "Is it impracticable, impossible or undesirable to develop this land according to its current zoning classification?" We contend that they have not even answered that question and that it would have to be answered : It is not impracticable. It is not impossible. 300+ nearby residents say it is not undesirable. b. "Would the proposed re-zoning benefit the entire County by allowing a typical development which is needed and cannot locate in other parts of the County?" It is not a typical development. It can locate in other parts of the County. NOTE: Page 5 , Weld County Mineral Resource Extraction Plan states, "Weld County contains extensive deposits of sand and gravel. " Page 7 : "First, the County is underlain by substantial deposits of sand and gravel resources of varying quality. " Page 20 : " . . .because Weld County contains abundant supplies of these resources, . . . " ALSO, BESTWAY' S ANSWER TO THIS QUESTION DOES NOT ADDRESS ITSELF TO THE HEALTH, SAFETY AND WELFARE OF PEOPLE, ONLY TO MONEY. c. "Would the proposed re-zoning benefit land adjoining the area requesting the change?" Absolutely NOT. . . .ask the 300+ residents who signed petitions. d. "What features apply to the property requesting re- zoning that make it logical to re-zone this tract and not to re-zone in a similar manner surrounding properties which might have like land use characteristics?" Not applicable. Surrounding properties are all residential areas . e. "Why are other areas in the County already zoned according to the requested classification unsuitable for the development which is proposed?" They aren't. See the answer to b and the quotes from the Weld County Mineral Resource Extraction Plan. f. "What proof or evidence is available that the original zoning is faulty or that changing conditions in the area justify re-zoning at this time?" There is no proof that the original zoning is faulty, only the contention of Bestway. AT THE TIME THE COMPREHENSIVE PLAN WAS DONE, WELD COUNTY HIRED NHPQ TO DO A SURVEY. First, gravel pits, by their very nature, are dirty and spread a layer of dust in a circle well beyond a 500 foot radius which means that we not only will be constantly cleaning but will be hard pressed to rent spaces to people in that environment. Secondly, we have experienced an extremely slow rent-up of the Park and only in the past several months have we seen any increase in the rate of rentals. Permitting a dirty, noisy gravel pit operation with large gravel trucks in close proximity to the Park is bound to seriously hamper our rental program to the point of jeopardizing the finances and pushing the Park into bankruptcy. Thirdly, a gravel pit within 500 feet of the Park will cause a de- cline in land value making it extremely difficult to sell the Park should an interested buyer be found. I cannot overemphasize the adverse economic impact on our Park by the construction and operation of a gravel pit within 500 feet, therefore, I strongly urge you to disapprove the Best Way Paving Company request. As a home owner in this area, I strongly oppose the use of that land for the purpose as proposed. In my opinion there are too many negative as- pects to outweigh the possible good--danger to children in the residen- tial neighborhood, noise and dust, considerable increase in trucks and equipment, and, far from minor importance, an eye-sore in this residen- tial community. I could see just as much sense in having a gravel pit in the several acres that make up our downtown area, as to have one touching this grow- ing residential part of our town. There has already been a great deal of discussion about this proposal , as we all are aware, and quite frankly I have been surprised that the leaders in our community involved up to this point in decision-making on this issue have chosen to throw aside the voice of the home owners in the area (80% opposed). The prior responses from the surrounding property owners to the Best-Way proposal have been overwhelmingly opposed to the gravel pit operation in this residential community. Business people in the City appear to endorse the gravel pit from a monetary viewpoint . They are somehow convinced that the price of gravel will increase if Best-Way has to move the mining operation out of town . I disagree . It seems to me that if Best-Way were to sell the 45 acres to a developer for residential homes , their profits from that sale would more than pay for any relocation charges they might incur . Are not the health and well -being of the surrounding community, as well as the property values of the same if not more importance? A gravel pit and a residential community of this size are simply not compatable, nor do I think any amount of fencing and buffering will solve the problem. The noise from the proposed gravel pit, and resulting traffic would add unnecessary stress to those people. One of the main reasons we moved to this area, was for the peace and quiet plus the fact that our son works nights and must sleep during the day- time. You should try living with someone who can' t get their sleep in during the day - it certainly is not easy on the person or the person ' s family. Has anyone asked what hours they may be working at this proposed gravel pit? No doubt they will be putting in long hours in the summer - interrupting sleep in the days, making nose for those who want to enjoy the out- side in the evenings. And what about weekends? These are questions that need asked! The proposal by Best-Way says that there will be a pond in the area. This would be an ideal breeding place for mosquitoes and other insects. Why add yet another danger to the familys in the area? Mosquitoes carry disease. Why risk disease for so many people? True, there are sprays for insects, but why pollute the air with more chemicals when veto of the Best-Way proposal (and therefore no pond) would eliminate the problem of possible disease. We urge your "NO" votes for the Best-Way proposal! ! We live in Johnson Acres, having just moved here last August from 37th Avenue. We moved to this area for the express reason of having peace and quiet in the neighborhood we -live in. If Best-Way is allowed to start a gravel pit, there goes peace and quiet right out the door! We have made quite an investment in our property and some day hope to sell it, and make enough profit to help us to live out out later years without having to rely entirely upon income from Social Security. If Best-Way is allowed to start a gravel pit, it is very doubtful if our property will grow in value, most likely it will not. Who would want to buy property close to a noisy, dirty, and dangerous gravel pit? Would you? To us, the danger of having a gravel pit this close to several housing developments is a definite danger to children. No matter what measures may be taken to keep children out of the area, their curiosity will surely get the best of them and it is possible that one or more may end up badly hurt or even killed. With pollution a major concern of every city today, surely you must know that this gravel pit would be a definite pollutiant with noise and dirt. Greeley has some pollution now, but definitely not as bad as other cities along the front range let' s keep Greeley and the plains as free from pollution as is possible for our health, the health of the younger generations and the beauty of the countryside! When a person comes home from work, it is their right and privilege to have a peaceful, quiet home atmosphere to relax and live in, after all , this is what we all work for, strive for, and dream of. To raise a family in todays world with all the pressures man has created for himself is hard enough. The intent of this meeting, of course, was to inform local residents within a 500 feet radius about the proposed gravel mining operation, impact (or lack of) of this operation upon the residential area, and the ensuing reclamation plans. After listening to the presentation, I am convinced that the best interests of the residents surrounding this site CANNOT be compatible with the proposed gravel operation. I ask that a special permit for this operation NOT be granted. Approximately 75 to 100 people attended the meeting. After listening to the predictable presentation, the majority of the audience voiced negative reactions. The answers given to pertinent questions from the guests were vague and inconsistent, if answered at all. Too, the speaker made several references alluding to a November 16th meeting and the small but favorable response Lord & Associates received from it. To set the record straight, neither I nor surrounding neighbors received any notification of this meeting. If I or any of my neighbors had any constructive criticism to offer to make this project palatable to us, we would gladly bring our suggestions forth. After much thought; we feel the only solution is to NOT have the project and accompanying ramifications at all. We cannot be convinced that a gravel oper- ation virtually in our front yards can be made attractive by ANY means. A large majority of neighbors feel that a decision granting this special permit would be legally creating a public nuissance. This outcome would affect more than 100 families directly, and countless more indirectly. The commission would leave our families with no feasible recourse. Selling our homes at a decided loss and/or pursuing a lengthy and costly legal course through state agencies to halt the mining operation would hardly be practical, if even possible at all. -2- We have elected you our commissioners with the hope that you will make your decisions with conscience, and with the best interests of the people of Weld County in mind. Therefore , I have requested that my first letter be withdrawn and that this letter replace it . It is unbelievable that Lord and Associates refer to themselves as "ecologists" and "environmental designers . " The report they submitted to you on behalf of Best-Way/Gilsabind Convidar did not include any results of EPA research concerning air pollution of the areas surrounding gravel pits . It did , however , mention "particulate matter (dust) " (p . 28) but gave no data concerning the present dust level or the expected level of increase created by expansion of the mining operation . The report simply stated that the operation was going to attempt to "minimize" (p . 28 and 29) the level of particulate matter . Secondly , in dealing with the problem of water pollution , the report only related that water pollution as a result of the mining operation "should not be expected" and "should not result" (p . 27) . You will note that the report did not say that water pollution will not result from the mining operation . Thirdly , the Lord and Associates" report (p . 27) stated , "No detailed noise studies have been made on or around the site but operations at the site generally produce noise at a low level . " I suggest that any competent ecologist or environmental planner would conduct such studies rather than include in a report such vague and indefinite words as "generally" and " low. " Again , the report describes the attempts of the operation to "minimize" and ( ti I; L s 1" Page 2 Planning Commission 1 - 15-78 "help reduce" the noise level "to the maximum extent possible . " How unscientific and nebulous can any statements be ! Should you think , however , that my feelings can be assuaged by further studies and a revised report , you are mistaken . A gravel pit , no matter how clean and environmentally safe it is , has no place in a highly residential area with many young children and two schools . To allow such a situation to occur would to totally irresponsible . Surely , our Weld County Planning Commissioners and Weld County Board of Commissioners are not that irresponsible . According to the New York Times , June 9 , 1977, IV, 14: 1 , the Environmental Protection Agency is starting a program to find whether there is a public health hazard associated with asbestos dust from crushed rock . The EPA found high concentrations of asbestos dust from gravel operations in Montgomery County, Maryland . The EPA urged this County to take strong measures to cut down on fibers which are believed to cause lung cancer . Asbestos is defined by the Encyclopedia Britannica as a general term applied to any mineral that can be easily separated into flexible fibers . The concerns of the community include all dust created by the gravel pit operation . Since most of the community lives in a southerly direction from the pit and the prevailing winds in this area are from the north , possibilities are tremendously increased that we will experience not only dusty homes and greenery, but that the invisible dust will penetrate our lungs through natural means . It is our contention that no matter how many or what type of filters are used on the crusher or what means are used to lessen the dust during scrapping, that on more days than not , we will be subjected to a threatening menace to our health . Many in the neighborhood already suffer from respiratory ailments such as asthma , bronchitis , and pleuresy . The fine , minute dust particles can only serve to worsen their conditions as well as affect the health of others . Pollution is also a concern of the neighborhood . On October 3, 1974, the Denver Post reported that a gravel pit was shut down by two United States agencies . A Colorado Highway Department contractor was ordered to shut down a gravel pit in Summit County for alleged violations of water pollution regulations . A U . S . Forest Service hydrologist said silt from the gravel pit had polluted six miles of West Ten Mile Creek . The U . S . Environmental Protection Agency issued a similar shut-down order to the firm. This type of pollution poses a danger to the health of many people including farmers who may depend upon the water from the stream in the gravel pit area for irrigation as well as for livestock watering . Noise pollution is also a likely probability in our neighborhood . With large equipment , machinery and rock crushers operating within 500 feet of nearly 200 homes , the noise will definitely be detrimental to the quality of life we now experience in our area . With the wind prevailing from the north , the neighbors on the south side will especially be subjected to the annoying constant din . -2- TO : Weld County Planning Commission 1 /17/78 Ralph Nader reports in the January, 1974 issue of the Ladies Home Journal that the Environmental Protection Agency reports that noise is a serious health hazard to which 40 million Americans are dangerously exposed--at least 17 million in their place of work and others from proximity to Airports , construction , freeways , etc . Dr. James D . Miller of the Central Institute for the Deaf in St . Louis , and EPA consultant , estimates that a constant noise level of 70 decibels may be sufficient to retard development of speech and reading among children . When the noise level reaches 105 decibels , as it may at a busy corner during rush hour , the probability of a hearing loss from repeated exposure approaches 100 per cent . In addition , noise can adversely affect the cardio-vascular system, helping to cause hypertension , peptic ulcers , and an abnormal lowering of vascular tone . Research indicates that noise can interrupt sleep patterns and produce emotional disturbances ranging from irritability , loss of attention , and lower work performance , to more serious paranoidal delusions and suicidal and homicidal tendencies . For these very important medical reasons , and for the reasons presented to you on January 17, 1978 at the planning commission meeting , the concerned citizens of this affected area are strongly opposed to the rezoning of the discribed property at 4th Street extending from 35th Avenue to 39th Avenue and ask that this rezoning for gravel pit operations be denied . Having purchased our home when it was built in 1972, we have invested a great deal of time, money, and effort for improvements over the last five and one-half years. If the request mentioned is granted, the value of our property and of surrounding properties will be affected. In addition, we selected our culdesac home site purposely for a comparatively comfortable noise level. The proposed change would increase the noise level significantly. Because of wind direction, dust particles also will become a serious nuisance. Briefly stated, these are our most immediate concerns. We hope that these points will be considered by the Weld County Department of Planning Services and that some alternatives can be studied. This is not to say that abestos or other fiber-bearing minerals cannot exist within the gravels at that quarry. Rather, I am saying, at this point, only that during my cursory examination of outcrops and rock samples at the quarry I did not encounter any such minerals nor any evidence for their presence. A more definite statement I cannot make without conducting more thorough field and laboratory investigations, including studies of gravel exposures at the quarry, research regarding source areas of the gravel, and possibly some petrographic analyses of selected specimens . That is the qualifications of those who conduct such analyses. Environmental noise analysis with accompanying octave band analysis and, most importantly, the interpretation of the findings necessitates intensive training in either industrial-environmental audiology (hearing conservation with certification in Audiology) or physiological acoustics. Even with that, extensive training in interpretation of the noise samples, e.g. their potential damage to the peripheral auditory mechanism, or their psychological repercussions must have transpired prior to the valid conduct of any noise analysis. Any individual who possesses less training should not attempt to conduct any noise survey or analysis if validity/reliability of the analysis is important for the protection of persons or their environment. Noise is so potentially damaging to people, but, on the other hand so difficult to measure and interpret, all analyses of it must be conducted by extremely well trained professionals, especially in this age of steadilly increasing environmental noise. Yoder : I am writing to advise you and your Department of a situation which I believe to have significant Public Health implications for certain citizens in Greeley and adjacent portions of Weld County. As a concerned citizen, and as a physician engaged in the practice of medicine in Weld County, I wish to make a formal request to enlist the aid of the Weld County Health Department and such state and federal resources as might be necessary to fully investigate these Public Health concerns. Generally, these concerns center around the potential environmental impact of a proposal which would result in a 75 acre gravel mining operation in West Greeley. Currently, Best-Way Paving Company operates an approximately 30 acre gravel mine north of 4 th Street and west of 35 th Avenue. They have an asphalt production plant on the premises and utilise a rock crusher and front-end loader in this strip mining Page 2 . operation. The Paving Company has before the Weld County Planning Commission a proposal to rezone a 45 acre site adjacent to the present operation from estate housing to agricultural use. This would be in conjunction with a request for a special use permit to allow this additional acreage to be mined as a gravel pit thus resulting in the 75 acre mining operation. As you may know, this site is bounded by R-1 single family residential housing south across 4th Street and west in Johnson Subdivision . It is also within one-half mile of Franklin Middle School and Shawsheen Elementary School as well as being close to the rapidily developing residentil areas of Westmoor Acres, Larson Subdivision, and Pheasant Run. Specifically, these concerns center around the potential emissions of industrial pollutants into the air from such a large strip mining and asphalt production operation. The asphalt production plant utilizes hydro- carbon compounds and must of necessity emit certain amounts of sulfur dioxide as a by-product. The rock crusher will create dust, which when combined with the ambiant dust from the natural erosion of the strip mined property, may create volumes of pollutants significant enough to cause increases in respiratory morbidity and mortality. The p.iving company' s proposed mining plan admits that at a certain phase of the operation as much as 600 of the site will be in a "major disturbance" state . Page 3 . The Environmental Sciences Laboratory of the Mount Siani School of Medicine, New York, has recently investigated a gravel mining operation in Maryland . The results of their study have been reported in Science: Vol : 196 , p.p. 1319-1322 , June 17 , 1977 . Because of established geological and geograph- ical principles , this data may have additional relevance to the current situation in Greeley. This study found signif- icant air contamination with asbestos and asbestos-like fibers and fibrils resulting from stone crushing operations in Rock- ville, Maryland. The gravel contained a general type of mineral combination known as serpentine rock or serpentinite. This fibrous serpentine rock is composed in part of chrysotile asbestos and an interlayered platy antigorite or lizardite . The amounts were not such as to make the deposits a signif- icant commerical source of asbestos, hut the potential carcinogenic effects of the air contamination caused by the crushing of this rock was of concern . Their data emphasized the necessity of using electron microscopy rather than con- ventional optical microscopy for analysis of the air samples to search for fibrils smaller than 5 9m. Geological data identifies the major serpentine belts in areas boardering mountain ranges formed by a process known as Alpine Glaciation or Pleistocene Glaciation. These deposits occur extensively alohq the Pastern coast of the United States, the Coastal Range of Caifornia, and the moun- tain ranges of eastern 'Canada . It is also established fact that the front range of the Colorado Rocky Mountains was Page 4 . formed by extensive Alpine Glaciation. Thus it follows that serpentine rock would also he present in this location . Therefore, it is my proposal that a study be undertaken under the direction of the Weld County Health Department to ascertain the potential environmental impact of such a 75 acre strip mining and asphalt production operation as that proposed by Best-Way Paving Company. This study should include statements concerning the emission of hydrocarbon fragments and sulfur dioxide as well as dust contamination by the rock crusher. There should also be an analysis of the gravel to determine whether or not any amount of serpentine rock is present. If serpentinite is present, further analysis using electron microscopy should be done to determine whether chrysotile asbestos, antigorite, or lizardite is being emitted into the air and carried by prevailing winds to adjacent residential areas . I would appreciate a reply indicating your response to this request as well as periodic progress reports if such a study as I propose is actually undertaken. Chemical agents, or measures equally or more effective than chemical agents, shall be used properly so as to control fugitive emissions from the overburden and reject piles and from haulage road- ways included as part of the entire operation. 6. The applicant shall retain the services of a certified meteorologist and shall follow his longrange and shortrange forecasts and instructions re- garding the best practical times for blasting and shall set its blasting schedule so as to minimize the escape of any resulting fugitive dust from the property into the northeast and southeast quadfant+s. Blasting shall be limited to the period between 8:00 a.m. and 5:00 p.m. Monday through Friday.
