RE: A CHANGE OF ZONE, COZ18-0002, FROM THE C-3 (BUSINESS COMMERCIAL) ZONE
DISTRICT TO THE R-1 (LOW -DENSITY RESIDENTIAL) ZONE DISTRICT - BRADY
RENTALS, LLC
A public hearing was conducted on August 8th, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
• I hereby certify that pursuant to a notice dated June 13, 2018, and duly published June 18,
2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Brady
Rentals, LLC, for a Change of Zone, COZ18-0002, from the C-3 (Business Commercial) Zone
District to the R-1 (Low -Density Residential) Zone District. Frank Haug, Assistant County
Attorney, made this a matter of record.
• Diana Aungst, Department of Planning Services, presented a brief summary of the proposal
and stated the site location in relation to relevant County roads. She indicated staff sent out 16
referrals and received ten (10) responses with no concerns or with comments that have been
included in the staff recommendation. She stated the site is a .41 -acre lot with one (1) existing
single-family dwelling constructed around 1900 and zoned C-3 (Business Commercial), Z-306, in
1979, and explained this Change of Zone will correct the zoning to accurately reflect the
single-family dwelling and make it consistent with surrounding properties. She stated the
proposed site is served by City of Greeley water and sewer. Ms. Aungst displayed images of the
site and adjacent areas and entered the favorable recommendation of the Planning Commission
into the record as written.
• Evan Pinkham, Public Works Engineer representative, provided a brief overview of the
transportation plans and stated the access is from Balsam Avenue and an Access Permit was
issued, AP18-00228, which stipulates using the new access on Balsam Avenue for the small
commercial access and to utilize the existing access for the residential lot. He described Balsam
Avenue as a paved, local load. Mr. Pinkham presented the drainage and grading requirements.
• Lauren Light, Department of Public Health and Environment, reviewed the water and sewer

provisions, stating the City of Greeley provides water and sewer, and as stated in the letter of
referral, has agreed to continue providing water service without requiring annexation. She
indicated no outstanding issues. Commissioner Cozad requested the word "may' be changed to
"shalt' regarding water service provisions on Condition of Approval (COA) #1.E.10.
Steve Gorham, Attorney, represented the applicant and stated the requested Change of
Zone better reflects the site because it is a residential dwelling.
No public testimony was offered concerning this matter.
In response to Commissioner Cozad, Mr. Pinkham agreed to add the access number to the
plat language. Commissioner Cozad reiterated her suggested change from "may' to "shalt' on
COA #1.E.10.
Commissioner Cozad moved to approve the request of Brady Rentals, LLC, for a Change
of Zone, COZ18-0002, from the C-3 (Business Commercial) Zone District to the R-1 (Low -Density
Residential) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval as amended and entered into the record. The
motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:33 a.m.
This Certification was approved on the 13th day of August, 2018.
