• n A, RESOLUTION RE: ADDITION OF STREETS WITHIN CARMACAR RANCHETTES SUB- DIVISION, LOCATED IN PART OF THE EAST HALF OF SECTION 5, TOWNSHIP 1 NORTH, RANGE 68 WEST OF THE 6th P.M. , TO THE COUNTY ROAD SYSTEM. WHEREAS, the Department of Engineering Services has recommended to the Board of County Commissioners of Weld County, Colorado, that certain streets within the subdivision known as Carmacar Ranchettes, be added to the County Road System and accepted for full maintenance, and WHEREAS, the Board of County Commissioners has studied the recommendations of the Department of Engineering Services and has determined that the developer has fulfilled his ob- ligations under the Weld County Subdivison Regulations , and that the acceptance of the above-described streets is in the best interests of the County of Weld, State of Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that certain streets lying within the Carmacar Ranchettes Subdivison, located in Part of the East Half of Section 5, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Spruce Drive . 33 mile m/1 Pikes Peak Street . 25 mile m/1 Fir Avenue .39 mile m/1 Aspen Avenue . 37 mile m/1 Aspen Court . 05 mile m/1 Mt. View Street . 26 mile m/1 Longs Peak Street .18 mile m/1 TOTAL 1.83 miles m/1 be and hereby are added to the Weld County Road System, and accepted for full maintenance by the County. This office has been working with the developer since 1974 to get the streets to meet County standards as required at acceptance time . The County Engineer and I have both inspected the streets and it is our recommendation that the following graveled streets be added to the County Road system: Spruce Drive .33 mile m/1 Pikes Peak Street .25 mile m/1 Fir Avenue . 39 mile m/1 Aspen Avenue . 37 mile m/1 Aspen Court .05 mile m/1 Mt. In the very near future we plan to install them. Some random survey shots were made by one of our engineers and the following items should be corrected. 1 . The CMP in Longs Peak Street just west of Aspen Avenue has 0 .6 ' cover and will require 0 .4 ' more cover. 2 . From the discharge end of above mentioned tube a ditch should be constructed so water can drain away . 3. CMP across Aspen Avenue , north of Mount View Avenue has only about 0. 1 ' cover; there , this will require additional cover of about 0. 9 ' , also the east tube at the intersection of Mount View Street and Aspen Avenue will require about 0.5 ' more cover and the west one about 0. 3 ' more cover . 4 . The CMP across Aspen Court will require about 0. 8' more cover . 5 . It is suggested that a CMP be installed on Spruce Drive in the low spot , from Lot 2, Block 6 to Lot 4 , Block 5. 6 . Clean and smooth up borrow pits and clean out around all drainage CMP' s . 7. All trenches that have settled shall be restored to grade . .`o Mr. William E. shade 2 June 16, 1975 8. Streets should be re-aligned in the areas where lot pins are in street areas, such as the pin for Lot 7, Block 3 , in Aspen Avenue. 9. On May 30 , 1975 an inspection was made and it appeared the domestic water line was broken in several places as water was coming to the surface and running down borrow pits , this should be corrected. 10 . Streets widened to provide a minimum of 2 ' shoulder on each side . 11. Intersection radius needs to be increased in areas such as the intersection of Pikes Peak and Spruce Drive. Several cross tubes have been installed since the last inspection leaving the road surface in these areas fair- ly rough , with at least one. needing more cover . It appears that the West tube at the intersection of Mountain View Street and Aspen Avenue is not installed on grade . Aspen Court is still just roughed in and is not passable at this time . Other streets appear to be narrow in places and shoulders need to be shaped. Water lines have been installed across the road surface and will need to be re-graveled in some cases . At this point and time I would recommend to release the hold on building permits in this subdivision with the understanding that r� subdivider can not complete the necessary work to be done due to weather conditions , and that as soon as weather permits in the Spring , he shall complete all work to bring Carmacar Subdivision to County standards . g n d r•p ,.- - 8---rd. 1y _. W' COUNTY COMMISSIONERS INSPECTION REPORT fJr K1 :15 DATE December 6, 1974 II PROJECT: Carmacar Ranchettes Subdivision - "+nttLEY. COLO. • LOCATION: Co. Rd. # 5 South of S. H. # 52 F PERMIT. # REPORT: At this time the indication is that the water lines are still being worked at and not much visible change from last inspection . There were 2 or 3 more fire hydrants visible . The streets are in the same condition as last inspection except ruts, and dirt dragged upon the graveled surface by equipment working, shows up real clear in certain areas . Short access tubes for the two houses on the south end of the subdivision have not been corrected and I noticed 2 others with ends caved in on the North side of said subdivision . The flow line of the borrow ditches are very irregular and to the naked eye it looks like many low places for SKETCH water to stand. Cross tubes have not been installed at this time. PERMIT # Very little change at this inspection except water pipe is now on location REPORT:_ and lorated along the streets on the west side of subdivision At this time there Are no cross tubes installed and a final_determinatinn should hP_made where these are necessary. There__is evidence that trucks have been along these streets and soft spots are showing up. I would suggest a close check of this prior to acceptance as base might be forced down into the mud and require additional base to be placed. There is no way to tell if streets are in the correct place as no stakes are there to go by. Access tubes for the two houses on the south are very short and a decision should be made if they are acceptable. COLO. Box 837 Longmont, Colorado 80501 Re: Carmacar Ranchettes Dear Mr. Brown: This letter is in response to your letter of October 30, 1974. We have made several inspections of your street construction pro- gress in the past several weeks. Our inspections indicate that the majority of the streets have received base rock of various thickness and width. Soft spots and rutting have occurred in several of the streets. Several of the streets are narrow with deep borrow pits. There appears to be drainage problems at: intersection of Pikes Peak and Aspen, Aspen and Mountain View, and across Longs Peak south of Aspen. The following specifications shall be considered as minimum: 1 . 24 foot surfacing 2. 2 foot shoulders on each side of surfacing 3. Minimum of 4" of base, exclusive of any material lost in soft areas. 4. Proper drainage along and under the streets Since the majority of the base has been placed we will not require any additional bond but will retain the $15,000 existing bond. Bailey Construction Co. finished delivering gravel to us this morning about ten O:Clock and we started laying it , compacting it and finishing the roads up on Monday morning at 7:00 A.M. we have everything comp- leted except Longs Peak Street and Fir Avenue and those streets have the gravel on them but we didn't get to complete laying it out prior to the rain that hit this morning about ten O:Clock, We also have some three hundred feet on Aspen court to finish but will just have to wait for a break in the Weather, we hadntt done anything towards that street because the water ditch had been open, we started to cut it in last Saturday and Sunday got busy on Monday laying the gravel in the rest of the area and it got to wet before we could get to it today but at most I would say we are looking at two weeks subject to weather of course. . I hope having the roads completed does away with the need for the addittional bond you mentioned in your letter because when I called the bonding company they were so spooked by all that has happened thus far as to threats by the county etc. that they are very adamant about issuing anymore bond. As to the Water Contract and bond the fellows who we awarded the contract to went Deer hunting and will have the contract to us by early next week and I will get a copy of that to you as soon as we get it from them. Mr. Gilman Olson Assistant to The County Commissioners Dear Sir: Concerning our conversation this week with regards to Cannacar Ranchettes,first a brief history of my understanding of everything to date. Mr. Carpenter and a couple of business associates subdivided this property in Late 1969 and it be- came a county approved subdivision on January 19, 1970. At some later date they sold the interest they had in the property to a Mr. Kenneth Gattenbein and pro- ceeded in the pursuit of there many other business interests, Assuming that a prudent buyer with money up and a mortgage back to them would look after his own and their interests, never really paid much attention to the project. They had reason to become concerned about 14 months ago when there payments on the indebtedness were late in coming , their first action was to contact Mr. Gatten- bein and inquire as to his financial well being, he assured them that the prob- lems were under control and he would get back in tune with his financial obliga- tions to them and did in fact get everything current at that time and advised them that he had some problems (Financial) but could get them worked out in a reasonable time. As I understand the situation he has suffered some overwhelming financial setbacks and is now beyond help. When they realized his dilema fully they proceeded to get the property back and this has just been accomplished. I have been in the development business for many years and have done business with the principals of this Subdivision for many years -and they contacted me,explained the basics and asked me to go to work on it. I wan't interested in going to work for them so I bought the property subject to a loan of course and proceeded to get it whipped into shape so that it might be sold. I leased a motor grader and hired an operator to nm it and started grading roads and replacing stakes that had been lost in the weeds and knocked over since they were installed over 4 years ago. I contacted Left Hand water users and came to an understanding with them as to what was needed to get the water system funct- ioning , contacted Rocky Mtn. Natural Gas for service, contracted with Bailey Concrete products for gravel for the roads, called Mr. Don Morgan Gravel Foreman for some advice as to how the county wanted the roads graveled. Mr.. Gilman Olson Page 2 October 11, 1974. I was advised that Mr. Morgan couldn't assist me and that I should get in touch with the county Engineer for the assistance and advise that I had requested. If you would please keep in mind this was all done prior to the article in the paper. I propose to continue with the project and submit the following timetable for the completion of the various phases . Water: We have reached agreement with the Left }land water users of Niwot for the completion of the water system and have there assurance that they will connect every home ready for water immediateley. The contractor provides for completion of the system prior to years end, and the system is guaranteed and bonded for a year, under the terms of our contract with him. Natural Gas: We have negotiated an acceptable agreement with Rocky Mountain Natural Gas Co. Fredrick Office , and they are in the process now of drawing a contract for installation of the feeder system. Mr. Stells wasn't available this date for a completion date however I would assume it wont take much longer if any than the Water system. �t Roads: I have worked seven days on reteina the roads cut and should have them youpretty well laid out prior to YoU.X..'66646t hZ8 of this letter. I have contracted with Bailey Concrete products of Erie Colorado for 6,000 tons of crushed gravel, and will start delivery as soon as the water lines are out of the way. Weeds: I have spent several days getting some of the weeds knocked down and plan to continue until they are all down, and once they are down I will keep them down on the unsold lots. I have submitted the initial paperwork to the Farmers Home Administration in order to get this Subdivision approved for Farmers Home Administration funding for homes and have been advised that it would qualify if and when the county accepted the roads and the utilities were in. Mr. Olson : needless to say I regret that I got into this thing at such a late date and came in unaware with all of the problems that exist within the Sub- division, However I submit that I am a liscensed subdivision developer and have been since this designation was adopted by the Colorado Real Estate Commission,, I have several successful developments behind me including Brownsville, Shannon Esates and Hillcrest Heights in Boulder County, The Sherri Mar Addittion in Larimer County, Dream Acres , Glens of Decant), Milton Lake Estates and many farms before the regulations prohibited the cutting up of them. Due to Carmacar's developer's lack of regard for regulations and plans submitted with his application for the development this Board of Commissioners will allow no more building permits to be issued for that ranchette until roads are constructed to County standards. People should not be sold property only to discover that due to road conditions their property is extremely difficult to reach. We are aware of other problems with Carmacar and sympathize with persons now facing inconveniences there. Due to Caxmacar's developer's lack of regard for regulations and plans submitted with his application for the development, this Board of Commissioners will allow no more building permits to be issued for that ranchette until roads are constructed to County standards. People should not be sold property only to find that due to increasingly poor road conditions their property is extremely difficult to reach. We are aware of other problems with Carmacar and wish to halt the inconveniences people living there are facing. The concern which prompted your signing the petition is appreciated and please be assured that we will do all in our power to enforce the regulations of the County in this instance. The developer has not contacted this office in the past month regarding the roads. 4. The water line system is still not functioning properly. I would like to make the following recommendations; 1 . The existing bond for approximately $15,000 should be called in immediately by the County Attorney. 2. The County should place gravel on the streets servicing the existing houses prior toiwinter. 3. The possibility of vacating all streets not serving existing houses should be explored. 4. All building permits on streets being considered for vacation should not be issued. 5. INSPECTION REPORT DATE August 23, 1974 PROJECT: Carmacar Subdivision Roads LOCATION: Part of the E 2 Sec. 5-T1N-R68W PERMIT # REPORT: All vacant areas in this subdivision seem to be covered with weed growth to a height of 5 to 6 feet making it very hard to inspect streets. In my opinion an attempt has been made to flat blade the weeds from a portion of some of the streets without regards to stakes. About the South half of Aspen Avenue was torn up by a deep ditch with a large ridge of dirt, indicating the fixing of the water line. At this time very little progress has been made to get the streets in this subdivision in shape. A/j indications are that this whole area is a potential fire hazard due to the tremendous amount of now drying weeds . This office has also been contacted by the Weld County Engineer, concerning a seeming lack of co- operation on your part to complete the streets as you agreed to do when platting your subdivision. This letter is to advise you that you are to begin construction of the promised road improvements within ten days of receipt of this letter and that said roads should be completed as soon as possible and in no case should the roads remain unpaved and below county standards beyond October 1, 1974. This office also recommends that you do the roads in front of all homes as a priority over interior unsold lots, inasmuch as these are the people who are greatly inconvenienced by your failure to put roads in the subdivision. Upon failure of your proceeding to improve the roads as we have for- mally requested of you by this letter, it will be the intention of the Board of County Commissioners through this office to proceed against the bond- ing company and at that point pave the roads using county equipment or some other contractor and use the bond monies to provide roads for the Carmacar Ranchettes. Further if said compliance is not had and the county is obligated to provide these roads, to the extent that the bond may not cover the entire required work, it is the county's intention to hold you liable for the same regardless of bonding. We are aware that some construction and maintenance is required in our subdivision. As I advised you, a broken water line caused a severe wet spot or lake which has not dried out sufficiently to grade roads. We had a maintainer at the site for over 30 days but were unable to operate due to mud. We anticipate its availability for our use again in the next few days. As I advised you , our rapport with our residents is generally very good except for one very unstable resident who has gone as far as to threaten some of the County building department staff. We assure you of our continued cooperation in meeting county requirements and standards. Shelton McKim. This inspection was due to a complaint from the present home owner and is not to be assumed as a final or any other inspection by Weld County Building Department . The last in- spection of record in this office of this home was made on 2-18-72 on framing , here the home is said to be complete and occupied ; a violation in itself . We as an office , notice that the builders are very lax in calling in proper inspections , even to this date ; a situation which must be remedied . Following , a list of violations and errors found by the building official : 1 . Fireplace has never been inspected , hearth is failing , needs support. Firebox is cracking needs repair . Very unsafe in this condition . 2 . Support beam under crawl space in violation . Ends not properly supported , center posts not proper size - requires at least 4" x 6" or better. Ends need solid support on foundation wall , no wood allowed other than beam itself . Structurally un- stable - may fail in a few years . 3 . Found hollow core door from garage into basement , Pre- sent door loose fitting and gap at top consealed with stripping . This requires a tight fitting solid core door. 4. Siding on exterior of home is loosening and bowing out in many areas , needs renailing to conform to code , 5 . Grade too low on south and west sides - needs more fill dirt . Upper north window in master bedroom loose on bottom, needs renailing , also others need same attention and caulking ' for weather tight seal . 7 . Steps from garage to basement - treads too small . Have discussed this with builders and will remedy as best as possible . 8. Tile in bathroom, uneven and very poorly grouted . Needs regrouting over all and in places reglueing . Shower door has sloppy fit needs fixing and grouting or caulking . 9 . Board below brick level on west side needs removing , too close to grade. 10 . Garage walk-in door binding . Notice no shims around jamb . Suggest chiming and renailing . 11 . Garage overhead door not fitting tight to floor which is required . Suggest taking weather guard off the bottom and scribing and cutting to conform to garage floor then replace weather guard . Gentlemen , there is undoubtedly many serious violations here as well as some hot so serious . However , I am sure you will agree that with prices as they are today any violation is most near a disaster to the home owner and in my mind justifiably so .
