Legal Description: Part of the NW4,SW4; NE4,S W4; & SE4, SW4; Section 31; all in Township 3 North, Range 67 West; 6th P.M.; Weld County, Colorado. General Location: South of St. Vrain Creek - East of WCR 13 Colorado Blvd. - North of WCR 26 - and, East of the St. Vrain Sanitation District Plant. Parcel Number(s): 1209-31-0-00-061; 1209-31-0-00-051; 1209-31-0-00-064. Total Acres: 120.00 There remains a resident need to clarify the continuation of some activities commenced under the OMLR permit. Based upon what we know today: 1. Basins and Reservoirs 2 and 4 are completed and suitable for release. 2. Area 3 Agricultural stockpile Area and Recycling Plant and Yard are uses that may continue subsequent to OMLR release of these areas from the permit. 3. This leaves only the vegetation surrounding the existing reservoirs - and planned revegetation of the buffer area for Area 3 for continued supervision under the exiting warranty and permit, unless released by the OMLR. To this end, Varra Companies submitted a Technical Revision as a foundation to establish clarity for the purposes of this Request. The consideration as to what Areas of the permitted lands may be released from the permit and affirming any continuing obligations, if any, should provide greater focus for any remaining lands requiring 1 further attention. The effort will better affirm the suitability of all planned and continuing uses over post release lands and activities with respect to their identifiable areas and purposes. These considerations are detailed in the pending Technical Revision (iterated in part, in blue ink, below - and as supplemented by notes in black): Kim Ogle and Diana Aungst, Weld County Department of Planning Services, verified that the planned post mine activities for the Agricultural Stockpile location and continued recycling activities and uses do not require further permitting with Weld County. Further, on 31 May 2018, Diana Aungst, Weld County Planner and Floodplain Manager; indicated that no FHDP or other floodplain permitting are needed: The revised Dakolios Map as approved by the OMLR by Technical Revision in alters the location of the planned vegetative buffer strips (necessary to better protect the reclaimed return irrigation waters ditch traversing Area 3). This reduces the total area of the planned grassed buffer in Area 3 to 4.01 acres. • The two reservoirs shown (Areas 2 and 4) are completed and shorelines re -soiled and vegetated. Water levels at both reservoirs are below the static; water level when the reservoirs are full. Vegetation has invaded or spread and hydrophytic vegetation increases the closer it approaches current water levels. This vegetation would suffocate and repeat the succession process as the reservoirs fill and empty over time. The estimated area of vegetation reported in the 2011 Amendment is the best estimate of the vegetation that would remain beyond and above the static water level of the reservoirs, and formed in 2011 part of the basis of approval met at that time. Conditions along the reservoir shores are documented in the included Photo Documentation Log Map (attached) and Photo Log description, below. • Area 1 is outside of the present day 100 -year floodplain. The existing scalehouse and stockpile area surrounding it is outside and above the present day 10- year floodplain. • Weld County is aware and acknowledges that the existing scalehouse and yard that presently occupy this location, supports on -going and continuing recycling activities and will remain in place and active subsequent to planned OMLR release. The remainder of the focus is upon Area 3. • Area 3 outside the buffer strips pertains to: 1. Sub -area A: These are locations for planned agricultural stockpiles and mobile equipment which lie within the approximate 100 -year floodplain, consistent with that for common agricultural activities found in the A- Agriculture Zone. Sub -area B: The location of the concrete and asphalt recycling processing equipment and stockpiles - which are also outside and above the approximate 100 -year floodplain - are activities consistent with that found in the A- Agriculture Zone and acknowledged as an allowed use under the existing Weld County USR 616; and will remain so subsequent to release of the OIVII,R permit. 3. Sub -area C: This is a defined area of a 4.0+1- acre buffer strip and vegetative filter to better stabilize and segregate lands from planned activities. The strip has been modified from the previous Technical Revision by changing the location of the buffer from along the southern boundary of the recycling area, to 25 feet either side of the existing buffer strip - where it will provide the greater benefit. Please refer to the revised Reclamation Plan Map included with this revision. • With the completion of grading, soiling, and revegetatiori of all areas other than the 4.0+ /- vegetative buffer of Area 3(c), no other reclamation activity remains. For this reason, the existing $87,200.00 financial warranty may be reduced to the current cost of seeding the 4.0+1- acre buffer strip. There remains a resident need to clarify the continuation of some activities commenced under the OMLR permit. To this end, Varra Companies met with Weld County Planning Staff to clarify the status of operations with Weld County once an OMLR release of the permit occurs. In a meeting with Kim Ogle and Diana Aungst on 3 May 2018, Kim verified that the planned post mine activities and uses do not require further permitting with Weld County. Specifically, recycling activities may continue under the authorization of the existing USR subsequent to the release of the permit by the OMLR. This acknowledgement is based upon an earlier understanding established in May 2011 with Planning Staff and Tom Parko, Director of Weld County Planning Services. 1 Further, on 31 May 2018, Diana Aungst, Weld County Planner and Floodplain Manager; indicated that no FHDP or other floodplain permitting are needed: • The Dakolios Map as approved by the OMLR by Technical Revision in 2013 is included with this correspondence for ease of reference. Also included as part of this Technical Revision is a revised map altering the relocation of the planned vegetative buffer strips (necessary to better protect the reclaimed seep/irrigation ditch traversing Area 3). Beyond that - no other changes are anticipated, with the exception of some clarifications, detailed as follows. • The two reservoirs shown (Areas 2 and 4) are completed and shorelines re - soiled and vegetated. The planned scalehouse and stockpile area surrounding it is outside and above the present day 10- year floodplain. • Area 1 is outside of the present day 100 -year floodplain. Weld County is aware and acknowledges that the existing scalehouse and yard that presently occupy this location, supports on -going and continuing recycling activities and will remain in place and active subsequent to planned OMLR release. The remainder of the focus is upon Area 3. • Area 3 outside the buffer strips pertains to: 1. Sub -area A: These are locations for planned agricultural stockpiles and mobile equipment which lie within the approximate 100 -year floodplain, consistent with that for common agricultural activities found in the A - Agriculture Zone. 2. Sub -area B: The location of the concrete and asphalt recycling processing equipment and stockpiles - which are also outside and above the approximate 100 -year floodplain - are activities consistent with that found in the A - Agriculture Zone and acknowledged as an allowed use under the existing Weld County USR 616; and will remain so subsequent to release of the OMLR permit. 3. Sub -area C: This is a defined area of a 4.0+/- acre buffer strip and vegetative filter to better stabilize and segregate lands from planned activities. The strip has been modified from the previous Technical Revision by changing the location of the buffer from along the southern boundary of the recycling area, to 25 feet either side of the existing buffer strip - where it will provide the greater benefit. Please refer to the revised Reclamation Plan Map included with this revision. • With the completion of grading, soiling, and revegetation of all areas other than the 4.0+ /- vegetative buffer of Area 3(c), no other reclamation activity remains. For this reason, the existing S87,200.00 financial warranty may be reduced to the current cost of seeding the 4.0+/- acre buffer strip, or $124.43/acre x 4 Acres Varra Companies, Inc.
