The project team held a "PUC hearing preparation meeting" on August 8, 2018, during which lawyers from UPRR, Weld County, and CDOT (AG's office) discussed the upcoming hearings and how best to prepare. During the meeting, Weld County indicated that vacate plans for the crossings would have t4 be approved by the BOCC, which we had planned on previously. However, it was suggested tha$ the vacate plans be app[oved.,ngw rather than after PUC approval had been obtain effectively allowing closure Or tri Crossings in the near term. My understanding is that this wad the method used to close 5th Street in Eaton while PUC approval is pending. ASSESSMENT There are several benefits to this option: 1) The crossings we have deemed unsafe will be closed sooner, reducing the potential for crashes in the near term 2) CDOT fulfills our obligation to UPRR for the Group 1 closures 3) Weld County residents still have an opportunity to comment before the BOCC, as notice of the vacate must be provided ten days prior to the meeting 4) Gregg Carson suggested that locals may be more inclined to bring their concerns before the BOCC than the PUC as they will be in Weld County rather than traveling to Denver There are also potential drawbacks/ risks: 1) We must push back the pre -hearing conference (scheduled for August 20) such that we are not pursuing the vacates without the judge's knowledge (medium risk; though this will certainly impact the schedule, the potential payoff of earlier closure has been approved by UPRR) 2) Though this is a step that must eventually be taken, it may seem that we (especially Weld County) are trying to skirt the PUC process (medium risk; it will likely come up but it could be argued that Weld is just trying to make the system safer) West Greeley 110601 W 10th Street, Greeley, CO 80634 www.coloradodot.Info CDOT 000158 3) Should the administrative law judge feel we are trying to dodge the process, it may delay the process or even result in a negative ruling (minor risk; this seems unlikely as we are arguing on the basis of safety improvements) 4) I do not know what the political implications will be of this move; it seems that the Commissioners will have to make a potentially unpopular decision, and the certainty of them doing so is certainly questionable, but their vote to submit the closures to the PUC seems to imply consent already RECOMMENDATION This is obviously a decision that Weld County make. I think it would be prudent to run this by Johnny ASAP. MEETING NOTES • All of the Group 1 closures but WCR 29 are going to a hearing • Part of the PUC decision on WCR 29 was that the crossing cannot be complete until rail crossing improvements at WCR 34 are finalized CDOT 000288 •--Rob received information regarding the hearing schedule on 8/7/2018 • WCRs 72 and 104 will be presided over by the same Administrative Law Judge (ALJ)2 but ruled on separately. • There will be a pre -hearing conference for 72 and 104 on August 20 at 1:00 in Denver, the purpose of which will be to schedule hearing dates and submittal deadlines • DECISION: Lawyers from UPRR (private firm), CDOT (Gregg Carson), and Weld (Bruce Barker) will attend the pre -conference hearing • WCRs 35/46 and 2.5 will be presided over by a different judge; dates for these closures have yet to be determined • There continue to be updates to the PUC dockets after the deadline. FHU will continue to check for updates. • We will need a subject matter expert from each of the entities; tentatively, CDOT's representative will be Rob Martindale, Weld's will be Elizabeth Relford and/or Don Dunker, and UPRR's will be Lance Kippen • We want to illustrate the difference in emergency response and school busing based on the before and after closure situations • Need to interview emergency responders (fire, police, and ambulance) and school bus services where applicable to get feedback on re routes 4414 -estimated added timeimpacts • ACTION: FHU will prepare exhibits illustrating the location of emergency response facilities and residents/businesses impacted by the closure after information is provided by emergency responders/school districts • Single contact for ambulance services throughout the corridor • ACTION: Elizabeth will compile list of contacts for other services • ACTION: Steph (FHU) and Chad will contact emergency response personnel to determine alternative routes and potential delays • Need to review public meeting sign -in sheets to determine if business owners with new locations were aware of the potential road closure prior to permitting • ACTION: FHU and Elizabeth will compile public meeting sign in sheets for PEL and closures meetings • We want to illu 5trate the improvements to adjacent intersections intended to improve alternative routes • We will consider the worst case scenario when looking at detours, rather than addressing individual PUC responses; it's possible that the judge wilt allow public comments prior to the hearing and additional people may show up. This status report will replace the meeting originally scheduled for the afternoon of 4/3/2018. In addition to the write-up, I attached an updated action log and project schedule. PLEASE REVIEW this document and let me know if you see anything unusual. I would like to be able to shift meetings when they are not absolutely necessary so I can respect everyone's busy schedules but I can only do that if we get feedback on status reports like this. LIST OF CLOSURES o @Weld County indicated that UPRR might be amenable to switching WCR 18.5 and 4 for 'NCR 37 and 78 o Changing these closures would mitigate the substantial public pushback we have received so far on 4 and 18.5 o The public has not yet been informed of the potential closure of 78 and 37 o ACTION: Team to d=scuss the necessity of a public meeting for the closure of 78 and 37 at the next status meeting CLOSURE APPROVAL PROCESSES Approval processes include the PUC application submittal, Access Control Plan modification, Weld County Board of County Commissioners (BOCC) approval, and the Weld County/CDOT IGA(s). It was suggested that the City begin working with the DRCOG to submit this as a potential project to be approved. The closures that require detour improvements are classified as Group 2, and include WCR 100, O Street, WCR 33, 30, 18.5, and 4. In recent discussions with Weld County, they suggested that the closure of WCR 78 and 37 will replace 4 and 18.5, though UPRR has not yet approved these changes and Weld County indicated the need for further discussion. SCHEDULE Upcoming tasks include finalization of the IGA with Weld, submittal of PUC applications, approval of closures through the Weld BOCC, and approval of ACP amendments for 29, 35/46, O Street, 72, and 18.5 if it is retained. Group 1 PUC submittal will take place following finalization of the IGA and approval from the Board of County Commissioners. Assuming minimal public pushback, closures will begin early summer 2018. Group 2 closures will likely begin late summer 2018, and may extend out to 2019 based on the required detour improvements. BUDGET Initial cost estimates indicated that detour improvements will cost more than $13M. Following internal discussion, CDOT's allocation has been capped at $6M. Detour improvements will need to be budgeted accordingly. Per Rob Martindale (CDOT railroad specialist), additional funding (up to $5.4M, with the potential for more based on a March 30, 2018 conference call with Fl -I WA) will be available through Section 130. Where we use Section 130 money, we will need to follow NEPA requirements along with the Federal Section 130 regulations. IGA CDOT prepared a draft IGA between CDOT and Weld County to identify detour improvements and quantify funding necessary to close the roads and construct the improvements. Following iterative review by both CDOT and Weld County, an updated 1GA will be ready to submit to the AG's office by May 4, 2018. ISSUES Detour improvements and cost estimates are preliminary, and may change based on feedback from Johnny Olson (Region 4 RTD), Weld County, or UPRR. US 85 is offset approximately 300 feet from the intersection. In addition to closing the railroad crossing, access from WCR 33 onto US 85 from the north will also be closed. There has been little public pushback on this project, primarily due to the industrial development on the southeast corner of US 85 and WCR 44 and associated improvements, including a developed access south to WCR 42, east of the railroad. WCR 33 will remain open as a detour during construction of the Peckham interchange; closure will occur subsequent to interchange opening. As such, this is a Group 2 closure. SCOPE All improvements will occur concurrently with the Peckham interchange project. Improvements include removal of railroad signage, removal of asphalt pavement and a cul-de-sac or hammerhead on the southeast side of the crossing. US 85 work potentially includes the removal of auxiliary lane signing and striping, but final improvements to be determined concurrent with the Peckham interchange design. Access to the south frontage road will remain, although access will be restricted. ROW may be needed for improvements for cul-de-sac or hammerhead. The intersection of WCR 46/34 and US 85 is located just north of Peckham. The railroad is offset approximately 50 feet east of US 85. An amendment to the Access Control Plan is needed for the crossing closure. Western access off of US 85 will not be removed. This is a Group 1 closure, and has generated little public reaction. The connection between WCR 46 and WCR 35 on the east side of the tracks is parallel to the tracks and within UPRR ROW. This road will likely need to be shifted in the future. SCOPE Phase 1 improvements include installation of barriers and barricades, removal of railroad signage, removal of asphalt pavement. US 85 work includes the removal of the left turn deceleration lane, right turn deceleration lane and right turn acceleration lane signing and striping, and installation of detour signing and striping. Phase 2 improvements associated with this closure include reconstruction of the connection of WCR 46 into WCR 35 outside of railroad ROW and associated ROW acquisition. US 85 work includes potential reestablishment of east drainage ditch between US 85 and UPRR. US 85 is offset 200 feet west of the railroad. Closure will require an amendment to the Access Control Plan. Adjacent business owner feedback has led to further consideration of supplemental improvements as mitigation for the closure, including a "Michigan U" south of the intersection on Bypass US 85 and intersection improvements on WCR 41/WCR 66 and WCR 41/O Street. These supplemental improvements are currently under consideration. Weld County will not close O Street until detour improvements are constructed. UPRR indicated that the O Street closure was their highest priority. This is a Group 2 closure. SCOPE Phase 1 improvements will include installation of barriers and barricades, removal of railroad signage and removal of asphalt pavement. US 85 work includes the removal of the left turn deceleration lane, right turn deceleration lane and right turn acceleration lane signing and striping. The various detour improvement alternatives are being assessed. The Town of Eaton was asked to withdraw their Energy & Impact Grant Application as intersection improvements needed at WCR 39/72 are developer -driven. Safety equipment ordered for this intersection with Section 130 money will be used at Sth Street. SCOPE Phase 1 improvements will include installation of barriers and barricades, removal of railroad signage, and removal of asphalt pavement. No improvements necessary on US 85. Phase 2 improvements associated with this closure include a cul-de-sac or hammerhead on the east side of the crossing. WCR 100 is a gravel road and US 85 is offset approximately 100 feet west of the railroad. This is a Group 2 closure because the Town of Nunn has requested an east/west connector road. Weld County will enter into an IGA with the Town of Nunn to use funding to construct WCR 98 between US 85 and WCR 29. CDOT will need to make improvements on US 85 similar to the auxiliary lane improvements at WCR 100. In addition, WCR 31 between WCR 100 and WCR 98 on the east is a gravel road that will need to be widened and treated with magnesium chloride. Weld County will include these improvements within the IGA with Nunn. SCOPE Phase 1 improvements will include installation of barriers and barricades, removal of railroad signage, and removal of asphalt pavement. Improvements on US 85 include signing and striping. The Town of Nunn has insisted that detour improvements be complete prior to closure of WCR 100. Weld County will do this work, and share ROW ownership with the Town of Nunn, so ROW acquisition will not be required. Phase 2 will include improvement to WCR 31 east of the tracks. Weld County may need help with the costs of the initial application of magnesium chloride. Should a cul-de-sac or hammerhead be necessary east of the tracks, ROW acquisition will be required and substantial utilities will need to be relocated. US 85 is offset approximately 60 feet west of the railroad. Closure of WCR 78 will require an amendment to the Access Control Plan. This 's a Group 2 closure. WCR 37 is a paved road that intersects US 85 just south of WCR 78. Closure of WCR 37 and 78 must occur concurrently for UPRR to receive the operational benefit. This closure is intended to replace WCR 18.5 and possibly WCR 4 in the ROW Agreement. There has been little pushback from the public, but th's closure was not part of the original public meeting so the extent of opposition is unknown. SCOPE Phase 1 improvements wi l include installation of barriers and barricades and removal of railroad signage. No improvements necessary on US 85. Phase 2 improvements associated with this closure include a cul-de-sac or hammerhead on the east side of the crossing and construction of a roadside ditch between US 85 and the tracks. ROW acquisition will be required for the cul-de-sac. This closure requires a connector road between WCR 37 and WCR 76. The Eaton Draw floodplain is located in this area. UPRR has indicated that they will allow construction of the connector road in their ROW, and that the landowner is under a lease with them that they are able to terminate if necessary.
