FINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING APPLICATION FOR COUNTY DANCE HALL LICENSE NUMBER 0393, EXPIRES DECEMBER 31, 2018, AT 12:00 MIDNIGHT, AND AUTHORIZE CHAIR TO SIGN - EL CENTENARIO ENTERTAINMENT, LLC, DBA EL CENTENARIO NIGHTCLUB The application of El Centenario Entertainment, LLC, dba El Centenario Nightclub, 10763 Turner Boulevard, Unit 1, Longmont, Colorado 80504, for a County Dance Hall License, came on for hearing on the 18th day of April, 2018, at 9:00 a.m., and the Board of County Commissioners of Weld County, Colorado, having heard the testimony and evidence adduced at said hearing, having considered the testimony, evidence and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1. That the premises is equipped with sufficient water, lighting, parking and restroom facilities to accommodate the number of persons expected to attend dances thereon. 2. That the premises is not in such a state of disrepair that it is more likely than not to be a safety hazard to persons expected to attend dances thereon. 3. That if the premises consists of an enclosed structure, the structure is sufficient in size and fire rating to safely accommodate the number of persons expected to attend dances therein, and all requirements of the applicable fire department, district or authority have been met. 4. That the premises is capable of being accessed from a public road, street or highway safely without causing an increased risk of accidents. RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, El Centenario Entertainment, LLC, dba El Centenario Nightclub, presented the Board of County Commissioners with an application for a County Dance License to hold public dances at the location described as follows: 10763 Turner Boulevard, Unit 1 Longmont, Colorado 80504 WHEREAS, said applicant has paid to Weld County the sum of TWENTY-FIVE AND 00/100 DOLLARS ($25.00) for said Weld County Dance Hall License, and WHEREAS, the Board deems it appropriate to grant a Weld County Dance Hall License to El Centenario Entertainment, LLC, dba El Centenario Nightclub, and (.,ca: 5Oc RS/ Tr/aac ), c.oac PH(Bc), O-PPL , ot.PPL REP °co/IBC/ lca' 2018-1196 LC0042 DANCE HALL LICENSE - EL CENTENARIO ENTERTAINMENT, LLC, DBA EL CENTENARIO NIGHTCLUB PAGE 2 WHEREAS, said license shall be issued upon the express condition and agreement that the public dances will be conducted in strict conformity to all laws of the State of Colorado, and any violation thereof shall be cause for revocation of the license. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that, pursuant to the criteria in Section 12-6-40 of the Weld County Code, the premises is a safe and proper place for the intended purpose, and that the public morals, public safety or public health of the community, shall be satisfied by the issuance of the license. BE IT FURTHER RESOLVED by the Board that Dance Hall License Number 0393, be, and hereby is, granted to El Centenario Entertainment, LLC, dba El Centenario Nightclub, to conduct dances at the hereinabove described location. BE IT FURTHER RESOLVED by the Board that said License shall be in effect through 12:00 o'clock midnight, December 31, 2018, conditional upon the applicant conducting all dances in strict conformity to all laws of the State of Colorado. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign and issue said License. BOX 758 GREELEY, COLORADO 80632 April 10, 2018 El Centenario Entertainment, LLC dba El Centenario Nightclub 10763 Turner Blvd., Unit 1 Longmont, CO 80504 RE: REPORT OF INVESTIGATION FOR COLORADO LIQUOR LICENSE APPLICATION AND DANCE HALL LICENSE - EL CENTENARIO ENTERTAINMENT, LLC, DBA EL CENTENARIO NIGHTCLUB Dear Applicant: On Friday, April 6, 2018, I traveled to the proposed licensed premises known as El Centenario Entertainment, LLC, dba El Centenario Nightclub, located at 10763 Turner Boulevard, Unit 1, Longmont, Colorado 80504. While there, I made an on -site inspection regarding the Liquor License and Dance Hall License applications filed. The Liquor License application is for a Tavern (County) Liquor License. It will be heard by the Board of County Commissioners as the Liquor Licensing and Dance Hall Licensing Authority for Weld County on April 18, 2018, at 9:00 a.m. My inspection revealed the following: 1. The proposed licensed premises is not directly connected to a different licensed premises, pursuant to Section 12-47-301(3)(a), C.R.S. 2. The diagram of the proposed licensed premises is correct. 3. There are no other Tavern (County) Liquor Licensed premises in the neighborhood, pursuant to 12-47-301(2)(b), C.R.S. There are two (2) other license types located in the immediate area: a 3.2 Percent Beer On -Premise (County) Retail License — Carpco, LLC, and 7 -Eleven, Inc., dba 7 -Eleven Store 39510A, and a Liquor Store (County) License - RLF, Inc., dba CJ's Liquors. The proposed premises has the capability of heating and serving sandwiches and light snacks, in compliance with 1 C.C.R. 203-2, Regulation 47-100(J). 6. The premises is equipped with sufficient water, lighting, parking and restroom facilities to accommodate the number of persons expected to attend dances thereon. The premises is not in such a state of disrepair that it is more likely than not to be a safety hazard to persons expected to attend dances thereon.
