Based on the meeting in May and the provided 2018 Technical Revision. Weld County will
not require an FHDP for planned reclamation because the changes are being incorporated
in to the CHAMP study. Additionally, the current asphalt, concrete etc. recycling activities
as permitted under USR-616 may continue even after the OMLR permit release.

Good Afternoon, Diana.
On 18 July 2018, I left a copy of a Technical Revision (TR) submitted to the Colorado Office of Mined
Land Reclamation (OMLR). Since we did not hear back from you in this regard, it seemed
appropriate to revisit this with you to be sure you had seen the original correspondence.
Included with that TR was correspondence directed to your office with a request that you affirm
representations we make in the TR pertaining to post mine land uses, as follows:
1. Weld County will not require an FEII)P for planned reclamation: and,
2. Recycling activities and associated areas and facilities are authorized
under the existing Weld County LISP to continue post ()MLR permit
release.
Since the TR makes representation of determinations made by your office that are integral to the TR
and our planned post mine land use(s) - it created a necessary courtesy for us that you have
opportunity to acknowledge and affirm that our representations of those determinations are true
and correct. A copy of our original correspondence to you of 18 July 2018 is attached for your
reference.
You should already have a copy of that correspondence and the Technical Revision submitted to
OMLR, as of the date of that correspondence. Regardless, if you would like either a digital or paper
copy of the TR, please let me know and I'll either send or deliver it personally, depending on your
preferences.
Subsequent to your review of these materials, please direct your correspondence affirming the
understanding there -in to my attention. Feel free to reply either via e -Mail, or by overland mail.

Attached is a copy of our planned Technical Revision to the Colorado Office of
Mined Land Reclamation (OMLR). You should find the application consistent
with our meeting of 31 May 2018, that determined planned reclamation and
planned uses of the location may proceed according to existing flood plain
conditions reflected prior to the conclusion of the pending CHAMPS study for
this stretch of St. Vrain Creek.
As such, planned agricultural activities may proceed over the parcels, including
Area 3 Part A - as reflected on the included map. Further, existing approved
recycling plant and correlated stockpiles may proceed unimpeded subsequent to
release of the location under the OMLR Permit - and consistent with the existing
Weld County USR 616 within and correlated to the ••10.0-f- /- acre Area 3 Part B.
Area 1 scalehouse and associated activities will continue to support the planned
and continuing activities of Area 3.
All continuing uses are consistent with information provided and reviewed by
Weld County Planning in May 2011. The Planning Department at that time
determined that the activities described here -in did not rise to the need of a
Minor Amendment with the Planning Department.
The included map is consistent with information provided in May 2011, except
that planned grassed buffer strips have been enhanced by changing the location
of the 50 -foot grassed buffer. Instead of the planned buffer placement along the
southern edge of the recycling yard, it will instead form a 50-footcombined
buffer at 25 feet in width along both banks of the existing drainage ditch that
traverses the north boundary of the recycling yard.
To better provide assurance to the OMLR as to our standing with Weld County,
on your review of the Technical Revision submittal materials, please affirm via
e -Mail or written correspondence that:
1. Weld County will not require an FHDP for planned reclamation: and,
2. Recycling activities and associated areas and facilities are authorized
under the existing Weld County USR to continue post OIVILR permit
release.

Submitted, find one signed original and one copy of a Technical Revision for the above
permit, along with the required $ 216.00 Fee (Check #: 18862). Varra Companies, Inc.
is preparing the above referenced project for final reclamation and release of the OMLR
Permit referenced above. There remains a resident need to clarify the continuation of
some activities commenced under the OMLR permit.
To this end, Varra Companies met with Weld County Planning Staff to clarify the status
of operations with Weld County once an OMLR release of the permit occurs. In a
meeting with Kim Ogle and Diana Aungst on 3 May 2018, Kim verified that the planned
post mine activities and uses do not require further permitting with Weld County.
Specifically, recycling activities may continue under the authorization of the existing
USR subsequent to the release of the permit by the OMLR. This acknowledgement is
based upon an earlier understanding established in May 2011 with Planning Staff and
Tom Parko, Director of Weld County Planning Services.
Further, on 31 May 2018, Diana Aungst, Weld County Planner and Floodplain Manager:
indicated that no FHDP or other floodplain permitting are needed:
• The Dakolios Map as approved by the OIMILR by Technical Revision in 2013 is
included with this correspondence for ease of reference. Also included as part
of this Technical Revision is a revised map altering the relocation of the planned
vegetative buffer strips (necessary to better protect the reclaimed
seep/irrigation ditch traversing Area 3). Beyond that - no other changes are
anticipated, with the exception of some clarifications, detailed as follows.
• The two reservoirs shown (Areas 2 and 4) are completed and shorelines re -
soiled and vegetated. The planned scalehouse and stockpile area surrounding it
is outside and above the present day 10- year floodplain.
• Area I is outside of the present clay loo -year floodplain. Weld County is aware
and acknowledges that the existing scalehouse and yard that presently occupy
this location, supports on -going and continuing recycling activities and will
remain in place and active subsequent to planned OMLR release. The remainder
of the focus is upon Area 3.
• Area 3 outside the buffer strips pertains to:
1. Sub -area A: These are locations for planned agricultural stockpiles and
mobile equipment which lie within the approximate WO -year floodplain,
consistent with that for common agricultural activities found in the A -
Agriculture Zone.
2. Sub -area B: The location of the concrete and asphalt recycling processing
equipment and stockpiles - which are also outside and above the approximate
1.00 -year floodplain -- are activities consistent with that found in the A -
Agriculture Zone and acknowledged as an allowed use under the existing
Weld County USR 616; and will remain so subsequent to release of the °MLR
permit.
3. Sub -area C: This is a defined area of a 4.0+1- acre buffer strip and
vegetative filter to better stabilize and segregate lands from planned
activities. The strip has been modified from the previous Technical Revision
by changing the location of the buffer from along the southern boundary of
the recycling area, to 25 feet either side of the existing buffer strip - where it
will provide the greater benefit. Please refer to the revised Reclamation Plan
Map included with this revision.
• With the completion of grading, soiling, and revegetation of all areas other than
the 4.0+ /- vegetative buffer of Area 3(c), no other reclamation activity remains.
For this reason, the existing $87,200.00 financial warranty may be reduced to the
current cost of seeding the 4.0+ /- acre buffer strip, $124.43/acre x 4 Acres

of buffer, for a total warranty of $497 72 for seed (source Buffalo Brand Seed,
a k a, Sharp Bros Seed, Greeley, CO) plus the cost of labor and equipment
(tractor and drill) to accomplish the same An updated and enhanced
revegetation mixture is provided, along with current costs determined based on
information gathered with the assistance of Sharp Brothers Seed in Greeley, CO
